Jurnal Masyarakat dan Budaya (JMB) or Journal of Society and Culture is a peer-reviewed journal that aims to be an authoritative academic source on the study of society and culture. We publish original research papers, review articles, case studies, and book reviews focusing on Indonesian society, cultural phenomena, and other related topics. A manuscript describing society and culture outside Indonesia is expected to be analyzed comparatively with the issues and context in Indonesia. All papers will be reviewed rigorously at least by two referees. JMB is published three times a year, in April, August , and December.

Abstract

This study reveals that the implementation of Islamic syariat has fundamentally changed its view from political issue to basic human rights. The existing of Indonesian government can not eventually stop the implementation of syariat Islam taking place in Indonesia. The International Covenant on Civics and Political Rights (ICCPR) 1966 and the International Covenant on Economic, Social and Cultural Rights (ICESCR) 1996 and also the 1945 Indonesian Constitution have shown to concern in protecting religious implementation. The implementation of Islamic Syariat Law in Aceh, Banten and South Sulawesi Provinces has given a significant evidence. The notion of the freedom expression and freedom of religion based on international and national laws make Indonesian government has dramatically changed its attitude to be more democratic and tolerant. Abstract

Tulisan ini ingin menunjukkan adanya pergeseran ideologi di Muhammadiyah dari tendensi kultural menuju tendensi puritan. Pada awal berdirinya, Muhammadiyah merupakan representasi Islam varian Jawa. Ia lahir di Kauman, satu tempat dalam lingkungan tembok Kesultanan Yogyakarta, oleh sejumlah abdi dalem Kraton tersebut. Ia dibangun dengan inspirasi dan kesadaran seorang Islam-Jawa tulen, Raden Ngabehi Muhamad Darwisy (KH Ahmad Dahlan). Pada perkembangannya, terjadi satu pergeseran di organisasi yang berdiri 1912 ini, seolah-olah NU (Nahdlatul Ulama) lebih pas dipandang sebagai representasi Islam-Jawa daripada Muhammadiyah. Banyak faktor yang mempengaruhi terjadinya pergeseran ini. Diantarannya adalah masuk dan berkembangnya ideologi Wahabi, terutama setelah Mekah dan Madinah dikuasai Saud-Wahabi. Keterlibatan orang-orang dari Padang dalam Muhammadiyah juga berpengaruh dalam pembentukan sikap organisasi ini terhadap budaya lokal. Terlebih, ideologi Muhammadiyah banyak dipengaruhi oleh ulama besar dari Padang, Haji Rasul. Selain kedua hal tersebut, faktor lain yang ikut berpengaruh dalam membentuk karakter Muhammadiyah dalam kaitannya dengan budaya adalah pembentukan Majlis Tarjih yang berorientasi syari’ah. Pendirian lembaga ini dipelopori oleh Mas Mansur, seorang ulama dari daerah pesisir, Surabaya. Karakteristik keislaman daerah pesisir pantai dikenal lebih ketat dibandingkan daerah pedalaman (hinterland) seperti Yogyakarta. Kata kunci: Muhammadiyah, ideological shift, Majlis Tarjih, cultural tendency, puritanical tendency.

Abstract

This article discusses the influence of modern technology of fishing over the social life in a Muslim fishing community in South Thailand or Pattani. The advent of modern fishing technology to peoples fishing ground raises some problems in traditional fisher in Ru sembilan. Firstly, there is a drastically decreasing resource in fishing ground, so that they face difficulties in finding catchers. Secondly, their commercial access to fishing ground raises a conflict among them drives to financial lost. This paper also explains the Thailand government policy in handling fisher conflict to management and conservation on aquatic resources. It seems that the Thailand Monarchic Government is considered discriminate local fisher. When people stop using dangerous catching instrument, in other hands commercial fishers keep operating in their fishing ground. It cause the conflict dragging continuously. Abstract

