Abstract

Abstract: The Bengkulu Provincial Government is strongly committed to improving the quality of the Apparatus Resources of bureaucratic reform, especially the reform of apparatus resources within the Regional Government of Bengkulu Province. The ASN task has been regulated in Article 11 of the ASN Law stated that ASN employees are in charge of: a. Carry out public policies made by Personnel Development Officers in accordance with statutory provisions; b. provide professional and quality public services; and c. Strengthen the unity and unity of the Unitary State of the Republic of Indonesia. In order to carry out its duties, violations often occur that might interfere with public services which should be prioritized in carrying out their duties. Abstract

Abstract: Regional autonomy provides opportunities for each region to make a regional regulation by prioritizing the needs and desires of the people currently needed. Indonesian society is known as its Multicultural so that in determining regional rules it will concern the values, systems, culture, habits, and politics they hold. The existence of multiculturalism has developed a Regional Regulation that reflects its regionalism, for example, based on customs, culture and regional systems, Sharia Regional Regulations in Aceh and Sharia Nuanced Regulations in developing Indonesia. The rise of regional regulations has led to many pros and cons in society and even among politicians. The anti-sharia regulation was launched by the PSI in 3 main party missions. Significant differences between sharia regulations that apply in Aceh with sharia-nuanced local regulations which are mostly born in autonomous regions in Indonesia conclude that whether such regulations are constitutional and whether it is certain that every sharia or sharia-based regional regulation will always be a discriminatory regional regulation and will lead to intolerance for religious people.Keywords: Autonomy, Regional Regulation, Syari'ah.

Abstract

Abstract: Economic development in Indonesia which has been intensified since the late 1960s has indeed succeeded in reducing poverty and improving living standards in general. But this increase in well-being on the other hand has sacrificed human freedom, as evidenced by the violations of fundamental human rights. Abstract

Abstract: Since 1982 in Law Number 4 of 1982 concerning Environmental Management Principles which was later amended in 1997 to become Law Number 27 of 1997 concerning Environmental Management, legal politics regarding criminal law policy has been carried out. Law Number 32 of 2009 concerning Protection and Management of the Environment (UUPPLH) as the latest generation, has included criminal provisions in Chapter XV, which consists of 23 articles. The results of the study show that criminal law enforcement against formal offenses has a special procedural law, because it relates to the principle of ultimum remedium, meaning that the use of criminal law against formal offenses must wait until administrative law enforcement is declared ineffective. In order to avoid difficulties in enforcing environmental law that is sometimes used by certain elites to seek profits by looking at the gap in the weak regulations in the laws and regulations, the legislation, especially regarding formal law, must be clearly arranged, firm, not multiple interpretations.Keywords: Politic Criminal Law Enforcement, Environmental Law Enforcement

Abstract

Abstract: The study of fiqh Siyasah is a very urgent and warm to discussed, because it is related to politics that regulate the lives of many people. Therefore, it is necessary to know in detail what Siyasah fiqh is so that it is not trapped and erroneous in making political policies based on maslahah. Islamic Siyasah based on maslahah is siyasah born of al-quran and hadith  not siyasah born of the interests of certain individuals or groups. It is this Islamic Siyasah which is the object of study of the Siyasah fiqh. This object needs to be clarified so as not to misunderstand Islamic politics or politicized Islam. The impression of politics is dirty and bad indeed, it is inherent in the minds of the people. This is as a result of the bad politicians themselves. Many political figures have been caught in the case of corruption even though they are from islam political parties. It is here that it is very important to distinguish between Islamic politicians and Islamic politics itself. In order to find out the policies or actions of Islamic political figures that are not in accordance with the siyasah fiqh, the policy or action cannot be categorized as siyasah syar'iyah even though the policy comes from party political figures with Islamic labels. Keywords : Al-Hadist, Al-Qur’an Dan Fiqh Siyasah

Abstract

Abstract: The problems of Regional autonomy with a centralistic tendency is incarnated in the mechanism of dismissal of regional heads according to Act No. 32 of 2004. A new regional government law has emerged, namely Act No.  9 of 2015 concerning the Second amendment of Act No. 23 of 2014 about Regional Government. This research is a type of normative juridical research with primary sources of regional government laws. The results of the study show that the dismissal of regional heads and/or deputy regional heads is carried out by the DPRD leadership to the President. This proposal is obtained from a series of supervisory processes. If the DPRD leadership is not able to carry out this task, the proposal will be made by the Minister of Home Affairs. The political nuance of each law issued above has an influence on the flexibility of legal ideals to create autonomous regions. The freedom of the region to take care of its own region independently slowly reaches its way until the Act No. 23 of 2014 has been fairly proper in representing the ideals of the region to become more independent and carry out the broadest autonomy in accordance with the constitutional mandate. Keywords: Impeachment Mechanism, Regional Head, Regional Government.

Abstract

Abstract: The process of dismissal according to the Act is without going through the proposal of the DPRD and being tried directly by the Corruption Court. When the file has been submitted to the court a temporary stop will be applied. After obtaining a permanent decision (inkracht), if proven to be innocent then no later than 30 days the Regional Head concerned will be reactivated. If proven guilty the President dismisses the Governor and / or Deputy Governor and the Minister dismissing the Regent and / or Deputy Regent and Mayor and / or Deputy Mayor. The case of corruption that is authorized to prosecute in Islamic law is the Mazhalim Court to decide on the case (verdict / verdict). Then the Amir was given 10 days after the ruling was issued to defend the charges. If the plea is rejected, then he is immediately dismissed if at least two-thirds of the members of Majelis al-Shura are present at the special session to carry out the dismissal. Furthermore, the authority to dismiss the Regional Head is the Caliph. Abstract

Abstracts: Attempts to discuss women's leaders in Islam are the courage to enter a region full of the dangers of excessive generalization, excessive simplification, and restrictions that are almost inevitable from Western bias. The first problem is only one of the unresolved problems. Most of these factors are directly related to Islam itself, such as current and past legal reality, roles that are permitted and carried out as a result of Muslim images of women and religious ceremonies and diverse Islamic practices , where Muslim women have traditionally participated. Other supporting elements to provide a complete picture of women in Islam such as education, political rights, professional employment opportunities, and the like, have little to do with religion, but are still influenced by it. The issue of female leaders in Islam has often been discussed before, but until now the problem has not been eroded completely. This is inseparable from the factors that led to differences of opinion among the scholars, community leaders even in the community itself.Keywords: Leader, Woman, Islamic Law
