Abstract

The rural population is a basic capital for national development, owned by the people and the Indonesian nation. In the constitutional structure of the Republic of Indonesia, the Village has developed in various forms and is obliged to be protected and empowered to be strong, advanced, and democratic and democratic so as to carry out governance and development towards a just, prosperous and prosperous society. The involvement of the Village Head in resolving conflicts within rural communities has made the writer interested in studying the nature of cases out of court settlement by the Village Head against the village community and the reformulation of legal policies in implementing the nature of the settlement of a non-court problem. The approach used in this research is statute approach, historical approach, and conceptual approach, and case approach. The results of this study states that solving a problem that occurs in the village by placing the Village Head as a peace judge is a form of discretion / policy of the executive in order to realize public service for the community. In other words because it is a discretion, it certainly follows the laws and regulations that state the limits of it.

Abstract

Dewan Perwakilan Rakyat Re[ublik Indonesia merupakan salah satu lembaga Negara yang mengalami dampak perubahan itu. Salah satu lini yang secara signifikan mengalami perubahan adalah pada lini fungsi. Pasca perubahan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Dewan Perwakilan Rakyat mempunyai tiga fungsi dimana perihal tersebut diamanatkan dalam pasal 20A (1). Ketiga fungsi tersebut adalah fungsi legislasi, fungsi anggaran dan fungsi pengawasan. Salah satu fungsi pengawasan yang dimiliki oleh Dewan Perwakilan Rakyat adalah Hak angket. Sebelum adanya perubahan kedua Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, fungsi pengawasan Dewan Perwakilan Rakyat hanya diatur dalam penjelasan umum, dan hal ini-pun masih terlihat sangat umum dan belum secara eksplisit dijelaskan. Kemudian pasca perubahan kedua Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, kemudian hak angket sebagai salah satu fungsi pengawasan ini diatur lebih tegas yaitu dalam Pasal 20A (2). Akibat hukum dari penggunaan hak angket Dewan Perwakilan Rakyat ini terhadap kebijakan Presiden dapat mengarah kepada upaya pemberhentian presiden dan,atau Wakil Presiden, jika kebijakan presiden tersebut melanggar pasal 7A Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Hal ini mungkin saja bisa terjadi, maka dari itu penulis menganggap hal ini perlu untuk dipahami dan dikaji lebih dalam.

Abstract

Teknologi merupakan kebutuhan seluruh bangsa, walau terkadang untuk memperolehnya membutuhkan biaya yang cukup mahal. Upaya memperoleh teknologi melalui alih teknologi merupakan keniscayaan bagi Negara berkembang seperti Indonesia. Karenanya perlu diupayakan melalui berbagai cara agar dapat mendorong pertumbuhan ekonomi. Banyak ragam terjadinya alih teknologi, salah satu caranya melalui waralaba. Pintu masuk alih teknologi dapat ditemukan dalam persyaratan maupun perjanjian waralaba yang terdapat dalam Peraturan Pemerintah Nomor 42 Tahun 2007 tentang Waralaba, khususnya di dalam Pasal 3 yang menegaskan adanya persyaratan waralaba adalah adanya hak kekayaan intelektual terdaftar.

Abstract

ASEAN countries need to be encouraged to make responsive, effective, efficient, non-discriminatory, and pro-competition regulations that are adjusted AEC Blueprint 2025. This means that each ASEAN country needs to harmonize regulations so that the rules that apply in each national territory do not conflict with each other and in line with AEC Blueprint 2025. There is no clear regulation system in force in ASEAN, nor is the legal harmonization mechanism and binding power of the AEC. Questions that should be asked, is the legal basis for the implementation of AEC Blueprint 2025 deliberately based on international agreements only (intergovernmental, soft law) and not upgraded to legal force (primacy principles, hard law)? The most important thing is that there is a shared awareness to build the ASEAN region's economy more productive, advanced and shared prosperity. The commitment is not enough just to use soft law approach, but must be followed by hard law approach (primacy principles). ASEAN leaders should hold talks and seek agreement to implement the principle of supranational (primacy principles) that the implementation of the AEC Blueprint 2025 be adhered to by all member states.

Abstract

Abstract This article indicates how tax legislations, both in direct and indirect fields, of ASEAN countries should be harmonized. With respect to direct taxation, the issue of direct tax rates harmonization - personal income tax and corporate income tax - will firstly be discussed. Further, I will look into how the personal income tax treatment on a resident exercising the free movement of skilled labour should be. In addition, how to enhance the network of tax treaties between ASEAN Member States and withholding tax levied on cross-border transaction will also be described. As regards indirect taxation, I will consider to what extent such the consumption tax systems as VAT and GST in each ASEAN countries could be in accordance with each other. Finally, what challenges over tax harmonization in ASEAN can be will be noted. The majority of the discussions above will be based upon the tax harmonization and coordination already conducted within the EU.

