Abstract

Review of Islamic Law in terms of promising (waad) at Shariah Bank. This article explains the review of Islamic law in terms of promising in the view of Fiqh. There are any debates or controversies among Islamic Jurists (Fuqaha) that the status of promising is in implementing operational bank. According to some jurists, firstly, promising is mustahab (bounded religion) but promising is not committed with the Law or Ragulations. Secondly, promising is absolutely bounded religion or compulsory to be implemented, thirdly, promising is compulsory depend on requirement of promising (muallaq) with two categories. First category is compulsory even though the requirements are not fulfill and second is not compulsory due to not fulfill requirements. The second opinion is acceptable for authors with some reasons which are discussing in this article. The method of this article used to descriptive analysis focusing the emerging of waad in implementing the operational shariah bank by studying classical literatures and Contemporer in Islamic Law. The aim of this study is to investigate and to explore the rules of waad in Islamic Contracts at Shariah Bank with looking the cause and effect of waad because there is no waad contract in the article of law and regulation in Law System in Indonesia.Keywords: Wa’d, Islamic Bank, DSN-MUI,murabaḥah

Abstract

Islamic Boarding school is an islamic education institution which has an identical tradition in indonesian muslim societuy. This institution has emerged long before the colonialism era in Indonesia. In its long history since years to pursue the concept of modernism, islamic boarding school, sometimes ,has also been perceived negatively because of transnasionalism ideology which is adopted in recent years. In that case, this paper aimed to describe the existence of islamic boarding school in indonesian social life. By argumenting and comparing some previous studies in this case to gain an accurate result. Moreover, this paper is intended to answer some western perception about islamic boarding school in Indonesia, and finally emphasize the role of islamic boarding school as a government partner and its function in creating democracy.  Keyword: Islamic Boarding School, Tradition, Modernization.

Abstract

The article explains, at least three important problems, related to how to read hadis through the viewpoint of anthropology as a humanical science, why do it must be solved, and then what are the implications of it, in understanding some hadis. It becomes important to be discussed because, however, Muslims’ religiosity often touch humanity and social dynamic sides, constantly change and evolve. Its aim is clear, to ensure that hadis as second Muslims’ life guide after the Qur'an shalih li kulli zaman wa makan. Then, by using descriptive-analysis research method and focusing on the study of hadis that explain some procedures of  prayer, this can be concluded that, if we read through anthropological approach, the hadis are historical temporal valued. This means that it requires understanding and embodiment that must be adapted to the conditions of human in everytime. For example, the shape of mosque since the Prophet to present time has undergone many changes. So the forms or procedures of worship associated with that adjust for these changes, such as role of shaf in prayer, sutrah use, doing prayer on the vehicle, terrain, boats, up to recommend Muslimah to pray in jama’ah in the mosque, and so on.Keywords: hadis, anthropology, mosque, forms or procedures of worship

Abstract

Christian is the second largest religion in Indonesia, after Islam. The relation between Christian and Islam frequently emerges prejudices, misunderstandings, and conflicts. Based on the historical records, Christians frequently refused the Government’s rules that have been agreed by the adherents of all religions in Indonesia due to the interests  of Christianization developed from Portuguese and Dutch colonial era until the Independence Day of Indonesia. The efforts of Christianization seems more aggressive after the dissolution of the communist party and during New Order era.  As a result, many communist people and the poors became the Christians at that time. The Christians’ efforts to convert the believers of other religions in Indonesia, especially Muslims, were done by various ways and forms, and they still continue to this day.This Paper answers several main research questions as follow: how is the portrait of Christianization In Indonesia from 1966-1998?; how are the responses of Mohammad Natsir, Hasbullah Bakry and Abujamin Roham as Muslim intellectuals in mapping Christianization in Indonesia?; and how are the efforts of these figures in stemming Christianization in Indonesia?. This paper hows that Christianization in Indonesia is still taking place up to the present.  Even though on the name of social activities, the efforts of Christianization in the New Order era were conducted systematically, well-organized, and carefully planned so that they succeeded to convert Muslims to be Christians satisfactorily. Such condition was admitted by Mohammad Natsir, Hasbullah Bakry, and Abujamin Roham so that they strictly responded and stated that Christianization has violated Pancasila and UUD 1945 as well as infringed the ethics of proselytizing that potentially evoked prejudices, conflicts, and destruction  of inter-religious harmony in Indonesia. Those three figures made serious efforts to weir Christianization in Indonesia by writing scientific works dealing with Christianization in Indonesia in order to fortify faith and strengthen the unity of Muslims, training and preparing professional proselytizers, performing dialogues and discussions, and fostering inter-religious harmony so as to create peace and unity of Indonesi.Keywords: Mohammad Natsir, Hasbullah Bakry, Abujamin Roham, Pemikiran, Intelektual, Kristenisasi, Toleransi, Kerukunan, Indoensia.

