Abstract

Pollution due to industrial waste occurs mostly in coastal ecosystems as well as on sea water conditions. Meanwhile, when looking at the damage that occurred in coastal areas and oceans, the damage that occurred in the form of damage to coastal ecosystems such as mangroves and coral reefs due to reclamation and pollution. This condition occurs when Batam is held by the Batam Authority. Associated with environmental pollution problems caused by the industry bring tremendous impact on peoples lives, because it can cause environmental damage. Therefore, it needs serious handling to overcome them. So that between government, society and the environment needed a reciprocal relationship that must always be developed to stay in a harmonious and dynamic state. Keywords: The role of government in handling Pollution in coastal area of Batam City   Pencemaran akibat limbah industri banyak terjadi pada ekosistem pesisir serta pada kondisi air laut. Sedangkan bila melihat kerusakan yang terjadi di wilayah pesisir dan lautan, kerusakan yang terjadi berupa rusaknya ekosistem pesisir seperti mangrove dan terumbu karang akibat reklamasi dan pencemaran. Kondisi ini banyak terjadi ketika Batam dipegang Otorita Batam. Terkait dengan permasalahan pencemaran lingkungan akibat industri membawa dampak yang luar biasa terhadap kehidupan masyarakat, karena bisa menimbulkan kerusakan lingkungan. Oleh karena itu, perlu penanganan yang serius untuk mengatasinya. Sehingga antara pemerintah, masyarakat dan lingkungan dibutuhkan hubungan timbal balik yang selalu harus dikembangkan agar tetap dalam keadaan yang serasi dan dinamis. Abstract

Many have a general criminal cases committed by members of the military of this country, but in law enforcement as if the members of the military as a criminal not touched by the criminal law, as a general jurisdiction to try criminal offenses committed by members of the TNI still under military justice. Moreover, the military justice system that are covered so much of the sense of justice. It should be criminal offenses committed by members of the military brought to the general court as mandated by the Constitution amendments 45 and MPR Decree No. VII / 2000, which regulates the separation of the role of the National Police Force constituted by the issuance of MPR NO.VI AND VII OF 2000 in Article 3, paragraph 4 of MPR Decree NO . VII / MPR / 2000, reads as follows: a) the Indonesian National Armed Forces are subject to the authority of the military court in the case of violations of military law and subject to the general judicial power in violation of the general criminal law, b) When the authority of the general court referred to in subsection ( 4a ) this article does not work then the soldiers subordinate judicial power which is regulated by law. This means that throughout the criminal law for military materiel ( KUHPM ) has not changed, it is difficult to apply an idea or a "political decision" contained in MPR Decree No. VII / 2000 , that the "soldiers are subject to the authority of the general court in the case of violation of the general criminal law". So keep referring to Law No. 31/1997 about the existing military justice governing the criminal justice common for soldiers, so that a wishful thinking will achieve "the principle of equality before the law" against members of the military and members of the military will continue to be the golden boy in this Republic. Abstract

Abstract

Kids are part of human who is not separated, all humans are from childhood. Protection of children are increasingly being discussed, as a result of the frequent violations of child protection cases in every region in Indonesia. In the border areas of Indonesia, many trafficked children. Therefore this paper tries to explain bagimana factors that cause the sale of children in border areas, how to organize the strengthening of the protection of children in border areas of Indonesia as well as how mewujdukan sustainable child protection in the border area. Apparently a lot of factors that led to the sale of children in border areas, especially poverty, in organizing the protection of children in the border area, it is necessary to strengthen the rule of law protecting children against trafficking, and to realize sustainable child protection to keep child life continuously. Keywords: Child, Human Trafficking, Regional, Border, Indonesia.   Anak-anak adalah bagian dari manusia yang tidak terpisah, semua manusia berasal dari masa kanak-kanak. Perlindungan anak semakin banyak didiskusikan, akibat seringnya terjadi pelanggaran kasus perlindungan anak di setiap wilayah di Indonesia. Di daerah perbatasan Indonesia, banyak anak yang diperdagangkan. Oleh karena itu makalah ini mencoba menjelaskan bagimana faktor-faktor yang menyebabkan penjualan anak di daerah perbatasan, bagaimana mengorganisir penguatan perlindungan anak-anak di daerah perbatasan di Indonesia serta bagaimana mewujdukan perlindungan anak yang berkelanjutan di daerah perbatasan. Rupanya banyak faktor yang menyebabkan penjualan anak-anak di daerah perbatasan, terutama kemiskinan, dalam mengorganisir perlindungan anak-anak di daerah perbatasan, perlu memperkuat peraturan undang-undang yang melindungi anak-anak dari perdagangan manusia, dan untuk mewujudkan perlindungan anak yang berkelanjutan. Abstract

