Abstract

Surah an-Nisa, verses 11, 12 and 176 are the basis for inheritance. Those verses explain the word walad. The scholars agree that the word walad in surah an-Nisa, 11 refers to son and daughter. However, scholars differ when interpreting the word walad in surah an-Nisa, 176. First, majority of scholars opine that the word walad here refers to only son. Second, Ibn Abbas comes to a conclusion that word walad in the verse refers to both son and daughter. When viewed from the perspective of ushul fiqh by the term the word used, there are two kinds of meanings of words, namely literal and figurative meaning. The literal meaning of the word walad refers to children, while the figurative meaning of the word includes the meaning of grandchildren. Based on the Arab kinship system, the majority of Muslim scholars say that grandchildren are only those from male lineage. Based on the figurative meaning, the grandchildren inherit the same portion as those of children. As also explained in the Compilation of Islamic Law (KHI), article 185, grandchildren can be the heirs of successors, meaning that grandchildren replace the position of their fathers when passing away. However, the position of grandchildren from the female lineage is not explicitly stated in the article. For the sake of justice, grandchildren from the female lineage also are also included as the heir.

Abstract

Witness is a person who gives a statement in the court that qualify the certain conditions about an event or situation that he sees, hears and experiences himself as the evidence has occured  an event or situation. Yet, How if the witnesses collected do not see or experience the incident directly but they only heard from someone else. In The positive legal terms, the witness is called testimonium de auditu, according to Islamic procedural law it is called syahadah al-istifadhah. In the process of how strength the legal evidence of the testimonium de auditu in a divorce case in the Langsa City Syar'iyah Court. Testimonium de auditu in civil procedural law, if it is according to  positive law in article 171 HIR and article 1907 KUH. Civil of testimonium de auditu is not a tool of witness evidence, but it is used as a judge's judgment. But sometimes the exception of testimonium de auditu can be considered from the quality and strength of proof, the application depends on the case. In the perspective of Islamic law, the testimonium de auditu is categorized in the syahadah-istifada as a popular testimony. It means that the testimony delivered has become a public secret, a story in the community, or information in the community about the events that occurred.

Abstract

Abstract: This study aimed to test the Influence of Excellent Service Quality, Portion of Profit Sharing and Savings Income Level of Customers of Firdaus Savings at PT. Bank Aceh Syariah Langsa empirically. The method used for data analysis was OLS (Ordinary Least Square) with double linear regression estimation model based on the results of data processing by using Eviews software program. From the research result, R2 value of 0.851 was obtained. This means that approximately 85.1 percent of the proportion of independent variables used could explain the dependent variable variation in that model. Whereas the remaining of 14.9 percent was explained by other variables that were not used in this study. While the estimation results showed that the F-count was greater than the F-table (F-calculated = 22.71 > F-table = 2.67) for the function of the amount of the savings equation. It means that all independent variables used in the estimation of this analysis model namely service, profit sharing, and income jointly gave significant effect on the amount of Firdaus Savings at PT. Bank Aceh Syariah Langsa. Thus the Coefficient of service showed a value of 1.028 which means that the higher the level of service which was equal to 1.028 percent, the savings would increase the amount of Firdaus Savings at PT. Bank Aceh Syariah Langsa for about 1.028 percent and was elastic, the Coefficient of profit sharing showed a value of 1.425 which means that any increase of profit sharing in the yield of 1.425 percent, the savings would increase the amount of Firdaus Savings at PT. Bank Aceh Syariah Langsa for about 1.425 percent and was elastic. The Coefficient of income showed a value of 0.737 which means that any increase in revenues of 0.737 percent, the savings would increase the amount of Firdaus Savings at PT. Bank Aceh Syariah Langsa for about 0.737 percent and was inelastic. Service is one of the dominant factors that affect the amount of savings in Islamic banks, then it must be put into consideration by any Islamic banks to keep improving their services. Bank Aceh Syariah Langsa Abstrak: Penelitian ini bertujuan untuk menguji Pengaruh Kualitas Layanan  Prima, Porsi Bagi Hasil dan Tingkat Pendapatan nasabah terhadap tabungan firdaus di PT. Bank Aceh Syariah Langsa secara empiris. Metode yang digunakan untuk analisis data adalah OLS (Ordinary Least Square) dengan model estimasi regresi linier ganda berdasarkan hasil pengolahan data dengan menggunakan program perangkat lunak Eviews. Dari hasil penelitian, diperoleh nilai R2 0,851. Ini berarti bahwa sekitar 85,1 persen dari proporsi variabel independen yang digunakan dapat menjelaskan variasi variabel dependen dalam model itu. Sedangkan sisanya 14,9 persen dijelaskan oleh variabel lain yang tidak digunakan dalam penelitian ini. Sedangkan hasil estimasi menunjukkan bahwa F-hitung lebih besar dari F-tabel (F-hitung = 22,71> F-tabel = 2,67) untuk fungsi jumlah persamaan tabungan. Ini berarti bahwa semua variabel independen yang digunakan dalam estimasi model analisis ini yaitu layanan, bagi hasil, dan pendapatan secara bersama-sama memberikan pengaruh yang signifikan terhadap jumlah Tabungan Firdaus di PT. Bank Aceh Syariah Langsa. Dengan demikian Koefisien layanan menunjukkan nilai 1,028 yang berarti bahwa semakin tinggi tingkat layanan yang sama dengan 1,028 persen, akan meningkatkan jumlah Tabungan Firdaus di PT. Bank Aceh Syariah Langsa sekitar 1,028 persen dan elastis, Koefisien pembagian keuntungan menunjukkan nilai 1,425 yang berarti bahwa setiap peningkatan pembagian keuntungan dalam hasil 1,425 persen, akan meningkatkan jumlah Tabungan Firdaus di PT. Bank Aceh Syariah Langsa sekitar 1,425 persen dan elastis. Koefisien pendapatan menunjukkan nilai 0,737 yang berarti bahwa setiap peningkatan pendapatan sebesar 0,737 persen, akan meningkatkan jumlah Tabungan Firdaus di PT. Bank Aceh Syariah Langsa sekitar 0,737 persen dan tidak elastis. Layanan adalah salah satu faktor dominan yang mempengaruhi jumlah tabungan di bank syariah, maka harus dipertimbangkan oleh bank syariah mana pun untuk terus meningkatkan layanan mereka. Abstract

