Abstract

This research focused on the aspects of inequality and legal uncertainty due to the double taxation (double taxation) on the same object. As a result, the tax burden felt by the public will feel heavy. The research also examines the Constitutional Court ruling on the petition for the perceived tax law has imposed double taxation on an object the same tax. Analysis of the research done by looking at the tax benefit that should be used for national interests rather than the interests that are regional (sectoral) because of the potential tax on an area. Moreover, coordination among government agencies that are not effectively be an additional analysis to be more comprehensive in its discussion.

Abstract

To review the achievements of legal development during reformation era, shall be a parameter to be a foundation; which are some causes that led to the need for legal reform. In other word, it need to be identified what were the problems of legal development during the New Order era which in turns pushed to the rise of legal reform subsequently after political reform in 1998. There were problems addressed by legal reform, such as, the amendment of 1945 Indonesian Constitution, judicial reform through the amendment of Judicial Power Act, the inception of Corruption Eradication Commission, and also the inception of some new bodies which are considered to be helpful for the purpose of an effective legal enforcement and the maintenance of democracy.Keywords: : achievement, projection, current Indonesian legal system

Abstract

This research discusses the development of bases of liability in international laws and its implications to any outer space activities. The research method was normative-juridical. The findings show that: first, based on the development history, there are three bases of liability in international laws; each has its own characters and implementation mechanisms. Second, the important implications of the development of bases of liability in international laws of outer space activities are written in Article II and Article III Liability Convention 1972 which are the elaboration of the stipulations in Article VII of the Outer Space Treaty 1967. As a consequence of Indonesian’s participation in international outer space laws, bases of liability which is mentioned in Article II and Article III Liability Convention 1972 should be implemented in national legislation related to the liability in any outer space actitivies in Indonesia.

Abstract

The role of advocates is of significant importance in the corruption eradication, especially  in the side of litigation process.  During litigation process, there is ethical dilemma experienced by such advocates in accomplishing advocacy on behalf of the client.  In such situation, the courage of an advocate in holding up the Advocate Ethical Codes is very demanding.

Abstract

The research is focused on the implementation of vage normen as a discretion law source done by children police penyidik and on the kind of crimes done by children that can be discrete. The method used is the normative legal research through literature that is a research for secondary data as law material. The result proves that the police discreet taken from vage normen is not implemented yet as there is no clear rules about it. the kind of children crimes that may be discreet are clash, stealing, money game, vandalism, dangerous burning for others’ property, stealing, smuggling, crime trial, passing on stolen’s goods, destruction, public means destruction, destroying things, rascals, breaking traffic regulation, dangerous fireworks, being truant, running away from home, psychotropic involve, traffic accident’s suspect, hanging out over midnight, breaking personal rules and smoking.Key words : Vage normen, discretion, investigation, non juridic, well-being of the juvenile

Abstract

The problems discussed in this research are: first, how is the relationship between liquidation concept and the bankruptcy of solvable and viable (prospective) companies in Indonesia? Second, how is the attitude of the Supreme Court towards the bankruptcy of solvable companies in Indonesia? Third, how is the ideal concept of Indonesia’s corporate bankruptcy law in the future? This was a normative research. This research concludes, first, there is a relationship between the bankruptcy of solvable and viable (prospective) companies in the Commercial Court and liquidation concept implemented in Bankruptcy Law. Second, related to the bankruptcy of solvent companies in the Commercial Court, the Supreme Court calls off the adjudication of the Commercial Court according to several considerations, including the fact that the companies are still prospective and deserve an opportunity to continue their business and the bankruptcy proposal cannot be proven in a simple way. Third, the ideal concepts of Indonesia’s bankruptcy law in the future are (i) Separating the bankruptcy of corporate and individual. (ii) Insolvent becomes a standard of corporate bankruptcy. (iii) Implementing the principles of business continuity which becomes a concept of corporate rescue in the norm of Corporate Bankruptcy Law or Limited Liability Company Acts. (iv) There is a stricter regulation of revocation of bankruptcy of companies which no longer own their assets.

Abstract

Based on the principle of state responsibility, the state will guarantee that the utilization of natural resources will provide benefits for the greater well-being and quality of life, both present and future generations as a goal of the implementation of sustainable development. The problems that would be investigated are; first, how is the state responsibility as a basis of the implementation of environmental protection and management? Second, how is the implementation of state responsibility as a basis of the implementation of environmental protection and management? The method used in this research is juridical normative with regulation approach. The analyze method used is qualitative analysis. The research concludes that the principle of state responsibility position as the basis for the implementation of environmental protection and management means: 1) State guarantees that the utilization of natural resources would provide benefits for the greater well-being and quality of life, both present and future generations. 2) State guarantees the rights of citizen for a good and healthy living environment. 3) State prevents the use of natural resources activities that cause pollution and/ or damage the environment.Key words : State responsibility, environmental protection and management

Abstract

The existence of abortion is more frequent in cities than in villages, and most of abortions are done deliberatively, especially in the cities. The problems which will be studied are: First, when does life begin based on the medical study? Second, how should the prevailing laws (ius constiuendum) be to protect the unborn child? Related to the protection for unborn child, the research using normative method has already been conducted. The research result shows that: first, life begins since the conception based on the medical finding. Second, as the result, Article 75 verse (2) b of Law of Health both horizontally and vertically is not synchronous with the prevailing regulations of law. For the legal assurance, Article 75 verse (2) b of Law of Health needs to be reviewed.