Local people who live around National Park do not have access to participate in forest management. This condition seriously force people to pratice forest squatting and illegal logging. Illegal logging activities, for instance, having its close link with the negliance of local people to involve in National Park Management. To settle down the difference, Management of Gunung Leuser National Park at Bukit Lawang invited people who reside close to the conservation site; to take part in a program named “Ecotourism Program”. Participation of people in Ecotourism Program has two purposes namely: to avoid deforestation and to generate people’s awareness on sustainable forest management. Abstract

In performing its task to recovery, BPPN has an authority to manage assets guaranteed by debtors who have got BLBI after the monetery crisis in 1997. BPPN also has an authority to sell assets of debtors who have signed Master Settlement and Acquitition Agreement (MSAA) or Master Refinancing and Note Issuance Agreement (MRNIA). Both are the instruments, offered by BPPN as a recovery procedure. The assets can be sold directly by either BPPN or its representatives. Generally speaking, BPPN creates a holding company to manage the selling of assets of each organization group, who have signed the MSAA/MRNIA. However, many debtors of BLBI use these instruments as a way to escape their responsibility to return BLBI. This is caused by, among others, release and discharge clausuls in those agreement. It indicates that there is still the weaknesses in those agreement. Therefore, it must reviewed to make its clear. This article attempts to analyze those agreement, not only their status in the public and private law in this country but also the advantaged value of those agreement in the economic sector. In fact, those agreement can be the out of court settlement in the private law only but can’t abolish the demand in the public law. Keywords: MSAA, MRNIA, Dana BLBI, BPPN

Abstract

Ethnicity is a very important issue for the pluralistic Indonesian society, but before ethnic violences exploded in various places of Indonesia, not many social scientists were interested in studying the topic, and their understanding of ethnicity was mostly limited to the classic meaning of “an ethnic group’s identity” introduced by Fredrik Barth in 1969. This classic meaning has obviously failed to help us understand the dynamics of ethnic violences that occurred in Indonesia during the 7-8 years after the 1996 Sanggauledo conflict because it implied “old histories, local rivalries, and deep hatred” that could be traced back to the beginning of tribalism, but had no real connection to contemporary occurrences such as how ethnicity (of the Acehnese and the Papuan) was mobilized as ‘identity politics’ at the level of nation-state which led to state’s violences against those (ethnic) groups. Therefore, I think it is quite critical to discuss the new definition of ethnicity as ‘a new cultural dimension of difference’ and/or ‘the question of culturalism’, as well as its significance within the present socio-political context of Indonesia. For instance, is the (re)construction of ethnicity by the Acehnese, the Papuan, the Dayak, the Riau-Malay, and others in mobilizing ethnic solidarity really ‘the (re)making of ethno(local)-nationalism’ as some people have suggested? Abstract

Artikel ini mengkaji praktek penyelesaian konflik personal pada masyarakat yang hidup di dalam sistem hukum yang majemuk. Diskusi difokuskan pada dua masyarakat Muslim yang berasal dari wilayah Negara, wilayah geografis dan budaya yang berbeda, yaitu masyarakat Gayo (Indonesia) dan masyarakat Tausug (Philipina). Tujuan dari tulisan ini adalah untuk mengkaji bagaimana aturan-aturan hukum keagamaan, kondisi sosial-politik, dan tradisi budaya saling jalin berkelindan di dalam membentuk konsep masyarakat tentang hukum, dan bagaimana manifestasi konsep tersebut pada penyelesaian konflik. Melalui pendekatan praksis (diskursus) dapat dilihat bahwa agama sebagai realitas sosial bukanlah sebuah entitas yang tunggal, seragam, apalagi monolitik. Analisis memperlihatkan bahwa amalgamasi antara ketiga sistem nilai yang berbeda akan menghasilkan variasi pada artikulasi hukum dan juga praktik penyelesaian konflik di antara masyarakat Muslim. Data diperoleh dari penelusuran literature dan dianalisa dengan menggunakan metoda analisa naratif. Kata Kunci: Gayo, Tausug, conflict resolution
