Abstract

This paper is a discription of the debate over the issue of legitimacy of tarekat in the Minangkabau region in the early 20th century between the old traditionalist ulama and the young modernist ulama. The theoretical framework used to analyze the problem above is the theory of challenge and response by the historian Arnold J. Toynbee. The theory is about the dialectics of history and culture due to the causality of the challenges and responses, both in ideas, discourse and movement. The importance of this theory is to answer the fundamental issue about the meaning of tarekat from the perspective of the two groups of ulama along with the things underlying these differences.The conclusions in response to the problem is that the tarekat institution (Naqsyabandiyah-Khalidiyah) with it various form of practice such as geneology, rabitah, suluk, avoid from eating meat and so in the view of the old ulama is the result of ijtihad of the sufi scholars taken from the Quran and Hadis teachings as a way to get closer to the God, while according to the youth ulama, the tarekat practice above are not based totally on the guidance of the Quran and the Hadis. Therefore, regarded as heretical act category. But the youth did not oppose the amali and salafi practice of sufisme with a very tight relationship sufism and sariah.

Abstract

Banking services are needed by the majority of society to facilitate all  of their economic activities, especially to help their business or business development. One of the services performed by the banks, both conventional and sharia banks in accordance with the declaration of the BI program is a non-cash payment, better known as GNNT (Non-Cash National Movement). GNNT is one way to make a country more advanced. The indication of community acceptance to non-cash payment is the use of sophisticated technology, mindset and lifestyle of the society.Therefore, this paper examines Madura kiai's view to the program. Due to its social condition, the kiai's views on banking services are polarized. On the other hand, a kiai is a central figure who has a great influence on the environment of his society. The view of the madura kiai is divided into two: against non-cash payments in conventional banks and sharia banks. The non-cash payment to a conventional bank, the kiai's views are divided into three: halal, haram and syubhat. While in sharia banks, the views of kiai are divided into two: halal and syubhat. The polarization of views is in line with the polarization of the kiai type, between the salafiyah kiai and the inclusive kiai. But in general, the kiai give a positive response on the establishment of sharia banks.

Abstract

A Gus Dur’s terminological reference ‘Sub-Culture’ to Pesantren indicates that this institution is closely related to society. It is because of a fact that pesantren has been developed from, by, and for society. From its initial function as literate society, a center for reduction of social illiteracy, until as cultural literacy, a castle of socio-cultural defense, this institution has became an archipelago-based-islamic institution and a center of Muslim civilization in its intelectual roots of tradition, including al-turats, genealogical lineage of science, etc. At-turats (kitab kuning) serves as a medium of networking ulama’ in the spreading of islamic knowledge. The tradition of at-turats and the moral relationship between teachers and students has became social ground of pesantren building. This relationship has been embedded into the tradition of at-turats in order to maintain the genealogical linkage of science transmission (sanad). Instead of contradictionary, these elements are complementary for maintaining Pesantren as ‘sub-culture’.

Abstract

Tasawuf, sebagai ilmu, tidaklah lahir dengan mulus dan berkembang dengan pesat tanpa pertentangan di sana-sini. Kelahirannya, sebagaimana ilmu yang lain, diikuti dengan penolakan, mulai dari yang bernada biasa sampai yang cukup keras (diharamkan untuk dipelajari sebagai bagian dari ilmu keislaman, seperti ilmu-ilmu keislaman yang lain, karena dianggap sesat dan bid’ah). Namun, penolakan atau pertentangan ini tidak sepenuhnya harus dianggap membahayakan bagi keberlangsungan tasawuf. Sebab, dalam Filsafat Ilmu, penolakan itu dapat disebut sebagai proses falsifikasi. Jika suatu ilmu mampu bertahan di tengah terjangan falsifikasi, maka ilmu tersebut akan semakin mapan atau sempurna. Demikianlah yang dialami tasawuf. Buku yang ditulis doktor di bidang filsafat Islam dan tasawuf ini, mengetengahkan sejarah pemikiran tasawuf, mulai dari awal kelahirannya, perkembangannya, dan pertentangan yang menyertainya. Melalui metode arkeologi, dalam arti menggali kembali ide-ide atau pemikiran tasawuf yang terdapat pada tokoh-tokoh penting tasawuf, dan dibalut dengan pendekatan historis, penulis menjelaskan dengan renyah dan lincah pemikiran tasawuf dari awal lahirnya, ketersambungan idenya dari satu tokoh ke tokoh lain, dari tanah kelahirannya di Timur Tengah sampai menjejakkan kaki di Nusantara.

