Abstract

Abstract: Islam offers eternal universal message, namely justice, equality, respect and humanity. This universal message is the holy Sunnah of the Prophet.  Due to the advanced information and technology, the current problems of mankind increasingly appear. The problem can be viewed positively if everyone  understands completely the universal message of prophethood by always stand in the social-humanity. This articleis intended to examine the issue of human rights and Islamic law as an effort to end the dichotomy between Islam and humanitarian problems. It employed descriptive qualitative study that concern with a conceptual disputes. The findings showed that the dichotomy between the concept of human rights and Islamic law must be completed in terms of equality and humanity. Humanitarian affairs are a common action regardless of any interests, religion, politics, culture and even knowledge. If the harmony and understanding between the concept of humanity in the religious or tauhid framework is absence, the understanding of humanity must be freed from all forms of identity interest. Islamic law and human rights are two matters that support each other. Islam respects human rights and vice versa. The religious view must be universal as the views of human rights should also be universal. Each restricted view narrows the relationship.  كان الإسلام يحمل رسالة عالمية وهي العدالة والمساواة والاحترام والإنسانية. ملخص:وهذه الرسالة العالمية في الواقع من السنة النبوية المقدسة. ولكن الآن هناك مشكلات متنوعة يواجهها الإنسان فى عصر المعلومات والتكنولوجيات. وهذه المشكلات يمكن أن تكون إيجابية إذا كان الإنسان يفهم حقوق الرسالة النبوية العالمية التي تميل دائما إلى مجال الاجتماعية-الإنسانية. تبحث هذا البحث فى دراسة قضية حقوق الإنسان والشريعة الإسلامية كالمحاولة لإنهاء التناقض بين الشريعة والإنسانية. هذه المقالة من البحث النظري باستخدام الدراسة النوعية الوصفية. وخلاصة هذه المقالة أن ليس هناك التناقض بين مفهوم حقوق الإنسان والشريعة الإسلامية لأن أهدافها متساوية وهي العدالة والمساواة والإنسانية. ومن الممكن حل المشكلات الإنسانية تحت رعاية الشريعة الإسلامية والإنسانية بدون النظر إلى أية دين، وسياسة، وثقافة، ومعرفة. وإذا كان هناك التناقض بين مفهوم الإنسانية والشريعة الإسلامية فيجب أن تقدّم الإنسانية براءة من أية علاقة الهوية. إن الشريعة الإسلامية وحقوق الإنسان فى الحقيقة أمران يدعمان بعضهما بعضا. الإسلام يحترم حقوق الإنسان وكذلك العكس. ويجب أن تكون الفكرة الدينية عالمية وكذلك آراء حقوق الإنسان فينبغي أن تكون عالمية أيضا. الفكرة الضيقة لكل منها ستحمل إلى العلاقة الضيقة بينها. Abstrak: Islam membawa pesan universal yang abadi, yakni, keadilan, persamaan, penghargaan dan kemanusiaan. Pesan universal inilah sebenarnya Sunnah Nabi yang suci. Namun problem terkini umat manusia begitu variatif, degan semakin majunya informasi dan teknologi. Problem tersebut bisa menjadi positif jika semua orang benar-benar memahami pesan universal kenabian dengan selalu memihak kepada sosial-kemanusiaan. Artikel ini berupaya mengkaji problem HAM dan hukum Islam sebagai salah satu upaya untuk mengakhiri dikotomi antara Islam dan problem kemanusiaan. Artikel ini merupakan kajian konseptual, dengan jenis kajian kualitatif deskriptif. Kesimpulan dari kajian ini yaitu, dikotomi antara konsep HAM dan hukum Islam haruslah dituntaskan, kedunya pada satu ujung tujuan, yakni keadilan, kesetaraan dan kemanusiaan. Urusan kemanusiaan adalah urusan bersama tanpa memandang kepentingan apapun, baik agama, politik, budaya, bahkan pengetahuan. Jika tidak adanya keharmonisan dan kesepahaman antara konsep kemanusiaan dalam bingkai keagamaan atau tauhid maka pemahaman tentang kemanusiaan haruslah dibebaskan dari segala bentuk kepentingan identitas. Hukum Islam dan HAM adalah dua hal yang saling mendukung. Islam menghargai HAM begitupun sebaliknya. Pandangan agama haruslah bersifat universal sebagaimana pandangan mengenai HAM juga sebaiknya bersifat universal. Abstract