Abstract

Indonesia yang tergabung dalam PBB turut mengambil langkah awal dalam kebijakan yang diratifikasi dengan persetujuan pembentukan WTO melalui Undang-undang No.7 tahun 1994, yakni keterikatan untuk melaksanakan seluruh hasil kesepakatan perundingan Uruguay.  Peraturan penanaman modal asing sesungguhnya tidak secara tegas termuat dalam perjanjian WTO, namun secara eksplisit muncul dalam rumusan prinsip-prinsip perdagangan bebas khususnya terkait prinsip non diskriminasi yang meliputi Most Favoured Nation (MFN) dan National Treatment Principle (NT). penanaman modal asing merupakan solusi bagi negara-negara berkembang, seperti Indonesia untuk mengoptimalkan pengelolaan sumber daya alam dan potensi ekonomi (economic resource) agar bernilai lebih tinggi. Dibentuknya Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal dimaksudkan untuk menarik investor asing dan investor dalam negeri. Permasalahan yang akan dibahas dalam tulisan ini yaitu terkait  kewajiban diterapkannya  Prinsip non-diskriminatif dan  National Treatment atau perlakuan yang sama bagi penanam modal asing di Indonesia dan penerapan prinsip Non-Diskriminatif dan National Treatment dalam kasus Pengadaan Mobil Nasional Indonesia. Kesimpulan yang didapat yakni Pemerintah Indonesia sudah menerapkan prinsip Non-Diskriminatif dan National Treatment dengan menerapkan prinsip tersebut di dalam Undang-undang Nomor 25 Tahun 2007 tentang Penanaman Modal. Indonesia juga menerapkan Prinsip Non-Diskriminatif dan National Treatment dalam Kasus Pengadaan Mobil Nasional Indonesia dengan  menjalani putusan yang mewajibkan Pemerintah Indonesia mencabut semua Keputusan Presiden beserta Peraturan lainnya yang terkait dengan persyaratan kandungan lokal.

Abstract

ABSTRACTThis paper raises the legal issue regarding the juridical enactment of Village Regulations seen from the perspective of the formal principle of the institution of the formation of legislation in accordance with the principles of the formation of legislation stipulated in Law Number 12 of 2011 concerning the Establishment of Legislation. Identification of the problem under study is how does the juridical enactment of Village Regulations be seen from the perspective of the formal principle of the formation of legislation? Can the Village Consultative Body as a village head partner in forming Village Regulations be qualified as an institution for establishing village legislation? This research is normative legal research, using a statute approach, utilizing primary, secondary and tertiary legal materials. Analysis of legal material is carried out using qualitative analysis, with deductive reasoning. The results showed that the juridical enactment of Village Regulations was viewed from the perspective of the formal institutional principle of formation, because the Village Consultative Body could not qualify as a Village Representative Body, whereas according to the formal principle of establishing good village regulations, Village Regulations were made by the Village Representative Body together with the head village. The village does not have a Village Representative Body, but a Village Consultative Body. Therefore the Village Regulations established by the Village Consultative Body together with the village head did not fulfill the principle of juridical enforceability, which emphasized that the legislation must be formed by the appropriate forming institution, in this case, the Village Representative Body together with the village head. Keywords: enforceability, juridical, formal principles, institutions, village regulations.ABSTRAKTulisan ini mengangkat isu hukum mengenai keberlakuan yuridis Peraturan Desa dilihat dari perspektif asas formal kelembagaan pembentukan peraturan perundang-undangan sesuai dengan asas pembentukan peraturan perundang-undangan yang diatur dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Identifikasi masalah yang diteliti yaitu bagaimanakah keberlakuan yuridis  Peraturan Desa dilihat dari perspektif asas formal kelembagaan pembentukan  peraturan perundang-undangan? Apakah Badan Permusyawaratan Desa sebagai mitra kepala desa dalam membentuk Peraturan Desa dapat dikualifikasikan sebagai kelembagaan pembentukan peraturan perundang-undangan di desa? Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan peraturan perundang-undangan (statute approach), memanfaatkan bahan hukum primer, sekunder dan bahan hukum tersier. Analisis bahan hukum dilakukan dengan menggunakan analisis kualitatif, dengan penalaran deduktif. Hasil penelitian menunjukkan bahwa keberlakuan yuridis Peraturan Desa Peraturan Desa dilihat dari perspektif asas formal kelembagaan pembentukannya, karena Badan Permusyawaratan Desa tidak dapat dikualifikasikan sebagai Badan Perwakilan Desa, padahal menurut asas formal pembentukan peraturan desa yang baik, Peraturan Desa dibuat oleh Badan Perwakilan Desa  bersama dengan kepala desa. Desa tidak memiliki Badan Perwakilan Desa, melainkan Badan Permusyawaratan Desa. Oleh karena itu Peraturan Desa yang dibentuk Badan Permusyawaratan Desa  bersama kepala desa tidak memenuhi asas keberlakuan yuridis, yang menekankan bahwa Peraturan perundang-undangan harus dibentuk oleh kelembagaan pembentuk yang tepat, dalam hal ini Badan Perwakilan Desa  bersama dengan kepala desa. Kata Kunci: keberlakuan, yuridis,  asas formal, kelembagaan, peraturan desa.

