Abstract : Thesis entitled as a “RESULT OF LAW THAT WILL CONTAIN THE APPOINTMENT AND GRAND TESTAMENTARY HEIR ACCORDING TO THE BOOK OF THE CIVIL LAW”. Discuss issues of legal issues that result of law that will contain the appointment and grant testamentary heir according to the book of the civil law; in heritance right to the heirs by statutory (ab intestato) and testament which contains appointment heirs (erfstelling) according to the laws of civil law. Theoretical basis used in this study is the theory of the rule of law, rights theory and theory of legal protection. This type of research uses type of normative legal research using regulatory approach and conceptual approach. Materials research in this thesis the primary law, secondary and tertiary, which is processed at the level of technical level, the level of teleological and systematic level of internal. Material analysis carried out by method of interpretation of law contruction. Based method of deductive logic to think that we can conclude about testamentary appointment and grant testamentary heirs and logical qonsecuences according to the book of civil law by looking article 954 and 957 of the book. However, due to legal provisions regarding the appointment of a will that contains a grant heirs and testament in the book of the law of civil law. The next concept of the ideal law which must be applied by a public official or for a notary clarity and legal certainly. On the rights of heirs either by statute (ab intestato) or by the law of will and grants means that in the future there is no problem or dispute after heiress dies. ABSTRACT: Notary is running his occupation there is conducted collision because the collision of Notary can be fallen by sanction. One of sanction to Notary is fallout of administrative sanction. Administrative sanction fallout to notary represent duty notary supervisor ceremony. One of them is the Regional Supervisor Ceremony (MPW), sanction fallout to notary so that the notary don’t act improperly and remain to obey order. Regional Supervisor Ceremony (MPW0 becoming problem here is how sanction fallout to notary conducting collision of pursuant to number law 2 years 2014 about notary. To reply this problem is hence conducted by a research conducted by Yuridis normative. Process administrative sanction fallout, what is the form of sanction and exhortation written, and also the layoff is regional duty Regional Supervisor Cerremony (MPW). Abstract : The Background of the writing is the result of Palembang District Court No.62/PDT.G/2010/PN PLG juncto High Court verdict Palembang 101/PDT/2011/PT.PLG Number, Object lawsuit is Grant Deed No. 623/2009 dated July 30, 2009 which made before a Land Deed Official TA, SH. The decision of the judges in a lawsuit in state court can not be accepted and the decision of the judge also rejected the appeal in its entirety , a lawsuit can not be accepted because of the competence of courts to sue the Land Deed Officer and Head of the Land Office should at the State Administrative Court is not in Judicial Affairs , while the Grant Deed to cancel Judicial Affairs is the authority for Deed Land Deed Official beschikking not the result of a decision , but based on the wishes of the parties ( Partij acte ) contractual and to cancel the certificate that has been turned over the name of the authority of the State Administrative Court . Legal sanctions for Land Deed Official TA , SH which has made the Deed of Grant No. 623/2009 dated July 30, 2009 which can be legally flawed administrative sanctions and dismissal with no respect from his post by the National Land Agency of the Republic of Indonesia , after a court ruling have permanent legal force . While the legal sanctions for the Head of the Land Office had registered under the name of the Certificate of Property No. 910/24 downstream Village by the Deed of Grant No. 623/2009 which is a legal disability for severe disciplinary offense which is the Head of the Land Office for Civil Servants, the sanction under Article 7 figure 4 Government Regulation No. 53 of 2010 Concerning Civil Service Discipline, demotion level may be lower for 3 (three) years, in order to decrease the transfer of lower level positions, exemption from office, dismissal with respect not by his own request as Employee Civil, and dismissal with no respect as a civil servant. Abstrak: Berdasarkan Pasal 66 Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris sebagaimana diubah dengan Undang-Undang Nomor 2 Tahun 2014, bahwa untuk kepentingan proses peradilan, penyidik, penuntut umum, atau hakim dengan persetujuan Majelis Kehormatan Notaris berwenang mengambil fotokopi minuta akta dan pemanggilan Notaris. Sehubungan dengan kewenangan tersebut yang jadi permasalahan adalah bagaimana bentuk pengaturan persetujuan pengambilan fotokopi Minuta Akta dan pemanggilan Notaris oleh Majelis Kehormatan Notaris untuk menghadirkan Notaris pada proses peradilan dan bagaimana tindak lanjut proses peradilan dalam hal Majelis Kehormatan Notaris menolak memberikan persetujuan pengambilan fotokopi Minuta Akta dan pemanggilan Notaris dalam rangka proses peradilan. Penelitian hukum normatif dengan metode pendekatan pendekatan perundang-undangan, pendekatan konseptual, pendekatan historis dan pendekatan kasus. Penelitian menunjukkan bahwa, pertama jika penyidik ingin melakukan pemeriksaan terhadap Notaris sesuai dengan prosedur yang diamanatkan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris, tentu saja tidak dapat dilakukan karena Majelis Kehormatan Notaris belum terbentuk. Selama peraturan pelaksanaan Majelis Kehormatan Notaris belum terbentuk, penyidik hanya akan mendasarkan prosedur pemeriksaan pada ketentuan Hukum Acara Pidana (KUHAP). Kedua, Dalam hal Majelis Kehormatan Notaris menolak memberikan Persetujuan karena Notaris tidak menyaksikan, melihat dan mendengar atau mengalami sendiri pembuatan akta yang dijadikan dasar dugaan tindak pidana. Proses peradilan tetap berlanjut hanya saja penolakan tersebut tidak serta merta dikatakan bahwa Notaris tidak mau bekerjasama tetapi melainkan Notaris mempunyai kewajiban untuk menyimpan dan merahasiakan minuta akta. Untuk saat ini selama Majelis Kehormatan Notaris belum terbentuk, penyidik dapat langsung memanggil Notaris. Dalam hal Majelis Kehormatan Notaris menolak memberikan Persetujuan karena, Notaris tidak ada dasar dugaan tindak pidana. Proses peradilan tetap berlanjut. Pemerintah harus segera mengeluarkan Peraturan Pelaksana mengenai pembentukan Majelis Kehormatan Notaris. Notaris dapat melindungi dirinya yang terpenting harus terdapat dalam jiwa Notaris itu sendiri yaitu Jujur, Bekerja dengan ilmu yang kita miliki, dan Bekerja dengan baik.Kata Kunci : Majelis Kehormatan Notaris, Persetujuan Pemanggilan Notaris, Peradilan.