Abstract: To deal with modernity, al-Ja>biri> offered an alternative reading mothods which was then called Qira>ah muas}irah (contemporary readings) with its characteristics jalu al-maqru> mua>s}ir li>nafsih wa mua>s}ir lana>. The method is defined into two steps: first, fas}l al-maqru> an al-qa>ri> (subject took distance from the object study to obtain objectivity), second, was}l al-qa> ri> an al-maqru> (the subject has a link himself with the object of study in order to actualize and measure the relevance of the present subject). Furthermore, al-Ja>biri> concluded that Arabic reasoning divided into three epistemological systems, first indication system (baya>ni> epistemology) is a system that first appeared in Arab thinking. Nevertheless, al-Ja>biri> considered that this epistemology is strongly influenced by Badui (arabi>} so that it is not excessive called as hegemony, thus allowing it to be criticized. Second, Irfa>ni> system (Irfa>ni>’s epistemology}) in which knowledge is acquired through God exposure to His slaves (Kashf}) after the spiritualists (riya>d}ah). Departing from here, al-Ja>biri> actually scientific obtained in this way failing to provide a convincing conclusion. Third, the burha>ni’s system (burha>ni> epistemology) in which al-Ja>biri> is very skewed vision him- emphasized the innate potential source of knowledge is reasonable. Nevertheless, there are opposition who judge that al-Ja>biri> inconsistency against his own behavior, one hand he refused Marxist reading style of tura>ts, but on the other hand, the way he criticized Irfa> ni> and prioritized Burhani, then it is considered to be Marxist models. However, there are some scientists who considered that the discovery of al-Ja>biri> is one form of methodological revolution in reading tura> ts, the readings epistemologically useful to articulate the gap tradition (tura> ts) and modernity.Keywords: Tradisi (Tura>th), Qira>’ah Mu’as}irah, Baya>ni>, Burha>ni> dan ‘Irfa>ni>.

Abstract

Abstract: This paper examines thoughts, views, and arguments of clerics of Ponorogo Pesantren on the reform of law of waqf. The reform of law of waqf refers specifically to the form of money waqf and the existence of duration waqf. The main focus of this paper is the typology of thought of clerics of Ponorogo Pesantren on money waqf and duration waqf. Through in-depth interviews and life history of five clerics of Ponorogo Pesantren, it is found that the construction of thinking of the clerics of pesantren on money waqf and duration waqf falls into three catogories, namely 1) within the scope of the mindset of one mazhab like Syafiiyyah, 2) within the mindset of talfîq and takhyîr but still in the frame of four Sunni mazhab, and 3) within the mindset of reinterpretation of the texts of the Quran and the Sunnah as a response to the contemporary reality of money and duration waqf. The three categories of thinking of the clerics of pesantren kiai have diverse implications as manifested in their views and arguments either in money or duration waqf. Tulisan ini mengkaji tentang pikiran, pandangan dan argumentasi kyai pesantren Ponorogo tentang pembaruan hukum wakaf. Secara spesifik hukum wakaf yang dimaksud yaitu berupa keberadaan wakaf uang dan wakaf berdurasi. Fokus utama tulisan ini adalah bagaimana tipologi pemikiran kyai pesantren Ponorogo tentang wakaf uang dan wakaf berdurasi. Dengan melakukan teknik pengumpulan data melalui wawancara mendalam dan life history atas lima kyai pesantren di Ponorogo serta dalam pendekatan deskriptif-tipologis, maka tulisan ini menghadirkan bahwa kontruksi tipologis pemikiran kyai pesantren tentang wakaf uang dan wakaf berdurasi, terpolakan menjadi tiga tipologi, yaitu 1) masih dalam pola pemikiran lingkup satu maz|hab seperti Syafi’iyyah, 2) dalam pola pemikiran takhyir dan talfiq tetapi masih dalam bingkai maz|hab empat Sunni, dan 3) dalam pola pemikiran re-interpretasi atas teks-teks Al-Qur’an maupun Sunnah sebagai respon atas realitas kekinian tentang wakaf uang dan wakaf berdurasi. Ketiga kontruksi tipologis pemikiran kyai pesantren tersebut memberikan implikasi yang beragam sebagai terwujud dalam pandangan dan argumentasi mereka baik dalam wakaf uang maupun wakaf berdurasi.  Keywords: Muaqqat, Muabbad, Cash Waqf, Mauqu>f ‘Alaih.