Abstract

The fall of Enron, Lehman Brothers and other major financial institution in the world make researchers conduct various studies about crisis. The research question in this study is, from Islamic economics and business standpoint, why the global financial crisis can happen repeatedly. The purpose is to contribute ideas regarding Islamic viewpoint linked with the global financial crisis. The methodology used is a theoretical-reflective to various article published in academic journals and other intellectual resources with relevant themes. There are lots of analyses on the causes of the crisis. For discussion purposes, the causes divide into two big parts namely ethics and systemic. Ethics contributed to the crisis by greed and moral hazard as a theme that almost always arises in the study of the global financial crisis. Systemic means that the crisis can only be overcome with a major restructuring of the system. Islamic perspective on these two aspect is diametrically different. At ethics side, there is exist direction to obtain blessing in economics and business activities. At systemic side, there is rule of halal and haram and a set of mechanism of economics system such as the concept of ownership that will early prevent the seeds of crisis. Abstract

Ada beberapa perbedaan mendasar dalam mendefinisikan teologi islam sejak masa Muhammad SAW. Beberapa diantaranya lahir dan muncul dari aspek politik, dan beberapa dari aspek lain. Dua paham teologi yang paling terkemuka adalah Ash’ariyya yang bersumber dari golongan Sunni muslim, dan Mu’tazilah dari Syi’ah. Salah satu ulama produktif abad 19 Syeikh Nawawi Bantani menulis buku salah satunya adalah Fatḥ al-Majīd. Dalam buku teologi biasanya penuis mendeskripsikan dirinya ke dalam salah satu aliran. Namun sebaliknya, Nawawi yang meskipun dirinya mengakii sebagai Asy’ariyyah, tetapi dalam beberapa pembahasan dia membela Mu’tazilah.  Pada satu sisi ia membela Asy’ariyyah dalam masalah zat Tuhan dan atributnya yang tidak terpisah.  Mengenai Qur’an apakah diciptakan atau tidak, ia mengambil kedua pendapat Asy’ariyyah dan Mu’tazilah, seperti ulama Sunni lainnya, Nawawi dengan Fatḥ al-Majid nya mencoba untuk memodifikasi aliran teologi Asy’ariyyah. Keywords: Theology, Islam, Ash’ariyya,Nawawi al-Bantani

Abstract

Legal capacity is one of the major topics in Islamic law on personal status. The Qurʾān deals with this subject, for example in Q 4: 5-6. However, it only discusses the issue of legal capacity in relation to orphans and minors. Based on the loose Qurʾānic concept of orphans and minors, the jurists of the classical period attempted to understand what was meant by legal capacity in Islam and how ought to operated in a Muslim society. One of the most remarkable jurists who tackled this issue was Ibn Rushd (520/1126-595-1198). In his celebrated collection of fatwā, the Fatāwā Ibn Rushd, he explored the issue of legal capacity based on questions brought to him, who at a time sit as a qāḍī in Sevilla and Cordoba. Abstract

Civil law violation is a form of a crime that is subjected to a certain sentence. This violation conducted by a person who is qualified to be a responsible according to law. Legal responsibility formed to identify whether a person is guilty or not qualified to be judged for his violation. In this case, if one is capable to be sentenced then it has to be cleared that the violations is legally violated. I In Islamic terminology legal responsibility also recognized. Both Islamic civil law and Indonesian state civil law are the same. However there are differences, in Islamic manner, legal responsibility objected to the formation of moral obligation, thus, every conduct that violated Shari’a will be subjected, however in an Indonesian civil law moral obligation is not to be considered.