Permission publication is state’s authority to allow someone or a group of people, or law institution to commit a certain activity. Eventhought that is an authority in state’s authority, its publication still must be done selectively by noticing formal juridicial aspect (term of rule of legislation) sociology, or even ecology. however, in its practice, it’s often found the published permission through the decision or other instruments which disobey the term of rules of legislation, which cause social and ecology impact. The study in this transcription relates to the IUPHHKHT publication problem to PT. RAPP in Padang island. the permission publication by forestry ministry causes the complex problematic in Padang island appeans. the publication of degree. 327 in 2009 and degree 180 in 2013 have contradicted several rules of legislation, especially the one related to coastal and isles territory management, and internal peat area utilization. The revision of degree. 327 which is based on mediation term’s recommendation is a disablement, because the state as one of the cause of conflict even tried to mediate and in fact, the mediation team is also failed to gather the people and the company in a discussion. The publication of degree 180 as the transformation’s policy also disobeyed the recommendation they selected. The existence of conflict, related to the persistence of people management territory overlapping with concession; the inhuman compensation payment which is far from the land price’s normal standard; environmental demage conflict and demand for woods; and horizontal conflict between societies. the overall conflict those still exist indicate the state failed and neglected the fulfillment and protection of Padang Island societies right as citizens. Abstract

Children as the nations next generation, should be protected from childhood to adulthood. If the child since childhood was in the neighborhood crime, the boy can be the perpetrators of criminal acts in the future, and will be disturbing peoples lives. It is wise if the protection of children starting in school. School as place a child studying, along with peers, and learn to respect for peers, with smaller or teachers. Nowadays, very sad child protection in the school environment, imagine in the school of environmental protection of children is not running properly, many child protection were violated, so kids do not feel comfortable at school, absences from school, or drop out of school. Against this its good, we are all concerned with the protection of children, especially in the area of the school. This paper tries to offer the world the concept of the protection of children in schools on an ongoing basis, starting from the urgency of the protection of children in school, and the dynamics of child protection solutions in schools, as well as offering a sustainable concept of child protection in the school. The conclusion of this paper expects that all parties can participate in an ongoing child protection in the school. Sangat bijak jika perlindungan anak dimulai di dunia sekolah. Sekolah sebagai tempat anak menimba ilmu, bergaul dengan teman sebaya, dan belajar menghargai kepada teman sebaya, teman yang lebih kecil ataupun para guru. Sekarang ini, perlindungan anak sangat menyedihkan di lingkungan sekolah, bayangkan di lingkugan sekolah perlindungan anak tidak berjalan dengan semestinya, banyak perlindungan anak yang dilanggar, sehingga anak tidak merasa nyaman di sekolah, absen dari sekolah, atau putus sekolah. Terhadap hal tersebut ada baiknya, kita semua memperhatikan perlindungan anak, terutama di wilayah sekolah. Tulisan ini mencoba menawarkan gagasan konsep perlindungan anak di dunia sekolah secara berkelanjutan, dimulai dari urgensi perlindungan anak di sekolah, dinamika dan solusi perlindungan anak di sekolah, serta menawarkan konsep perlindungan anak yang berkelanjutan di sekolah. Abstract

