Abstract

The availability of land is important element in development activitiesespecially for public interest. This study aims todetermine the mechanisms applied in land acquisition for Batang Power Plant, in Batang, Central Java; and to explore the supportingand inhibiting supports in the implementation of the land acquisition and settlement efforts. This study explains development ofBatang Power Plant as infrastructure projects use the mechanism of Public Private Partnerships (PPP), according to The Law No. 30of 2009 on Electricity and Presidential Decree No. 13 of 2010. The supporting factors of the implementation of land acquisitionare existence of a positive perspective of residents, the price of the deal, the full support of government and large investmentfunds. The inhibiting factors of the implementation of the land acquisition are the attitude of the citizens of rejection, the pricedisagreement, the issue of environmental pollution and the emergence of land speculators. For resolving obstacles and constraintsin land acquisition created the establishment of a forum of communication together, increasing participation of citizens, transparencyand accountability, creating guarantees the survival of the farm laborers and tenants, and enhancing community empowermentthrough CSR programs.Keywords: Acquisition of land, the power plant.

Abstract

Generally the infrastructural development needs space and land. In its process, the role of a private sector may not beneglected as this frequently does not take care of the people’s rights on land. The society, as a subject of the development, shouldhave got a prospeorus living condition. Yet, they were marginalized and regarded as an object of the development. KonsepTheconcept of infrastructural development ,which does not grab people’s right on land, takes care of the living resources, andmaintains the sustainable living situation, would be one of the solutions.Key words: land acquisition, infrastructural development.

Abstract

The high threat of disaster / multi-disaster in Indonesia leads to a number of communities in a state of being exposedand vulnerable to disasters. The high number of people living around the source of disaster / KRB III also causes the high degreeof potential risk and loss if the disaster occurs. The National Land Agency has pivotal role in regulating land for development, in thiscase, through the provision and arrangement of land for settlement (relocation) and for infrastructural development for the peopleliving in the disaster-risk areas. This study employed review of literature and legal products on land availability as its method andapproach. The allocation of land, particularly for the people living in disaster-risk areas, may be provided through land acquisition,land utilization of reserved State land from previously abandoned land, or may also be provided through land consolidation basedon spatial planning.This is intended to achieve the quality of environment, safe and prosperous society.Keywords: land availability, land consolidation, disaster

Abstract

The paper is aimed at discussing whether the policy of land acquisition can become a scheme of agrarian conflictsolution. Seen from the land acquisition as a practice of conflict solution, the paper is directly focused on conflict of agrarian context,that is whether the land acquisition can be an alternative solution scheme which can be used to solve the agrarian conflict. Thepaper wants to state that: first, the land acquisition is not intended as a scheme to solve the problem, second, the policy is a doubleblade knife that is acquisition and at the same time it is also the abolishment, third, the policy of land acquisition is intended tohold the infrastructural building, fourth,- through the agrarian conflict at Musi Banyuasin, the paper showed that the absence of landacquisition policy or land allocation for the society resulted unresolvable conflict.Keywords: land acquisition policy, conflict, unresolvable

Abstract

Land Consolidation (LC) is land policy concerning settlement return the domination and land use as efforts of landacquisition for development interest, to enhance the environment quality and preservation of natural resources by activelyinvolving the community participation. In this case government needn’t to provide compensation with a very large fund due theprinciples used in LC is building without displacing. The LC participants provide Land Contribution for the Development (STUP)that will be used for public and social facility and for the KT implementation fund. KT that mostly conducted in Indonesia is UrbanLand Consolidation (ULC) namely LC which carried out in urban or outskirt. Several countries have implemented this in handlingland acquisition and arrangement issues, such as Japan, Germany and Thailand. This study using case study’s approach which aimto get the comprehensive knowledge about KTP. The ULC is a program that upholds the justice and participatory principle. Thecommunity will receive a decent environment completed with public and social facility, in addition the community is also asked todirectly involve in the activity process start from its planning up to development. Beside that others various public facility whichusually obtained by land acquisition can be fulfilled by the community participation in ULC.Key Words: Urban Land Consolidation, Land Acquisition, Public Interest

