Abstract

The licensing agreement on intellectual property rights raises the exclusive rights in the form of a monopoly on intellectual property rights. The exclusive rights are abused by the holder or owner of the intellectual property rights to determine the license agreement that violates the principles of competition. Setting licensing restrictions in Article 50 letter b of UU No. 5/1999 is appropriate only where the article is just limiting the intellectual property rights that may arise in the future. Setting licensing restrictions should not only be governed by UU No. 5/1999 alone, but also governed by laws and regulations related to intellectual property rights continuously, so that theimplementation of the licensing agreement limitation becomes maximal.

Abstract

In Indonesia, the basic rights of citizens is regulated by the Constitution Law 1945 as the basis of the state constitution. Basic rights of the individual in Indonesia other than stipulated in the 1945 Constitution, as well as further stipulated in the legislation. According to the Law no. 39 of 1999 on human rights article 1, paragraph 1 determines that Human rights are a set of rights attached to nature and human existence as a creature of God is Almighty and His grace which must be respected, upheld and protected by state law , the government and everyone for the respect and protection of human dignity. The basic rights of human beings in the field of economics is the rights of economy activity, labor, right to work, earn a wage and participate in labour unions, intelectual property rights also contract field. Need further study, whether the state protects the rights of individuals in the field of civil economic law in the Indonesian . This papper By using normative methods through the study of literature. The conclusion that the government would need to make rules that are clear and detailed set of individual rights in the economic field which must refer to the basic values which are universal, namely sustainability (sustainability), unity (wholeness), harmony (harmony), equality(balance),equity(fairness)

Abstract

Reclamation can be interpreted as an effort to land acquisition by drying the swamp, tidal areas, and so on. International In not a few countries that do the reclamation to conflict with state borders. In Indonesia too many cases of reclamation hurt some parties. Method used in this paper is a normative research methods. Data collection method in this paper the author uses the method of literature. International law has not set the reclamation significantly, but in the national law in Indonesia has been regulated in Law Number 27 of 2007 on the management of coastal areas and small islands. The importance of the rules regarding the reclamation it is expected that international law can be set significantly.

Abstract

Pasal 8 ayat (3) UUD 1945 mengatur, jika Presiden dan Wakil Presiden mangkat, berhenti, diberhentikan, atau tidak dapat melakukan kewajibannya dalam masa jabatannya secara bersamaan, pelaksanaan tugas Kepresidenan adalah Menteri Luar Negeri, Menteri Dalam Negeri dan Menteri Pertahanan secara bersama-sama , dan dalam waktu 30 (tiga puluh) hari MPR harus melaksanakan sidang untuk pemilihan Presiden dan Wakil Presiden yang baru menggantikan yang lama. Permasalahan muncul jika ditinjau dari perspektif kedaulatan rakyat yang dimana ada nilai demokrasi didalamnya yang tercederai oleh Pasal 8 ayat (3) tersebut karena MPR yang memilih Presiden dan Wakil Presiden yang baru. Berdasarkan latar belakang tersebut relevan untuk diangkat menjadi tulisan dengan metode penelitian hukum normatif kemudian dikaji melalui pendekatan perundang-undangan dan pendekatan konsep. Tujuan Penelitian ini adalah untuk mengetahui Pemberhentian Presiden dan/atau Wakil Presiden di Indonesia berdasarkan UUD 1945 dan untuk mengetahui Pemilihan Presiden dan Wakil Presiden baru yang dilakukan oleh MPR dalam perspektif Kedaulatan Rakyat. Pemberhentian Presiden dan/atau Wakil Presiden di Indonesia berdasarkan UUD 1945 yaitu diatur Pasal 7A kemudian dilanjutkan pada Pasal 7B UUD 1945. Dan Terkait dengan kewenangan penggantian Presiden dan Wakil Presiden dalam hal adanya pemberhentian Presiden dan Wakil Presiden secara bersamaan yang secara atribusi dipegang oleh lembaga Negara MPR, tidaklah sesuai dengan nilai-nilai kedaulatan rakyat. Sesuai dengan teori Kedaulatan Rakyat, dalam hal pemilihan Presiden dan Wakil Presiden yang baru dalam hal terjadi kekosongan secara bersamaan, harus lah kembali kepada rakyat secara langsung dengan mekanisme pemilihan umum, bukanya melalui sidang MPR seperti sebagaimana diatur pada Pasal 8 ayat (3) UUD 1945.

Abstract

Penelitian ini bertujuan untuk mengetahui faktor-faktor yang mempengaruhi kepadatan lapas, kebijakan Lapas Wirogunan untuk menanggulangi kelebihan kapasitas Lapas serta bagaimana formulasi pidana dan pemidanaan untuk mengurangi kelebihan kapasitas di dalam Lapas. Penelitian ini menggunakan penelitian hukum normatif dan penelitian hukum empiris dengan bahan hukum primer dan sekunder. Hasil penelitian ini menunjukkan bahwa 1) Faktor-faktor yang mempengaruhi  kepadatan kapasitas di dalam Lapas yaitu; Pertama, tingginya tingkat Kriminalitas dan Kedua, Kebijakan Peradilan Hukum Pidana. (2) Kebijakan yang dilakukan oleh Lapas Wirogunan ialah dengan mengoptimalkan dengan program terintegrasi di dalam Lapas. (3) Formulasi pidana dan pemidanaan yang dapat dilakukan ialah pertama merevisi KUHP yang semula berprinsip komulasi menjadi prinsip pidana yang memiliki konsep alternatif, yang kedua merubah pandangan hakim yang cenderung menjatuhkan pidana penjara menjadi adanya pidana alternative lain dalam KUHP. Ketiga, pemerintah menambah Lapas di Indonesia, sehingga formulasi ini mampu menekan adanya tindak pidana.