Economic thought of Abu Ubaid reflects the significance of maintaining the society’s rights and obligations, making justice a central principle in running the government and building a sense of unity and shared responsibility. Abu Ubaid also explicitly states that the government is obliged to provide an adequate standard of living for every individual in a Muslim society. He said that state revenue (fai ', khumus, alms and zakat) have to be managed by the state and allocated to the community. In term of  monetary, he states that the money have to have intrinsict value, standard exchange rate and medium of exchange. He is of the opinion that only dinars and dirhams that deserve to be used as a medium of exchange because it has a stable value so the inflation flows which adversely affect the economy of the country can be avoided.

Abstract

The existence of a man and woman who have no kinship so that it is lawful to marry her, in a lonely place without being ac companied by a mahram of the male or female side. This khalwat is a crime that is not subject to hudud punishment and kafarah punishment. This form of khalwat crime is included in the category of ta'zir finger whose number of punishment is not limited. In the Qur'an and Sunnah this khalwat act is highly reproached, but not clearly regulated in the Qur'an and Sunnah. So this act can be entered into the ta'zir group. All deeds that should (need) be forbidden to fulfill the common good (community). This prohibition must necessarily be made on the basis of community agreement / consensus in ways that are considered eligible. In North Aceh, the khalwat actors who are close to the power are hard to touch with the law, it is not surprising to all of us to remember that the law in this country is not yet the commander but the law is merely a bargaining position in everyday life.

Abstract

This research aims to analyze deeply about: 1) The method of determining the beginning of qamariyah month according to  the  book  of  Khulashah  al-Wafiyah,  2)  The  method  of determining  the  beginning  of  qamariyah  month  according Ephemeris,  3)  Hisab  accuracy  level  in  determining  the beginning  of  qamariyah  month  according  to  the  book  of Khulashah  al-Wafiyah  and  Ephemeris.  This  research  is  a library  research  in  the  form  of  qualitative  descriptive- analytical  research.  The  primary  data  source  are  the Khulashah al-Wafiyah and The Ephemeris, while secondary data obtained through the study of various related literature. Then  the  data  is  analyzed  by  content  analysis. The  results showed  that  the  method  of  determining  the  beginning  of qamariyah month according to Khulashah al-Wafiyah book in advance through calculation taqribi with reference to the data in the table that is already provided at the end of the book.  Based  on  the  calculation  of  the  intrinsic  taqribi followed  by  calculation  five  correction  to  the  moon’s  data. When applied to the hisab of the beginning of Shawwal 1437 H  /  2016  M,  the  results  show  that  hilal’s  high negative  or position of the moon is still below the horizon. This according with the facts that occurred on the ground when it was that the  height  of  the  new  moon  is  still  negative  so  that  the Ramadhan  in  istikmal  right  to  30  days.  Similarly,  the results  of  the  hisab  of  Syawwal  1437  H  according  to Ephemeris  which  also  showed  negative  height  of  the  new moon.  Thus,  the  accuracy  in  determining  the  beginning  of the month of qamariyah according to the book of al-Wafiyah Khulashah  classified  as  already  a  high  degree  of  accuracy that can even match the real of contemporary hisab.