Abstract

This paper discusses the relationship between culture, religion, and power in the XIV-XIX century associated with the process of formation of Islamic law in Nusantara; the law that grows and develops as a result of dialectical process between the social and cultural reality of the people of Nusantara. This textual and contextual dialectics gives birth to a unique legal system because the archipelagic society is plural and multicultural social system. From this dialectical process, there is an acculturation that give rise to the contextual and progressive dynamics of Islamic law which respect local traditions and wisdom. Furthermore, the involvement of the power authority also contributes to its development. There are two strategies used in the development and establishment of Islamic law in Nusantara, namely cultural strategy and ideological strategy. At this point, Islamic law in Nusantara is experiencing rejuvenation because it always dialogues with the surrounding social reality. Ultimately, the discourse of Islamic law in Nusantara shows its existence as a unique and genuine legal system of Nusantara, in favor of universal human values, and not just the result of fixed Islamic thought and law of the past.

Abstract

Empowerment means building awareness about women’s ability to independently determine their life as a human being, without dependence, distress and discrimination. since it’s inception, Islam has affirmed transformation of women without equate with men. Education is an important instrument of the transformation that starts from knowledge to build awareness. The Pesantren (Islamic Boarding school) has a role in this process. Because  it’s teachings are based on the teachings of religion to form awareness and attitude based on the religion. However, there are some problems in the curriculum, materials and education methods. Because the curriculum and materials of pesantren based on the explanation in yellow books which are the interpretation of the Muslim scholars on The Holy Koran and Al-Hadith. While, The contents of the yellow book are indicated gender discrimination by some researchers, like the 'Uqu>d al-Lujjain which is become foundation of almost all traditional pesantren. In this case, pesantren need to interact with modern knowledge in gender issues in order to create gender sensitivity. In addition, they need an introduction to the critical learning and improvment the professionalism of the teachers. With that, the education process of pesantren will be more empowered, progressive and in line with the principles of Islam.

Abstract

This paper explains that the agreement is basically contained the principle of freedom of contract should not be restricted by anyone even including legislation. But subsequent developments, the Indonesian legal practice, the agreement is based on this principle in the form of their failure to intervene parliament through legislation on freedom of contract. While in Islamic law, the principle of freedom of contract is not absolute, but limited. In principle, not much different from the limitations under positive law. In the Islamic Shari'a law are the principles of the agreement are divided into several basic principles, namely the principle of tawhid, the permissibility, freedom of contract, justice, equality, honesty, trust, benefit and welfare, konsensualisme, binding promise, achievement of balance, legal certainty, and personality.

Abstract

Pesantren as an educational institution has its own characteristics, so that schools can be distinguished from other educational institutions. Characteristic of schools considered to be very unique by the observer of education, from tradition, curriculum, education system, infrastructure, kiai leadership models, and also the lifestyle of the students were very simple and put together. So that attract many researchers to continue research and study of the pesantren. Management of pesantren education can not be separated from the role of kiai. Kiai has a major role that determines the course of the management of all schools. At the pesantren kyiai is a figure who occupied as the highest structrue in the management of the school. Kiai which controls and determines everything in pesantren. Kiai has demonstrated success in managing the schools, from the first starting early embryo until now in the face of development. It can be seen from the rapid increase in the number of students from year to year and owned infrastructure continues to increase and the quality of students in terms of their knowledge is not inferior to the products of non pesantren education institutions.