Abstract

The use of standard agreements are now widely applied in the business world,including the parking agreement set forth in the form of a parking ticket. Parking ticket in the transition of responsibilities are standard clause which reads as follows: "The management of parking is not responsible for loss or any damage, "The management of parking is not responsible for any loss or damage to the vehicle". The existence of this clause resulted in problems of parking management accountability to the consumer. This raises the issue of research, (1) whether the legal relationship that occurs between park managers and consumers? (2) how the parking management responsibilities to the loss of the vehicle and or property of consumer goods in the parking lot of standard clauses related to the transfer of responsibility for the parking ticket?. This study aims to determine the relationship between the law of what is happening parking managers and consumers in business transactions parking and parking management form of responsibility in case of loss of the vehicle and orproperty of consumer goods in the parking lot is related to the standard clause transition of responsibilities the parking ticket. This research is a normative law with qualitative analysis. The study concluded, legal relationships that occur between parking management and customer care is the relationship agreement goods (vehicles), and parking management shall be responsible for the loss of the vehicle and or property of consumers who parked in the parking area management.

Abstract

Trademark as a part of intellectual property rights in essence is a sign to identify and distinguishing a product that made by a company with other products in the market. Trademark must be registered to gain a legal recourse in the form of Rights Over Trademark. However a registered trademark can still be nullified, based on a certain adequate evidence the registered trademark cannot fulfilled the absolute grounds or relative grounds. In furtherance, nowadays trademark legally feasible to be registered as a collateral. And as for the most accurate form of the collateral itself according to the law shall be registered fiduciary guaranty.

Abstract

The existence of discretion on the one hand it is beneficial for administration officials to overcome  the stagnation of government.  Discretion allow a government  official to issue a policy even though there is no legislation that became law umbrella issuance of the policy. But on the other hand, if the discretion is not used in accordance with the procedures and requirements specified will open up opportunities for abuse of power by government officials, which of course would be  detrimental  to the  citizens  as victims. The problem in this research are, first, what is the fruit simalakama discretion to governance? Secondly, how the problems of discretion in the application of laws and regulations in Indonesia after Law No. 30 Year 2014 on Government  Administration? This research is the use of doctrinal primary law and secondary law.  The method  used the normative approach. The study concluded that, tops, discretion has been the fruit othe  governance  dilemma  because  on  the  one  hand  can  overcome  the  stagnation of government but on the other hand open the possibility of abuse of authority. Secondly, there are many problems arising after the enactment of Law No. 30 Year 2014 on Government Administration in particular  with regard to discretion

Abstract

ndonesia as a Muslim-majority country needs an attention to food products which circulate freely. It is not just the attention of the medically healthy composition, but also should be noted that the food consumed is healthy and halal. Inclusion of halal labeling is basically mandatory or voluntary, but if there is a processed food business operators that produce and / or processed food to enter into Indonesian territory to be traded by claiming their products as halal, then the processed food business operators shall put halal labeling and responsible for halal products. It is intended that the right of consumers to correct information, clear and honest about the condition and guarantee of the goods and / or services can be appropriately and adequately protected. In this article, the author uses the method of normative juridical research. The purpose of this paper is to determine the validity of the Consumer Protection Act against halal labelingon food products for Muslim consumers.

Abstract

Perjanjian Kerja adalah Perjanjian atau kesepakatan yang diadakan antara serikat pekerja atau serikat-serikat pekerja yang telah terdaftar pada departemen tenaga kerja dengan pengusaha atau perkumpulan pengusaha yang berbadan hukum, yang pada umumnya atau semata-mata memuat syarat-syarat kerja yang harus diperhatikan dalam perjanjian kerja. Perumusan masalah dalam penelitian ini adalah bagaimana Pelaksanaan Perjanjian Kerja Di Perseroan Terbatas Ditinjau Dari Peraturan Perundang-Undangan Ketenagakerjaan dan apakah Perjanjian Kerja Yang Dibuat Oleh Perseroan Terbatas (PT) Dengan Pekerja Telah Memenuhi Unsur-Unsur Perjanjian Kerja Menurut Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Metode penelitian yang digunakan yakni: studi kepustakaan (library research)  dan penelitian lapangan (field research). Hasil penelitian ini, menyimpulkan bahwa saat ini masih terdapat beberapa perusahaan yang masih mencantumkan dalil-dalil perjanjian kerja antara perusahaan dan karyawan yang bertentangan dengan Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan, yaitu apabila salah satu perusahaan tidak membayarkan cuti karyawan yang belum diambil atau gugur, maka karyawan berhak mendapatkan uang penggantian hak sesuai dengan ketentuan perundang-undangan.
