Abstract

People of Nagari Ampang Kuranji implement exogamous marriage in the form of inter clan and kinship marriage. This exogamous marriage, however, are varies among the nagaris. The existence of datuak in every clan brings an effect to the possibility of a groom to have a bride from one clan under the condition of different datuak. Customary fines will be applied to those who trespasses this customary regulation. This article tries to elucidate exogamous marriage in Ampang Kuranji from the perspective of Islamic law. Utilizing ‘urf perspective, this article argues that exogamous marriage among people of Nagari Ampang Kuranji can be considered as ‘urf sahih, a customary tradition that is inline with Islamic teachings.

Abstract

Religion is a social institution, especially for the Muslim community in general, determine the dynamics of the entire development community. In many cases the social processes that marginalizing women, intentionally or not, often involving religion as elements forming knowledge about relationships between men and women are unequal, and often used as a source of theological legitimacy of the above indisputable fact that marginalize women. During this time, the field of study of the Qur’an many scholars dominated philology and history. This led to a prolonged confusion between the text and the history of salvation history, which is implicit in it. This needs to be solved, with the view that the text of the Quran and his commentary as an expression of the views of Islam. This is where the importance of the legacy of structuralism in a given interpretation. By using Levi-Strauss structuralism, an attempt to determine the relationship webs in the narrative, the relationship is either syntagmatic or paradigmatic, to find hidden messages or messages that are deepest in the verses of the Qur’an.

Abstract

Indonesia is a nation in which the majority of its fellow citizens adhere to Islam. This furthermore stands as one of the reasons in creating judicial institution that specifically deals with Muslim judicial matters. Poligamy permit is an example of judicial matters subsumed under the jurisdiction of Religious [Islamic] Court. Despite of the fact that Islam recognizes polygamy, the intended person has to file polygamy permit to Islamic court for the sake of administrative order due to monogamy principle practiced within marital affairs. The Islamic court has the authority to look into the subjects involved in order to determine whether it is reasonable to grant the petition or not. This is however deployed to anticipate discrimination, right and responsibility abuses, and to reach verdicts that represent justice, utility, and legal certainty.

Abstract

Kajian ini difokuskan pada pembahasan terhadap mekanisme dalam usul fikih yang digunakan untuk melakukan penemuan dan juga perubahan hukum syariah, dengan referensi khusus terhadap salah satu problem yang dihadapi dunia Islam saat ini, yaitu masalah penanggalan. Penulis mengkaji tiga metode penemuan hukum dalam teori hukum Islam, yaitu metode bayani, metode kausasi, dan metode sinkronisasi dengan fokus pendalaman pada yang kedua dan memberikan contoh kasus keharaman rokok dalam beberapa fatwa kontemporer dan kasus penjatuhan talak di depan pengadilan seperti yang berlaku di Indonesia. Begitu pula penulis berpendapat bahwa ada empat syarat untuk suatu ketentuan hukum syariah dapat diubah dengan contoh kasus kebolehan perempuaan memangku jabatan publik seperti menjadi presiden yang secara harfiah nas dilarang. Lebih lanjut penulis menggunakan mekanisme tersebut untuk memecahkan problem penanggalan Islam dalam suatu perspektif global, dan menyimpulkan bahwa penanggalan Islam global tidak mungkin dibuat tanpa berpegang kepada hisab astronomi dan karenanya harus dilakukan reinterpretasi terhadap hadis-hadis rukyat dengan menggunakan mekanisme yang telah dijelaskan terdahulu

Abstract

Family economy is one of the supporting factors in making household harmony. Various ways are taken by the couple of husband and wife to increase the family economy. One of the ways is working abroad or becoming migrant workers. The majority of husband or wife in Banjarsari, Nusawungu, Cilacap go abroad in reason to improve the family economy that their families hopefully become more harmonious. However, after their family economy are fulfilled, dispute in their domestic household often happens, even it causes divorce. This paper explains the basis of normative and juridical causes of the divorce among the migrant workers in Banjarsari, Nusawungu, Cilacap.

Abstract

The most important thing to consider following every divorce is the matter of child custody (hadanah). At this point, Ulamas differ whether the right of mothers toward custody is annulled or not should they remarry. Jumhur Ulamas argue that mother’s right is annulled in this case, but Ibnu Hazm differently argues that the mother still holds her right on child custody under condition that she could be trusted in nurturing children. From scriptural point of view (nas), the writer found the solution that the anxiety of Jumhur toward remarried mother in neglecting child’s right can be vanished should the mother and step father could be trusted both in taking care and educating the child (Ibnu Hazm). Furthermore, exposed to Indonesian legal discourse, It is argued that the book entitled al-Muh}alla> written by Ibnu H}azm inevitably becomes additional source of the creation of KHI (the compilation of Islamic law). Eventually, this study confirms previous notions stating that Ibnu Hazm’s tought is relevant and applicable within Indonesian context.

Abstract

Ideally every child has his or her own father and mother who carry out their roles responsibly. However, in reality there are a number of children with disabilities who are ignored by their parent and consecutively taken care, nurtured, and guided by Yayasan Sayap Ibu. In order to protect the children, the caretaker of Yayasan Sayap Ibu deploys following efforts: preserving mind or intellect through education, preserving lineage (nasab) through nurturing and caretaking, and protecting property through many aids allocated to fulfill children needs. In sum, the article tries to examine whether the protection provided by Yayasan Sayap Ibu is in line with the theory of maqâsid asy-syari’ah or not. The theory consists of five pillars as follow: hifz din (protection toward religion), hifz nafs (protection toward soul), hifz aql (protection toward mind), hifz nasl (preserving toward lineage) dan hifz mal (protection toward property.

Abstract

Indonesian state is constituted of various races and cultures which reflect plural societies and create culture, art, and different customs as informal education of the society. Multicultural society is a society that acknowledges plurality as the matter of Indonesian nation. This kind of society can be easily found at Teluk Panji II village characterized as one of transmigration areas. Inter-cultural harmony is also depicted through marital system with different cultural background. For example, multicultural society will contribute to create equal position of different cultures. Multicultural society is relatively new term which is introduced by Canadian State around 1970s. This furthermore produces cultural fusion which bounds the relationship of plural society into multicultural one adhering to different kinship system. In sum, the law of inheritance implemented differs with those applied among families concluded through endogamy marriage.

Dalam banyak kasus proses sosial yang memarginalisasikan perempuan, sengaja atau tidak, sering melibatkan agama sebagai unsur pembentuk pengetahuan tentang relasi laki-laki-perempuan yang timpang dan seringkali dijadikan sumber legitimasi teologis yang tidak terbantahkan atas kenyataan yang menyudutkan perempuan. Selama ini, bidang kajian al-Qur’an banyak didominasi sarjana filologi dan sejarah. Ini memunculkan kerancuan berkepanjangan antara sejarah teks tersebut dan sejarah penyelamatan, yang secara implisit terkandung di dalamnya. Hal ini perlu dipecahkan, dengan memandang bahwa teks al-Qur’an dan tafsirnya sebagai ungkapan pandangan-pandangan Islam. Di sinilah pentingnya strukturalisme dalam memberi kekayaan khazanah penafsiran. Dengan menggunakan strukturalisme Levi-Strauss, sebuah upaya untuk mengetahui jaring-jaring relasi dalam narasi, baik relasi tersebut bersifat sintagmatik maupun paradigmatik, untuk mengetahui hidden message atau pesan terdalam yang terdapat dalam ayat-ayat al-Qur’an.]
