Abstract

Marriage,as a holy tie between persons, can be analysed from two perspectives: as a tradition and an aspect regulated by state law. In a certain circumstance, the tradition of marriage can be different or even in opposition to state’s marriage formal law. The marriage system of Wong Sikep in several regions in Central and East Java Provinces can be seen as one important example. Based on library research, this article analyzes the issue of legal pluralism that potentially occurs because of the implementation of multi laws in a certain field in a society - state law and adat law -. It shows how Wong Sikep communities respond differently to marriage formal system implementation, part of them still practice their adat law purely and some others who have conducted adjustment with state’s (marriage) law. Keywords: marriage, Wong Sikep, Samin, legal pluralism

Abstract

Abstract

The present qualitative study explores the rationalization of 24(twenty-four) men reported to the police of conducting sexual offense, to justify their sexual offense or transgression. Denials vary from absolute denial, minimization, such as claiming of having mutual consent sex, denial of victim harm, and a rarer phenomenon but apparent in two subjects, a kind of depersonalization. More specific denials relate to gender-based rationalization is prevalent, such as having unharmonious relationship with wife therefore they need other women for sexual outlet, or the girls are not ‘good girl’. Very strong rationalization is related to the discourse on ‘female chastity’ in which offenders justify their behavior as OK since their target subjects are not ‘good girls’, be evidenced by they are not virgin anymore, hang out at night, or have relation with other men. Offenders who are in relationships with their victims need to prove the chastity of their female partner, or felt suspicious and angry about the past relationships of the girls therefore forcing sex or conducting sexual assault. Offender might adopt a ‘professional’, a ‘hero’, a ‘revenger’ as well as a ‘victim’ role. All cannot be separated from the cultural context of Indonesia and are explaining the beliefs of male offenders about men as superior and having authority over women. Keywords: sexual offense; female chastity; cultural context

Abstract

Human trafficking is commonly associated with women due to the fact that the majority of the victims are women. In reality, both men and women have been the victims of human trafficking through various exploitative and abusive treatments. This paper aims to describe human trafficking activities across the border areas in Indonesia based on the gender perspective. Several aspects of human trafficking are discussed, such as the pattern, the process and the impact of trafficking activities on the victim's life. Data and information for this article come from the reviews of several studies and scientific papers related to the human trafficking, particularly in Indonesia. This study shows that the males and females trafficked victims have different experience of abuse in a range of sectors, and therefore required different kind of support and protection. This paper aims to contribute in finding the solutions for the improvement of the existing human trafficking intervention. Keywords: human trafficking, gender perspective, Indonesia

Abstract

As shown from the gap between actual situation of gender inequity and the implementation of gender policy, it can be seen that the representation of gender policy is low. Gender mainstreaming is a knowledge as well as a strategy to build gender equality. The sensitivity of gender issue has been acknowledged by international community commitment through several international meetings, that this issue must be integrated into national policy. Although Indonesia has ratified The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) into the UU No. 7 year 1984, the Gender Mainstreaming policy has only implemented in 2000 with the Inpres No 9. The gap between Human Development Index and Gender Development Index, despite the increase of both indexes, also shows that the problem of marginalization of women is still exist in Indonesia. The data from the indexes also show that Indonesia is unable to fulfill the MDG’s goal in preventing the number of death of mother in delivering baby. As strategy, the Gender Mainstreaming shows challenges from individual as well as bureaucracy, not to mention problem in ideas, interest and institution that tend to exclude gender as priority. The exsternal challenges are capitalism through media that sometimes have differentinterest. As strategy gender mainstreaming needs media to disseminate gender problem and gender knowledge. Keywords: gender mainstreaming, representation, women’s knowledge, strategy, policy