Abstract : This thesis examines the legal standing of acknowledgement letter of right to land as a right base to process a land registration that it has purpose to review and analyze the aspect of legal standing of acknowledgement letter of right to land in a system of valid agrarian law, rather related to the publishing authority, arrangement of society, function in process of land registration, analysis of legal power of the acknowledgement letter of right to land in land dispute and powerof authentication in formal and material. By using a normative legal research can be put forward that it meets with the legal standing of the acknowledgement letter of right to land that one of right of bases in process of land registration (certification) and legal power of authentication of the acknowledgement letter of right to land in land dispute represents an under-hand proof and therefore in land dispute must be seen the other proof as witness, admission, suspicion and oath, sp that in material, the obtained truth is not only formal legal truth. On the basis, this research recommends, related to the legal standing and the power of authentication of the acknowledgement letter of right to land that the National of Agency (BPN) keeps on making the massive certification in order to it can be stepped up becoming certificate of right to landand in settlement of land dispute to give prority in way and mechanism to engage in deliberation by relying on mechanism of formal legal settlement. Abstract: "Legal Status and Responsibilities of Sub Contractors Party on the Agreement Procurement of Government Goods / Services" analyze legal problems /issues namely, the Law considerations of the main contractors and sub-contractors to make sub contract procurement of goods / services of the government, the legal relationship between sub-contractors and main contractors with the government, the legal responsibilities of the sub-contractors in getting the default by the sub-contractor, the sub contractor procurement of government goods / services is not made as notarized ,there are differences in the regulation of sub-contract in Article 87 paragraph (3) of Presidential Regulation No. 70 of 2012 prohibited while Article 24 paragraph (1) of Law The Act No. 18 year 1999 on Construction Services allow for the sub contract. The theory framework in this study consisted of Grand Theory: Theory of Equitable Legal Certainty, legal liability theory. Middle Range Theory: Theory of Public Contracts Characteristically (Publiekrechtelijk overeenkomst), the theory as a Notary Public Officials. Applied Theory: Principles consensual, the freedom to make contracts, strength of binding contracts, goodwill, balance, habits, indemnities, timeliness, force majeure, dispute resolution, the principle of the goods / services of the government. The Research methods using type hermeneutic research paradigm. The research approach using Normative Approach, Statue approach, legal Philosophy approach, conceptual approach, legal Historical approach, Sociolegal approach.. The technique of taking conclusions with Deductive method so that it is concluded that the legal considerations around contractors and sub contractors to make sub contract In Clause of Article 8 paragraph (1) in agreement with the main contractor the goods / services of the government, and special expertise for achievement, and the non-legal considerations is cost efficiency. Judgements are binding relationship and The Legal Responsibilities to the main contractor and sub-contractors only, not to the government. It is suggested the agreement the sub-contract made as notarized by a notary public official authorized to guarantee legal certainty and fairness to the parties, so as not to violate Article 87 paragraph (3) Presidential Regulation No. 70 Year 2012 on Procurement of Government Goods/Services that the Deed made is the Partnership Act Consortium Agreement for Joint Operation (KSO) is set out in Chapter III Instruction to Participants Procurement (IKPP) in the Annex to Regulation Agency Chief Procurement Policy/government Services No. 6 of 2012 on the Technical Guidelines Presidential Regulation No. 70 Year 2012 on Procurement of Government Goods/Services. Abstract : A law must contain a clear and complete formulation to avoid various interpretations. In relation to Article 3 Paragraph (3) of the Code of conduct of the Notary with Article 82 No. 30 of 2004 concerning the Notary as amended by Act No. 2 of 2014, states that the Notary shall take shelter in an organization that Indonesian Notaries Association (I.N.I). The Code of Conduct is a moral code. The Legal issues in this thesis, namely the provisions of the Code of conduct of the Notary mentions the word of another person who hold and run up the position of public Notary. This means that another person besides the public Notary who can hold the position of Public Notary. Whoever the another person, what criteria of another person and what sanctions that may be imposed on such another person when making a mistake and violate the Code of Conduct and Law of Public Notary, and how when the same material is set out in the Code of Conduct as a norm of conduct and UUJN as legal norms, then what kind of the norm, whether included in the ethical norms, legal norms or both that norms of ethics and legal norms. This type of research of this thesis is a normative legal research, which forms the legal research conducted by examining the law material of secondary data by the method of approach to philosophy, law and conceptual approaches, and techniques concluding with the deductive method. Based on the research results can be concluded another person referred to in the Code of Conduct is the Substitute of Public Notary and Interim Public Notary also applies to it all the provisions applicable to the Notary.
