Abstract

Abstract: A man is allowed to marry more than one woman with one important require?ment, have an ability to act fairly. The sources of Islamic law, the Al-Quran and As-Sunnah, do not explain in detail the procedures or techniques of fairness for polygamous husbands. However, in the Law No 1 of 1974 concerning Marriage there are articles governing poligamy, as in Article 4 and Article 5. Those provisions show that in the? context of Islam Nusantara fiqh, polygamy is open to all men who want to marry more than one woman, but at once closed to a man who unable to the legislation require?ments. Through literature studies with jurudic-normative approach, this study found that Indonesia has its own approach to ensure that a polygamous husband can act fairly toward his wives. The article 4 and 5 of Law No. 1 of 1974 on Marriage proofing the intention. Therefore, the position of legislation as a result of Islamic Law transformation into national law becomes a concrete form of Islam Nusantara?s fiqh that has been applied in Muslim community life.Abstrak: Seorang suami boleh beristri lebih dari seorang dengan syarat memiliki kemampuan melaksanakan keadilan. Sumber hukum Islam, yakni Al-Quran dan As-Sunnah tidak menjelaskan secara rinci tata cara atau teknis melaksanakan keadilan untuk suami yang poligami. Akan tetapi di dalam Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan terdapat pasal-pasal yang mengatur prinsip keadilan secara yuridis dan teknis, sebagaimana pada Pasal 4 dan Pasal 5. Dengan ketentuan peraturan per?undang-undangan tersebut dapat dipahami bahwa dalam konteks fiqh Islam Nusantara poligami terbuka untuk seluruh pria yang hendak menikahi lebih dari seorang isteri, akan tetapi sekaligus tertutup bagi pria yang bermaksud melakukan poligami apabila tidak terpenuhi persyaratan yang ditetapkan oleh peraturan perundangan-undangan yang ber?laku. Melalui studi literatur dengan pendekatan yurudis-normatif, penelitian ini mene???mu??kan bahwa Indonesia memiliki pendekatan sendiri untuk memastikan bahwa suami yang poligami dapat bertindak adil terhadap istrinya. Pasal 4 dan 5 UU No. 1 tahun 1974 tentang Perkawinan membuktikan niat tersebut.? Oleh karena itu, posisi legislasi sebagai hasil transformasi Hukum Islam menjadi hukum nasional menjadi bentuk konk?ret fiqh Islam Nusantara yang telah diterapkan dalam kehidupan masyarakat Muslim.

Abstract

This paper is simply explaining on the legal norms of human rights in the Quran through critical study on the Quranic interpretation Surah al-Nisâ’ verse 135. As the primary source of Islamic law, the Quran is believed covered the various verses which are relevant with the legal norms of human rights. Moreover the guarantee of human rights and its consideration in the Quran has been presently existed more than the idea of human rights in Western world. In addition, the crucial proble here is not talking about accepting or rejecting human rights within the Quran, but many scholars find the difficulties on understanding human rights in the Quran more than accepting it as the Holy Book and the way of life for human beings.

Abstract

Prayer is one of the obligations of a believer to his God, prayer has various virtues and wis­dom, both in terms of religious, psychological, and social. Thus, prayer is the most important worship in Islam. In carrying out prayer, Muslims should not be carelessly, it is because prayer is worship predetermined time and how. In modern times, we are not going to be difficult in knowing the prayer time because many Islamic organi­za­tions, even governments make prayer schedule as a reference in the salat. Never­theless, we need to know the time of prayer based on a naturally occurring pheno­me­non, so that our knowledge is more comprehensive. In its implementation, some scho­lars have the same opinion in the interpretation of the hadith about prayer ti­mings exemplified by the Prophet. But there are also some scholars have different opi­nions about the interpretation for the determination of some prayer time. As an example the opinion of Imam Shafii and Imam Hanafi about the start time of Asr and Isha prayer which different opinions in the interpretation of the hadith of the Prophet Muhammad.

Abstract

Corruption is a criminal act which is getting the attention of many people. So, it need to get attention from the perspective of Islamic Criminal Law, both conceptually and operationally. Therefore, this paper is not only describe the historical development of concepts and theories of Islamic criminal law relating to the criminal law of corruption, but also specifically explained about nazhariyyah al-ta‘zîr criticism in legal theory of Ta‘zîr to the Law 20 of 2001 on the Eradication of Corruption. The main purpose of this article is to provide an overview of the theoretical possibility of ta‘zîr sanctions for perpetrators of corruption in Indonesia through nazhariyyah al-ta‘zîr and its relevance to the Law Number 20 Year 2001 on Eradication of Corruption.

