Abstract

Abstract: This research is motivated by the prescription in the Indonesia Criminal Code (KUHP) which is became one of the causes of a prosecutor cannot prosecute and execute a sentence against a criminal offender. A concept that was initially unknown in Islamic criminal law (fiqh jinayah). The purpose of this study is to compare the concepts of prescription in the Indonesia Criminal Code and Islamic jurisprudence. This study uses a library research method with a comparative approach. The conclusion of this study is that the Indonesia Criminal Code the prescription applies to all criminal acts at the level of prosecution and the execution of penalties. On another side  the prescription in Islamic criminal law can only be applied to takzir crime at the same level, namely prosecution and executing sentences.Keywords: expiration, criminal law, Islamic jurisprudence

Abstract

Abstract: The concept of Khalifah according to M. Quraish Shihab is that the Caliph must conform to; (a). Yahduna bi Amrina, can take people to the destination in accordance with our instructions (Allah). (b) Aabidin (including Iqam Al-Shalah and Ita’ Al-Zakat), establishing a prayer is a picture of a good relationship with God, while performing zakat is a picture of harmonious relations with humans. (c) Yuuqinun (full of confidence). The caliph must be sure that he can protect, nurture and guide so that every human being reaches the goal of his creation. (d) Shabaru (patience and fortitude), which is patient in carrying out God's mandate in the form of responsibility to prosper the earth and its contents by carrying out its laws in human life on earth. (e) Basing and implementing education according to Islam originating from Al-quran and As-Sunnah in order to realize the whole Muslim person. Because in essence the ultimate goal of Islamic education is to form Insan Kamil with a pattern of piety. The implication of the concept of Khalifatullah according to M. Quraish Shihab on Islamic education namely Islamic education must pay attention to the preparation of the design of educational programs outlined in the curriculum. In the curriculum guided in the scope of oriented on three things, namely: The achievement of the goal hablum minallah (relationship with God), the achievement of the goal hablum minannas. (relationship with humans), Hablum minal ‘alam (relationship with nature). Where the curriculum must also pay attention to the objectives of Islamic education which includes four aspects, namely. (1) aspects of akidah (yatlu alaihim ayatihi) (2) aspects of cleansing and forming behavior with ahklak al-karimah (wayuzakkihim), (3) aspects of rationality and transformation of science (wa yu'allimuhum al-kitab), (4) psychomotor aspects (wa al-hikmah).Keywords: Khalifatullah, Pendidikan Islam

Abstract

Abstract: The background of the research is based on the author's concern about the rise of apostasy cases that occur in Indonesian society, especially those that occur among public figures in the country. As happened with Lukman Sardi, Asmirandah and others. There has been a pro-contra against this phenomenon, ranging from the phobia of Islam (secular), liberal Islamic groups, radical Islamic groups (Wahhabis), and moderate modernist groups. The crucial point that has become a debate about apostasy is the application of the death law to apostates, which is regulated legally in Islamic law, so that affiliates who reject the total law arise with the pretext of human rights, and groups that defend the law with arguments undeniable. then the writer looks for the midpoint that answers and becomes the solution to this hot issue, by reviewing some classical references (turats), so that a meeting point can be found that can be agreed by both parties. To find the right formula in answering this phenomenon the author uses the Library Research method (library research) by using primary data and secondary data. Data analysis was obtained through library research which was analyzed qualitatively. From this study found answers relevant to apostasy and their consequences in contemporary Islamic law. There are two opinions that seem opposite and contradictory, between the opinions of classical and contemporary scholars. The side of difference is in the legality of beheading for apostates. One group considers it legal with valid arguments while the other group considers it not. Abstract

Abstract: Education is a basic need for the community to achieve progress. In the education process learning activities occur which in this case require media. Media education is a necessity to transfer information or knowledge to be more easily understood by students. In the early days of Islamic education, the Prophet has applied this educational media in conveying Islamic teachings to the Companions, using the Prophet's own behavior media, limbs, images, heaven and earth, sun and moon, silk and others. Along with the times, this educational media was later developed in the form of diagrams, graphics, globe, videos, tapes, power points and others.Keywords: Rasulullah's Media Education, Media Development.