Abstract

The research is aimed at describing conflict on the land acquisition of expanding the Komodo Airport at WestManggarai Regency, NTT. The expansion of airport is intended to accommodate the tourist since Komodo was determined to beThe New 7 Wonder of Nature. The increase of tourist place, especially on Sail Komodo program in September 2013. The focus ofexpansion was on three places namely the 300 meter runaway which belonged to Department of Transportation. The west part ofthe airport that is Binongko Hill and Batu Hill. At the last two areas, the expansion was done by eliminating the people’s land. Thisresulted protests from the society as they do not get any financial return. Using the qualitative and critical approaches, the studywas able to show the map of conflict location between the regional government and the society. At the Binongko and Batu Hillareas, the conflict took place as people did not set any financial return.Keywords: land acquisitions of Komodo airport, conflict, compensation

Abstract

One of the trigger for conflict in the case of land acquisition is the idea of resettlement as a form of compensation. Thereare many cases of resettlement that end up with rejection by the society. Resettlement in the case of land acquisition most likelyto be responded as a negative action which related to eviction or expulsion. Furthermore, this paper will reveal the problem ofresettlement in the implementation of land acquisition in Indonesia. This can be related to the model of community empowermentwhich possibly could become a constructive solution to bridge the need of development and the need of persons affected bydevelopment project to protect their rights.This study was conducted due to searching and studying secondary source thatdiscussed about development-induced resettlement. The result shows that resettlement could not only be defined as a physicaldisplacement. Resettlement has to be planned and implemented appropriately so that its effect was not exacerbating the affectedcommunities.Keywords: Land acquisition, compensation, resettlement, empowering

Abstract

The study is aimed at (a) identifying both legal and empirical constraints inhibiting the process of land clearing whichis one the important factors in land acquisition for public facilities, and (b) suggesting the concept of solving the problem, especiallyon the construction of Trans Java toll road. The research is done by library studies including legislations, documents, interviews.The efforts to solve the problems on land clearance was based on academic studies using references such as books, legislations,empirical and data and facts and actors opinions. Several constraints already identified are: (a) the difficulty of achieving anagreement on the amount of compensation caused by (i) the minimum knowledge awareness on the social function of land (ii) theimportance of infrastructure building, including toll roads, (iii) the limited fund for land acquisition, (iv) the dispute on landownership, (v) the existence of land acquisition objects by BUMN, BUMD and wakaf land, (b) the incomplete file on landacquisition, (c) the invalid evidence of land ownership, (d) the presence of land speculators, (e) the presence of provocateurs (f) theweek cooperation of private-state scheme, etc.Keywords: constraints, land clearance, land acquisition, public facilities.

Abstract

The paper is aimed at studying the land acquisition as seen from the human right perspective. The values of humanright should be the basis of the development as this is closely related to human right. Nilai-nilai dasar HAM harus mendasaripembangunan, karena terkait erat antara pembangunan dan HAM. The society, having been affected by the development, shouldget a more prosperous life than the condition prior to the development process or at least they have similar condition as comparedto the situation before the land acquisition process takes place. . The activity should also protect people’s prosperity so that theydo not get poorer.. Some consideration should taken in land acquisition. First, the loss of income due to the loss or decrease oflands. Second, the loss of jobs both temporary or permanent. Third, social unhappiness due to the loss of kinship relation. Forth,the loss of nucleus family relation. This might affect the socio-seconomic statu inc ome.Key words: Human right, public inetrest, land acquisition.

Abstract

The research is aimed at answering three related questions, either directly or indirectly on the program of large-scaleland acquisition on Mamminasata Program in South Sulawesi. These questions are: 1) How does the space structure change afterMamminasata project on land acquisitions at three villages: Samata, Pacci’nongang and Romang Polong?; 2) How does the processand dynamic land acquisition at three village take place?; 3) How does the possibility of conflict take place after the project wasdone. Those questions will be answered by descriptive qualitative research method. The result shows that there was a correlationbetween large scale land acquisition on Mamminasata program with spatial change, the rise of land and extensive agrarian conflict.Keywords: development program, Mamminasata, spatial change, land acquisition.