Abstract

Abstract: The notion of the epistem in the logical Arabic terminologyis devided by Muh}ammad Abid al-Ja>biri> into three kinds, namely, baya>ni>, burha>ni>, and  irfa>ni>. The distinction of these is made on the basis of its epistemic distinction. Another logical aspect that rarely to be discussed is the type of knowledge d}aru>ri> it. In this category, people assumed that d>aru>ri> is single and there can be agreement about it, bit is not in certain case. The view of knowledge d}aru>ri>  according to baya>n dan burha>n is relatively contradicted. Departing from this contradiction, the writer is intended to analyze it by formulating the problems in the following (1) how is the concept of d}aru>ri> knowledge in each perspective  in regard to the necessary of truths, which should be mutually supportive but the facts are contradictory; (2) how is the difference between d}aru>ri> knowledge in the view of burha>ni> and baya>ni>? By comparing these two perspectives, the objectives of this article is (1) to reveal the form of d}aru>ri> knowledge from both views and (2) to analyze the differences of constitute that form it. ملخص:قسّم عابد الجابري مفهوم نظرية المعرفية فى تكوين العقل العربي على  ثلاث أقسام، وهي البيان والبرهان والعرفان. والفرق بين هذه الثلاثة بناء على معرفيتها. ومن الفروق السابقة يمكن أن يأخذ جوانب أخرى سوى قضية المعرفية. وهذا الجانب من نوع العلم الضروري. كان الناس يعتقدون أن العلم الضروري هو واحد ويمكن أن يكون هناك اتفاق حول هذا الموضوع. ولكن في الحقيقة ليس كمثل ذلك. تتعارض ضرورية العلم فى المنطق البياني والبرهاني. وبناء على هذه المسألة أريد أن أبحث فى نوعين من العلم الضروري، وأسئلة هذا البحث أولا، كيف مكانة العلم الضروري في كل من هذا العقل الذي ينبغي أن تكون مطابقة ولكن فى الحقيقة هي متناقضة. ثانيا، كيف الفرق بين العلم الضروري فى العقل البرهاني والبياني؟ وكانت أهداف هذا البحث للكشف عن شكل العلم الضروري من جهة العقل البياني والبرهاني والكشف عن أسباب الاختلافات التي يبنى عليها. Abstrak: Pemikiran epistem dalam kancah nalar Arab dipetakan oleh Muh}ammad ‘Abid al-Ja>biri> dalam tiga nalar, yakni nalar baya>ni>, burha>ni>, dan‘irfa>ni>. Pembedaan tiga kategori nalar ini dibuat berdasarkan perbedaan epistemnya. Dari perbedaan itu ada aspek yang menarik untuk dibuat sebuah kategori baru dalam hal pembedaan nalar selain persoalan epistem, yang selama ini masih jarang dilakukan. Aspek yang menarik selain kategori epistem tersebut adalah kategori jenis ilmu d}aru>ri>nya. Dalam kategori ilmu ini, selama ini orang menyangka bahwa ilmu d}aru>ri> itu tunggal dan bisa terjadi kesepakatan tentangnya. Namun dalam masalah ini ternyata tidak demikian. Ked}aru>riahan ilmu dalam nalar baya>n dan burha>n bahkan terjadi pertentangan yang cukup tajam. Berangkat dari pertentangan ilmu dloruri dalam dua nalar ini, kami ingin menelusuri dua bentuk ilmu d}aru>ri> dalam kedua nalar tersebut, yang rumusan masalahnya adalah pertama, bagaimana sejatinya ilmu d}aru>ri> pada masing-masing nalar ini dalam menganggap kebenaran yang berfaedah niscaya, yang seharusnya saling mendukung tapi kenyataanya saling bertentangan?. Kedua, bagaimana perbedaan antara ilmu d}aru>ri>i dalam dalam nalar burha>ni> dan nalar baya>ni>? Dengan membandingkan kedua hal ini maka tujuan yang akan dicapai dari pembahasan pertama adalah mengungkap bentuk ilmu d}aru>ri> dari kedua nalar dan dari masalah yang kedua tujuannya adalah menelusuri perbedaan yang menjadi pembentuknya. Kata kunci: Nalar Baya>ni>, Burha>ni>, ‘Irfa>ni>, dan Ilmu D}aru>ri>