Abstract

Abstract: This article will discuss family education and family efforts to overcome juvenile delinquency. The family as the first and foremost educator for children is obligatory to educate children to be good. The rise of the phenomenon of juvenile delinquency is increasingly troubling the public, especially in the era of globalization and technology and in the middle of school politics which increasingly corners the existence of family education. For this reason, this study seeks to uncover and analyze the forms of juvenile delinquency and how the family's efforts in overcoming juvenile delinquency are increasingly prevalent, especially in the midst of the Bawean people who are 100% Muslim. Abstract

Abstract: Islamic education leadership will always make Islamic values in its leadership. Communication between superiors and subordinates is not just in the realm of organization, but in Islam there is fostering relations between human beings. Leadership education are expected to be able to make corrections to the behavior that exists in the organization, and leaders of an institution are able to implement quality standards. Quality improvement and management development are very much considered. Abstract

Abstract: Studying or reading Kitab Kuning, such as the hadith books or the Qur'anic commentaries is not an easy job. Need perseverance and other sciences such as Arabic, Nahwu, Shorrof, and so on are needed. Thus, if studied traditionally it will take quite a long time, even according to some circles it takes between 5 and 15 years to be able to read and understand it well. On this basis, the Sidogiri Islamic boarding school makes a Kitab Kuning learning method, which is easily understood and easily memorized by the santri with the hope that the students who live in Sidogiri in a short time can read and understand Kitab Kuning well. In 2010 the boarding school of Sidogiri succeeded in making yellow book learning method. This method is called Al-Miftah Lil Ulum. Initially this method was tested on 500 new santri. In a very short period of time around three months there were 350 students who could read and understand Kitab Kuning by using Al-Miftah Lil Ulum method. The results of this study indicate that: a) Yellow book learning planning using Al-Miftah Lil Ulum method is: (1) Formulating yellow book learning goals. (2) Determine the subject matter. (3) determine Kitab Kuning learning strategy. (4) Hold a placement test. (5) determine the allocation of school hours. b) Kitab Kuning learning process using the Al-Miftah Lil Ulum method consists of several stages: (1) preliminary stage. (2) core stage and (3) cover. c) Evaluation of yellow book learning using Al-Miftah Lil Ulum method using oral tests and written tests while the implementation of the tests is carried out in the learning process and outside the learning process.Keywords: Learning Strategy, Kitab Kuning, Al-Miftah Lil Ulum Method

Abstract

Abstract: Professional teachers have the characteristics as based on Law No. 14 of 2005, among others: having pedagogical competence, personality competence, professional competence and social competence. The STKIP Bima Sociology Education Study Program which has teacher background holds real teaching or Field Experience Practices (PPL) with 107 PPL students with a total of 843 students from various study programs located in Bima City and Bima Regency. The research method used is descriptive qualitative. The research informants were students in social studies majors in grades X and XI, science class X and class XI. Data collection techniques used are observation, interviews and documentation. The data analysis technique according to Mile and Huberman has three stages (data reduction, data display and data verification). Testing the validity of the data using data triangulation. The research analyst uses the structural functional theory of Robert King Merton. The results of this study relate to the performance of PPL teachers and the competence of professional teachers. The performance of PPL teachers experienced a dominant increase in student assessment in the second month of implementation. Professional teacher competency consists of pedagogic competencies, personality competencies, professional competencies and social competencies. Pedagogical competencies are more emphasized on methods, media, and learning strategies. Personality competency, the teacher is still not firm in controlling students who make noise. Professional competence, the teacher still lacks mastery of the material so that it has an impact on the delivery of piecemeal material, rigid and forgetfulness. Abstract: Humans are social creatures that consist of two elements, namely self (lust) and soul (spirit), the first element is closely related to the physical while the second is related to mental / spiritual meaning. To measure the level of satisfaction as a consumer, three approaches were taken, namely utility approach, indefer curve approach and attribute approach. This paper will discuss consumer satisfaction using the total utility approach by comparing physical and non-physical satisfaction. Abstract

Abstract: This study discusses the Application of Educational Sanctions in Increasing Discipline of Students in MTs Semesta Kedungmaling Sooko Mojokerto. The approach in this study is a qualitative type case study. In collecting data used participant observation methods, in-depth interviews and documentation. The data analysis technique uses an interactive analysis model that includes several interrelated components, namely data collection, data reduction, data presentation and conclusion drawing. To check the validity of the data used extension of research, persistence of observation, and triangulation. The results of research on educational sanctions are (1) Socialization. At this stage the madrasa invites parents of students to sign a Memorandum of Understanding regarding the application of the rules and sanctions given. (2) Trial. Implementation of educational sanctions also needs to be tested, namely for 1 month with a duration of time from 12.00 to 13.00 WIB. (3) Implementation. First: Executor I, in KBM (Teaching and Learning Activities). Educators in the class have the right to reprimand, warn and record even the right to sanction students who have problems before being followed up by executor II. Second: Executor II (educator in charge of discipline) analyzes and interrogates student mistakes. After finding out the mistake, while being given a punishment, students are also given soft therapy and motivation not to repeat their mistakes again.Keywords: Educational sanctions, discipline
