Abstract

Abstract: The issue of cash waqf is not really a new case in the study of fiqh. Historically, cash waqf basically included in the khilafiyah. The legal disagreement occurs as a result of culture and understanding of the legal community is still struggling in the region of fixed asset waqf. There are several answers as well as a legal opinion to be used as proof to some madzhabscholars, one of which is the opinion of Imam Hanafi that allow cash as waqf endowments on the basis of Istihsan bi al-’Urfi.The basic argument of the Hanafi is the hadeeth narrated by Abdullah bin Mas’ud, may Allah be pleased. While, Imam Malik also allow the base diwakafkan quality goods. Beside those arguments, Imam Shafi’i does not allow cash waqf and argue that the cash waqf does not immortal (can disappear). Theseare the law of several fuqaha answers to this problem. While in Indonesia, legally justify the cash waqf with the issuance of Undang-Undang No. 41 Tahun 2004 about Endowments and Peraturan Pemerintah (Government Regulation)No. 42 Tahun 2006 about The Implementation of Undang-Undang No. 41 Tahun2004 which the Regulation Legislation can provide legal certainty on the application and implementation cash waqf in Indonesia. Abstrak :Isu mengenai wakaf tunai sesungguhnya bukanlah perkara baru dalam kajian fiqh. Dalam sejarahnya, wakaf tunai pada dasarnya masuk dalam wilayah khilafiyah. Terjadi silang pendapat hukum tersebut akibat kultur dan pemahaman hukum masyarakat masih bergelut dalam wilayah wakaf tidak bergerak.Ada beberapa jawaban serta pendapat hukum untuk dijadikan hujjah sebagian ulama madzhab, salah satunya ialah pendapatImamHanafi yang membolehkan wakaf tunai sebagai wakaf atas dasar Istihsan bi al-‘Urfi. Dasar argumentasi mazhab Hanafi adalah hadits yang diriwayatkan oleh Abdullah bin Mas’ud, r.a.Sedangkan Imam Malik juga membolehkan dengan dasar kualitas barang yang diwakafkan. Sementara Imam Syafi’i tidak membolehkan wakaf tunai, dengan alasan bahwa wakaf tunai tidak abadi (bisa lenyap).Inilah yang menjadi jawaban hukum dari Fuqahaterhadap permasalahan ini. Sementara di Indonesia, secara yuridis membenarkan adanya wakaf tunai dengan terbitnya Undang-Undang No. 41 tahun 2004 Tentang Wakaf dan Peraturan Pemerintah Nomor 42 Tahun 2006 Tentang Pelaksanaan Undang-Undang 41 tahun2004 yang mana Peraturan Perundang-Undangan ini dapat memberikan kepastian hukum tentang penerapan dan pelaksanaan wakaf tunai di Indonesia.

Abstract

This paper aims to analyze the relationship between the application of the legal principle ofequality before the law in law enforcement in Indonesia with the harmonization of conflict between thestate institutions and the National Police Commission. The method used in this research is normativejuridical, namely research in the review by reference and based on the norms and rules of law, thelegislation in force, theories and doctrines of law, jurisprudence, and materials other literature relevantto the research topic. From the analysis of the data, it can be concluded that there is a recognition of theprinciple of normative and empirical rule of law, namely that all the issues are resolved with the law asthe supreme guidance. Normatively either in the Constitution of the Republic of Indonesia Year 1945,and in Undang-Undang Nomor 39 Tahun 1999 on Human Rights, the principle of equality of treat-ment before the law has been published in a comprehensive manner, as the rights that must be re-spected, guaranteed, protected and met by the state. Disharmony between institutions or law enforce-ment agency that is now emerging, should be immediately solved by basing the legislation that exists.

Abstract

Hazairin is an intellectual of Islamic law. Although most of his live and education are incommon education, not in speciality of islamic way, but Islam that was learned autodidactly makes hebecoming a great man as modern islamic reformer. He concluded that social system in what Quranwants is not a clan system or anti-unilaterality. In one side, seriousness of thinking that was produced byHazarin is considered as controversial statement. In the other side, his recent breakthrough has beenrealized through a number of Law rules.

Abstract

Since test material to the provisions of Pasal 268 ayat (3) Undang-Undang No. 8 Tahun 1981on Criminal Proceedings in Mahkamah Konstitusi, Mahkahmah decided in its decision number 34 /PUU-XI / 2013, which states that the provisions was inconsistent with the Undang-Undang Dasar1945, so it does not have binding legal force. Therefore, Peninjauan Kembali (PK) in criminal cases maybe done more than once with the new circumstances or conditions found substantial novum new foundduring previous PK undiscovered. If problems associated PK novum criminal case is considered sub-stantial, and neither should Novum issues related PK in civil cases, as may be after the filing of the PKand disconnected, no new circumstances or substantial novum recently discovered that during theprevious PK undiscovered or if there is a decision of a judges mistake or a real mistake was discoveredafter PK decided. PK is an extraordinary remedy that aims to find justice and truth material. Justice cannot be limited by time or formal provision that limits that PK is only one time. Justice is a very basichuman needs, the more basic human needs of the rule of law. But in civil cases, the results of this studyindicate that the filing PK limited only once.

Abstract

Joint property in marriage law in Indonesia comes from Indonesian tradition law which isthen used as the written law namely Undang-Undang No. 1 Tahun 1974 About Marriage and Compila-tion of Islamic Law with the aim to provide balanced position between husband and wife. The objectiveis in line with maqashid al shariah. But, the joint property that occur automatically in the written lawneeds to be reconstructed based on the ownership of Islamic law that the existence of joint property isin line with Islamic law.

Abstract

Haidh is an unique cases for women and usually it has a cycles. How if we postpone to purified when haidh has done. This paper will discuss about the reason of women students college who postpone their time to purified, and explore the Islamic view to responds this problem. This research find that the most of reasons of delay are: first, to make sure that their haidh are not exist anymore, and second, because they want to go to college. Based Islamic views, the reason to make sure whether haidhs blood completly stoped is permitted, but no more than one day. But, if the reason is to go to college, it is forbidden because it was included as negligence of shariah.