Abstract

Nusyuz etymolically means opposition, hate, while according to the term nusyuz is the conduct of wife who opposes her husband to not carry out his orders, turn away from her husband and make the husband angry. Nusyuz according to the School of Shafi'i is the release of wife’s obedience to her husband. Either disobedience which is indicated by words or through behavior (deeds) or both (words and deeds) at once. According to Imam al-Shafi'i and some jurists from the Shafi'i School, the sanctions imposed for the perpetrators of the Nusyuz, as legitimized in QS al-Nisa: 34, were taken through three levels of advising, separating the bed, striking. Amina wadud interpret nusyuz as a disturbance of household harmony. Amina Wadud does not agree if nusyuz is meant by disobedience to the husband. Amina Wadud argues that nusyuz is more accurately interpreted as an unharmonious situation between married couples. Between the sect of Shāfi'ī and Amina Wadud have similarities and differences regarding the problem of sanctions that should be given to the perpetrators of nusyuz. The second equation is that they agree to the imposition of sanctions, but on the third sanction of beating this opinion is only approved by the Shafi'i school alone (though beating must be under certain conditions), whereas Amina Wadud prefers more exreme solution, that is divorce.

Abstract

law (rechtsstaat) recognizes and protects human rights. All people must be treated equally in the law. Equality in law must be balanced with equal treatment. Legal assistance is the right of a person who is involved in a criminal case to be able to prepare a defense or counseling in upholding his rights as a suspect. Everyone has the right to receive legal assistance from an advocate, no one may be denied the right to obtain a legal defense in a legal state. Provision of legal assistance does not look at religious, ancestral, racial, ethnic, political beliefs, socio-economic strata, skin color and gender. Thus, justice will be realized for everyone

Abstract

Abstract: There is not any emphasis on the value of justice greater than this matter (that God sent His apostles and sent down His Book) to bring about justice. In the name of justice the books were revealed and the Apostles were sent. Because of this justice, the life of heaven and earth is also upheld. The evolution of the philosophy of law, which is inherent in the whole philosophy evolution, revolves around the certain problems that arise repeatedly. Among these problems, the most frequent discourse is the issue of justice in relation to the law. It happens because laws or regulations should have been fair, but in fact they often don't. Keywords: justice, philosophy, law, perspective, West, Islam Abstrak: Tiada penekanan akan nilai keadilan yang lebih besar dari pada perkara ini (bahwa Allah mengutus para rasul-Nya dan menurunkan Kitab-Nya) untuk mewujudkan keadilan. Maka dengan atas nama keadilan kitab-kitab diturunkan dan para Rasul diutus. Dengan keadilan ini pula tegaklah kehidupan langit dan bumi. Evolusi filsafat hukum, yang melekat dalam evolusi filsafat secara keseluruhan, berputar di sekitar problema tertentu yang muncul berulang-ulang. Di antara problema ini, yang paling sering menjadi diskursus adalah tentang persoalan keadilan dalam kaitannya dengan hukum. Abstract

إن موضوع المعاملَّت المالية موضوع مهم حيث يس حاجة المسلم اليومية تتعلق بماله ومكاسبه. والناُ قد حبب إليهم المال على فطرتِم, والناظر فِ أسباب تَلك الۡموال يجد أنها كثيرة الۡشكال ومتوعبة المسائل, وقد واض الناُ فِ العصر الاضر شتَ أنواع المعاملَّت المالية المعاصرة منها اللَّل ومنها الرام, لكن الذي اكتسب من الرام قد اعتذر بأنه حاه  ً هذه الۡموال فِ جهل فادعى أنه ل يؤوذ عليه منها وبَلتالي ل يؤثر شيئا  منه؛ ً ا فِ حياهة تلك الۡموال. مع أن الجهل فِ مثل هذا الۡمر يعد تقصير لإمكانه السؤال تَاه أهل العلم المتخصص فِ مجاله.