Abstract

The process of land acquisition for development for wide-ranging public interest is always carried out with the stages as stipulated in Law Number 2 Year 2012 and its implementing regulations. However, other things with the procurement of small-scale land that can be done by way of sale and purchase, exchange or other means agreed by both parties without going through the stages set forth in the laws and regulations implementation. Article 121 of Presidential Regulation No. 148 of 2015 in paragraph (3) states that small-scale land procurement can be carried out without location determination. In the absence of a location stipulation in small-scale land acquisition resulted in agencies requiring land can not consign or take care of damages in court because one of the conditions set forth in Supreme Court Regulation No. 3 of 2016 to do consignment or nursing in court requires determination location set by governor or mayor / regent.

Abstract

Abstract There is a vivid imbalance in farm land domination. This emerge conflict in almost Indonesia territory.  Structuring the ownership or control of land has been started since the Act Numebr 5 of 1960 as the reference in the structuring of the agricultural land holdings in Indonesia. However, what is hoped and be the justification reason the act seems has not shown as demanded. Based on  Decree of Head of BPN RI Number 34 of 2007 on Technical Guidelines for Handling and Resolution of Land Issues, land conflicts arise regarding the issue of tenure, ownership, use or utilization of the plot of land. The enactment of Law No. 18 of 2004 on Plantations also open conflicts between farmers and plantation companies. Conflict occurs when the plantation is difference between one or more people or groups of people with plantation companies relating to land tenure estates. There are several factors that cause conflict, especially agricultural land tenure plantation land, namely: (1) inequality of agricultural land holdings; (2) there is a vagueness setting land rights; (3) wasteland physically; and (4) overlapping land ownership. Recalling the complexity of the conflict over land, land conflict resolution should be based not only on purely formal legal approach but also through other approaches such as economic, social and cultural.

Abstract

Laju kerusakan kawasan hutan terus terjadi disebabkan oleh berbagai faktor diantaranya yakni lemahnya pengendalian dan pengawasan terhadap operasionalisasi sistem perizinan dalam pengelolaan kawasan hutan, alih fungsi, alih fungsi kawasan hutan menjadi perkebunan, pemukiman dan/atau untuk kepentingan non kehutanan lainnya (Pertambangan). Tujuan yang ingin dicapai dalam tulisan ini yaitu mengetahui dan memahami terkait dengan mekanisme penerapan Tanah Objek Reforma Agraria dalam Kawasan Hutan berdasarkan Peraturan Presiden Nomor 88 Tahun 2017 dan Faktor penghambat dalam penerapan Tanah Objek Reforma Agraria dalam Kawasan Hutan berdasarkan Peraturan Presiden Nomor 88 Tahun 2017. Tulisan ini merupakan penulisan hukum normatif dengan menggunakan metode pendekatan kasus. Hasil yang didapatkan yaitu, sosialisasi secara komprehensif terkait mekanisme yang diatur dalam Permen LHK Nomor 83 Tahun 2016 tentang Perhutan Sosial harus lebih diupayakan. Melalui skema-skema yang ditawarkan Permen LHK Nomor 83 Tahun 2016 tentang Perhutan Sosial, masyarakat dapat berkontribusi besar dan bermitra dalam menjaga pelestarian dan perlindungan kawasan hutan serta peningkatan ekonomi. Kekhawatiran dari implementasi Perpres Nomor 88 Tahun 2017 adalah masuknya kepentingan industri ekstraktif dan hilangnya wilayah kelola rakyat yang selama ini dijaga secara turun temurun.