Abstract

According to the form of legal development (al-tasyrî‘), nazhâriyyat al-‘uqûd is resulted from the transformation process of sources, principles, and bases of Islamic economic values which are derived from the Quran and the Sunna into the pracstical of Islamic business. It is also firstly begun through the analysis and translation on nazhâriyyat al-‘uqûd by the muslim scholars in the book of fiqh. The concept of business transaction (mafhum al-‘uqûd) in Islamic legal contract is based on three theories: First, the theory of property rights (nazhâriyyat al-milkiyyah ‘alâ al-mâl); Second, the theory of business transaction (nazhâriyyat al-‘uqûd); and Third, the theory of property management (nazhâriyyat al-intiqal al-milkiyyah). These are starting point to examine the consept of business transaction (mafhum al-‘uqûd) within Islamic legal contract to dealth with the Islamic practical rule of direct selling.

Abstract

Syekh Mahmûd Syaltût stated that Islamic law is a universal legal system that made it lives and thrives in society. Islamic law is an independent legal system, not taken from other laws, so it has own character. The sources of Islamic law are derived from the Koran, Sunna, and ijtihâd. The truth of ijtihâd is relative and dzanni, but it will be received by us if it is not contradicted to the Sharia or sacred texts. Thus, It makes a difference opinion among the scholars in the process of ijtihâd on how to formulate Islamic law (istin­bâth al-ahkâm) which is caused by three things: First, the formulation of rules (al-tahsîs). There are scholars who hold to the understanding uslub or dalil syara’ and some scholars adhered to the issues of branches (furu‘); Second, the metho­dology (man­haj) or the formulation of the legal methods that used, both inductive and deductive; Third, aspects of thinking which is the fundamental basis of the scholars that used in ijtihâd. Development and validity of ijtihâd will always still be opened and dynamic, which is following the development of human thought and the dynamics of Islamic law.

Abstract

The development of religious court in Indonesia is existing while the establishment of Islamic law as part of national law system. It is influenced by the improvement of legal thought which is the background of Islamic law legislation. In independence period, exactli on 1970, the government emphasizes the existence of religious court through the law of court institution number 14 of 1970. On 1977, Indonesian Supreme Court pusblished the rule of Islamic court through the law number 7 of 1989 in which give the religious court for casation to supreme court.

Abstract

Waqf is one means to make people more prosperous, it is pointed out that Islam as a religion that always offers mankind to live a more prosperous by way of organizing and managing the waqf. However, several decades after the dissolution of the revelation that explains about waqf, it does not really appear as an offer religion that leads to prosperity. Then Islamic law needs to legitimize waqf back into the practice of more productive endowments and to be a source of public finance.

Abstract

Al-Ghazalî is known as an intellectual figure who mastered various sciences. Almost all the religious aspects he studied in depth, including the issue of money. The learning process he did until he died. In the field of Islamic knowledge, there are proof which show many scholars who admitted to his mastered knowledge with tremendous enthu­siasm. This paper is presented to describe the thought of al-Ghazalî, such as the under­stan­­ding of money, the concept of money, the kind of money, the function of money, and the contribution of money to the Islamic economic system. The sources of data in this paper takes a lot from the phenomenal book of al-Ghazalî, namely Ihya al-‘Ulûmuddîn, as well as from other books related to this paper.

Abstract

In Islamic inheritance law system, ulama agreed on the distribution of waris as an ‘ashabah, especially among Sunni. However, it is different from the opi­nions of ulama among Syi’ah Itsna ‘Asy‘ariyyah which stated that ‘ashabah is out part from the Islamic inheritance law system. In determining the law, ulama Syi­’ah Itsna ‘Asy‘ariyyah refers to the Koran, Hadith, and the consensus of the ulama (ijma), and the thought by different ways and methodologies with Sunni. Ulama Syi’ah Itsna ‘Asy‘ariyyah has understood ‘ashabah with their own understanding. They said that ‘ashabah (the residual) is only given to a group of men from tirkah given to ‘ashabah al-furudl, they thought that the residual must be returned to all thabaqat certain groups. Therefore, ulama Syi’ah Itsna ‘Asy‘ariyyah were denying the extance of ‘ashabah In the Islamic inheritance law system. Based on the issue, this paper try to explain the under­stan­ding of  ulama Syi’ah Itsna ‘Asy‘ariyyah in determining the law, especially in field of ‘ashabah.
