Abstract

Strictly speaking, the Basic Agrarian Law is not intended to wipe out someone’s or legal body’s rights but ratherto unify the National Land Law. As mentioned at Part II of the Basic Agrarian Law, the conversion had to be done to admit boththe western registered lands and those bearing the adat rights. One of the rights that can be converted into the right ofownership is druwe desa land. Eventhough there has already been a rule on the above conversion, druwe desa at Pakraman BengVillage have not been converted up to the present moment. Abstract

Since May 2013, the National Land Agency has begun serving Thematic Map production. This implies that thereis some additional workload on the ongoing land register mapping. Therefore, it will be necessary to develop efficienttechnology to accelerate the production of cadastal maps. Nowadays, the remote sensing technologies using high-resolutionsatellite imagery has been used to produce maps, such as Land Use map, in BPN. To some needs, as a matter of fact, there arestill weaknesses on remote sensing technology. This paper is aimed at introducing the use of unmanned aereal vehicletechnology (UAV) to accelerate the production of thematic mapping. This technology is able to produce a sharper orthophotoin seeing parcel objects rather than that of satellite imagery. It has the production capacity of > 300Ha per day. Theinexpensive and portable instrument led the idea of “on demand mapping” and the establishment of an efficient photogrammetricsurveyor team that can serve in a relatively small area (<5.000Ha). The mapping will be done in locations with small changeor the location needing a need a quick response. Moreover, there is no need to wait for a wide area as well as the use of remotesensing technology or conventional air mapping. Using the UAV for mapping technology can produce images with a value of<20cm Ground Sampling Distance (GSD) with average Horizontal positional accuracy of approximately 2 times GSD.Keywords: Cadaster mapping and land use map, orthophoto image, unmanned aerial vehicle.

Abstract

Due to the complexity of the natural disaster in Indonesia, the effective disaster risk management should havecomprehensive information. Cadastre database using parcels as basic mapping units constitute the detailed information relatedto elements at risk. It is not easy for the institutions in charge with those disaster risk management to access the detailedinformation. The research is aimed at overcoming the above problems that is by designing the integrated cadastre databasescheme. The survey results are use to test the geo-database cadastre scheme. The evaluation is done by in depth interview tothe potential users. The result of evaluation showed that the cadastre database made is good enough to solve the abovementioned problems.Keywords: cadastre, design, geo-database, elements at risk, earthquake.

Abstract

One important componentin the3Dcadastral system isthe definition of height component. The height of a cadastralobjectis the height above a certain height reference field. Based on theconceptandits use, there aremany height reference fields.Each reference field will have a certain effect on the type of height system and on the corresponding precision. Theabsoluteheightisdefinedin reference to thenationalheight reference, which provides certaintyandcleargeometricandtopologicalrelationsfor3Dcadastralobjects. However, the ideal nationalheight reference field,in this case precisegeoidmodels has not been definedfor thewhole of Indonesia.An alternativesolution to the problem uses a definition ofalocalgeoidmodel or the use ofa high-resolutionglobalgeoidmodel, the EGM2008. In the implementation, the precision level ofthe available geoid model and the required precision level of cadastral objects height become the basis for the selection of ageoid model. The use ofthe geoid modelasthe height reference has also an impact on theoptimalization/development of theapplication of BPNCORSstationsthatcan beusedas ahorizontal as well as a verticalreferencepointin3Dcadastralmapping.Keywords: 3D cadastre, cadastral mapping, geoid.

Abstract

The phenomena on sea tenure by the traditional society in Nusantara maritime are spread from the western part upto the eastern area. The common property rights on maritime resources have not been explicitly admitted by the state, however,they are only considered as the state property. According to maritime anthropologists, the practice of sea tenure constitutesstrategies of resources management. This is intended to preserve the fishermen’s living conditions and marine resources. To acertain extent, the fish resources are said to belong to all people and openly accessed. This has led to a great crisis on fisheriesand if this is not well controlled there will be human disasters.Keywords: sea tenure, marine cadastre.

Abstract

The geologic condition of the Indonesian archipelago; lying on the meeting zone of three big global tectonic plateswhich actively moves, often causes the rising of many faults in the region. The faults have various activities ranging from silentmotion to active motion category. Today there are many land parcels located on the faults. Some of them have been registeredat the local Land Office. Due to the active motion of the faults, it is possible that there are movements of the land position anddimension. This may cause disputes on land boundaries. The 4D Cadastre is aimed at anticipating the coming problems.Keywords: Tectonic activities, geologic faults, land parcels.

Abstract

This paper discusses 3D cadastre in the aspect of property registration i.e. complex building and overlappingproperties on different land use. We also discuss the interoperability of the two systems between the two different agencies.This 3D cadastre registration will serve as a first attempt to develop a more complete Integrated Malaysian 3D Cadastre System.A complex system needs a clear and concise method to show the representation of data, and here we utilize Unified ModelingLanguage (UML) for the data modeling task as it has been considered better technique for such real world data modelinglike cadastre data compared to the traditional entity relationship approach. Besides 3D registration, this paper also discusses 3Dmodeling, 3D geo databasing and 3D visualization. Malaysia could embark on this 3D cadastre system since it has wellestablished 2D cadastre framework. From the previous research and discussion it can be realized that the hybrid approachcertainly would be a good approach for Malaysian 3D Cadastre System. The hybrid approach means preservation of 2D cadastreand the integration of the registration of the situation in 3D by registering 3D situations integrated and being part of the 2Dcadastral geographical data set.Keywords: 3D Cadastre, 3D Database

Abstract

The need for land always increases but the area of land never increases. This makes people to use the landeffectively. The use of traditional cadastre; the use of 2 dimensional cadastral concept, is no longer able to fulfill the completecadastral needs. Having experiments on applying the 2 dimensional land registration, knowledge on 2014 cadastral conceptsand 3 dimensional cadastral concepts, the development of the ongoing organization’s work process is badly required. The paperis aimed at explaining how to design the process of land registration in applying the 3 D cadastral and 2014 cadastral conceptsusing a modeling process. The result of the process is the new diagram showing the change of the organization; both inside andoutside. However, due to the complexity of the 3 D cadastral concept, the discussion is limited to the apartment units inIndonesia.Keywords: 3D cadastre, 2014 cadastre, modeling.

Abstract

Social justice as a principe of Pancasila should become a basis of political law on a regulating the national agrarianresources, especially at coastal areas and small islands. This is to realize the welfare of all the Indonesian citizens. Theinternalization principle of social justice in regulating land tenure tand ownership at the above mentioned places can show thebalannced and propotioronal distribution of land tenure and ownership for stakeholders; ivestors, society and the government.Keywords: Citizen, investor, and goverment.