Abstract

Abstract Lubâb al-Hadîts, creation of  Imam Jalâl al-Dîn al-Suyûthî is a secondary book that contains 400 hadîtss. But in this book the author did not explain about the quality of the sand and matn of the hadîts overall. The issues that will be studied in this paper are hadîtss about the virtues of marriage at chapter twenty-five. The hadîtss have been frequently used by the public as evidence, especially at wedding moments. The writer concludes that only three of seven hadîtss on the importance of marriage in the book of Lubâb al-Hadîts have sands. They are also mentioned in the Ibn Majah’s book and Ahmad bin Hanbal’s book. The sand of first and second hadîts is dla’if and the third hadîts is shahîh lighairih. The matns of all hadîts are shahîh and those hadîtss can be hujjah because they relate to fadlâ’il al-aʻmâl. Lubâb al-Hadits, karya Imam Jalâluddin al-Suyûthî, adalah buku hadis sekunder yang berisi 400 hadîts. Dalam buku ini, penulis tidak menjelaskan kualitas sanad dan matan hadis secara keseluruhan. Masalah-masalah yang akan dikaji dalam tulisan ini difokuskan pada hadis tentang keutamaan pernikahan yang bab dua puluh lima. Hadis-hadis tersebut telah sering digunakan oleh masyarakat sebagai dalil, terutama dalam momen pernikahan. Penulis menyimpulkan bahwa hanya tiga dari tujuh hadis tentang pentingnya pernikahan dalam kitab tersebut memiliki sanad. Hadis-hadis tersebut juga disebutkan dalam kitab Ibn Mâjah dan Ahmad bin Hanbal. Sanad pertama dan kedua hadis adalah dlaʻîf dan sanad hadits ketiga adalah shahîh lighayrih. Matan semua hadits tersebut berkualitas shahîh dan dapat hujjah karena berhubungan dengan persoalan keutamaan amal. Keywords: Keutamaan nikah, Lubâb al-Hadîts, Jalâl al-Dîn al-Suyûthî.

Abstract

Abstract: Two aspects in Islamic teachings are normative and historical aspects. These two aspects are always intertwined throughout history. However, there are some Muslims who were less notice one of that aspect, the historical aspect. As a result, they are romanticism and apathy in the face of changing times is always changing. Unfortunately, the current methods of Islamic studies, according to the writer, are still dominated by this group. The social sciences and humanities have not received serious attention in the study of Islam. Therefore, the writer argues that this study of the need naqdiyah (criticism) in Islamic studies during this time that begins with the search for the fundamental values of Islam through the deepening of the philosophy of science and epistemology of Islam. Philosophy realized that the religious studies are something that does not separate from the authors’ point of views, inventors and originators. On the other hand, Islamic epistemology would explore various seizure hegemonies that occur in the history of Muslims. Expected epistemology is the epistemology that greet and advise each other, not the other way which claims to be the sole owner of the truth. In the reconstruction of Islamic studies, the authors offer the importance of doing multi approach to address each other as well as the presence of different methodologies. Multi approaches and methodologies that are not monolithic would make the study of Islam always answer the needs of contemporary life such as human rights, gender, environment, democracy and others. Keywords: Fundamental Values, Epistemologi Islam dan Koneksitas Pendekatan

Abstract

Abstract:  Encountering between Islam and Javanese culture is fascinating to study. It is proved by cultural unique in Java community, such “selametan” tradition in building the house. Therefore, in this study discover two elements. First, look for the motivation in holding that tradition.  Second, the depth meaning of “selamatan sajen” towards Javanese community. This study conducted qualitative approach and this was case study. This study focused on the relation between Islam Javanese culture. The population was the civilizing of Gentan, Ngrupit, Jenangan, Ponorogo. Observation and interview were used to collect the data. It was found that the existence of selametan sajen is as same as the Islamic assent. It was proved by Prophet Adam a.s and his son also used that tradition in the past. Moreover, the intended meaning of its culture is to pray to Allah. Then the purposes are, first, safeness during the process in building house; second, hopefully neighbors blessing. Selamatan tradition invites their neighborhood and gives them various kinds of food and snacks. Those are called as sajen. In line, selametan tradition such building a house, has contribution in spiritual education. As the reason, its sajen has different depth meaning of each symbol. Abstract

Abstract: During its development, al-Qur’an has become a central point in the life of every Muslim. As guidance for all mankind (hudan li al-na>s}, as the rule of law, and the rule of life, al-Qur’an has become a reference in any Muslim behaviors. For a Muslim, al-Quran is not only a text to be read and understood, but the text also offers solutions to solve problems. One of the important themes in al-Quran is methods of missionary endeavor by al-mawiz}ah al-h}asanah. The method that conducted by the Prophet in preaching rhetoric is al-mawiz}ah al-h}asanah. Through this paper, the writer wanted to explain methods of al-mawiz}ah al-h}asanah that contained in the Quran, and whatever its contained in the al-mawiz}ah al-h}asanah hence al-Quran makes one of missionary endeavor methods. The concept of al-mawiz}ah al-h}asanah in al-Qur’an repeated 20 times but its concept are not calculated at al-Sunnah. Al-mawiz}ah al-h}asanah means advice kindness, goodness educating, guiding goodness. And the Prophet developed three methods of preaching throughout his life with wisdom methods, method of al-mawiz}ah al-h}asanah and method muja>dalah. Furthermore, the forms of al-mawiz}ah al-h}asanah are: 1) clear and gentle statements 2) polite and reachable 3} memorable stories 4) Praise and reflection 5) motivated and treated.