Legislative elections are elections to choose members of the DPR, DPD and DPRD. Elections of 2014 refers to the Law No. 8 of 2012 that the implementation of voting takes place on Wednesday, April 9, 2014. In each stage of the implementation of the election can not be separated from the existence of the phenomena observed and found to be studied. In the 2014 legislative elections this phenomenon to the attention of the author is the repeat voting. Of the 546,278 polling stations inside and outside the country, as many as 779 polling stations have to hold repeat polls including Tanjungpinang. As for the problem of this research is related to policy organizer re-election in voting in Tanjungpinang. The research method used is descriptive analytical research through a qualitative approach. Sources of data obtained through primary data is the main data obtained directly from informants through interviews with commissioners and staff KPU secretariat Tanjungpinang and secondary data is data obtained from literature books, legislation, internet and other scientific work. From the research it can be concluded that the author Tanjungpinang KPU vote again at the polling place that TPS 275/36 by reason of ballots confused. In the implementation of revoting, Election Commission Tanjungpinang based on the electoral law, regulations and the Commission Circular. In principle the setting because of the re-voting ballots are not dealt with explicitly swapped in the laws or regulations of KPU. Abstract

Law Number 23 Year 2014 About the local government, said that the Regional (district / city) can form the districts in order to improve the coordination of governance, public services, and the empowerment of village communities / villages. Karimun Regency is one of regencies in Riau Islands Province, which borders directly with Singapore. The geographical position of Karimun regency consists of several islands large and small impede access to public services. Therefore, expansion of the existing sub-district is one alternative solution in order to improve the welfare of society. The purpose of this research is to study the prospective analysis of the division of the sub-district of the District Parent Sugie Moro based on Government Regulation No. 19 Year 2008 on the District. The design study is descriptive analysis with qualitative and quantitative approach, where data in the form of empirical reality analyzed qualitatively by describing and considering the provisions of the normative, theoretical judgment or views of experts and key informants related to expansion efforts districts. The results of this study are candidates for the District Sugie Besar only meet one of three requirements formation of districts, namely the requirements of the technical requirements. As for the physical requirements of the administrative and territorial unfulfilled. Candidates for the technical requirements of the District of Sugie Besar Acquire Score 368 which is in the category and Recommended Able to be formed into new districts. While the District Parent Moro after bloomed (formed District of Sugie Besar) they meet one of three requirements of establishing districts as set out in Regulation No. 19 Year 2008 on the District, namely the requirement of technical requirements, while for the administrative and physical cantonal requirements are not met. For the technical requirements, the District Parent Moro obtain a score of 391 in the category Ability and Recommended. The conclusion from this study is that although only meet one of three requirements formation of districts, the Government of Karimun Regency will still be able to carry out the formation of the District Candidate Sugie Besar. It is possible as a rule, that the district / city government can be formed districts in the region that includes one or more islands, which requirements are exempt from the administrative requirements, terms of physical territoriality, and technical requirements as those mentioned with consideration to the effectiveness and efficiency of service delivery and community empowerment village on the remote islands and / or outer. Abstract

Characteristic of the leader can apply with Thought of Mao Tse-Tung which “Put on the ideas of the citizenry and focus in that ideas, then you give it back to the citizenry in order that ideas, and if that happen with the ideas you must correct it. It is the basic method of leadership. ”The conclusion of Thought of Mao Tse-Tung” is appropriate to apply in fighting against of corruption because of The Letter of the Act of Republic of Indonesia Number 20 of 2001 concerning changes ofThe Letter of the Act Number 31 of 1999 concerning Eradication’s Act of Punishment in Corruption was created the justice for the society when the corruptors are accused the corruption. The point of view is takes the profit with the president as a executive leader then the president can become a subject of law with distinct character. Keywords: Corruption, Mao Tse-Tung, leader.   Ciri khas pemimpin bisa diterapkan sesuai pemikiran Mao Tse-Tung yaitu “Bersandar pada gagasan masyarakat dan fokus pada gagasan itu, lalu berikanlah kembali gagasan tersebut kepada masyarakat dan itulah gagasan sebenarnya. Ini adalah metode dasar kepemimpinan.” Kesimpulannya bahwa pemikiran Mao Tse-Tung adalah tepat untuk diterapkan dalam memerangi korupsi karena Undang-Undang Republik Indonesia Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi telah menciptakan keadilan bagi masyarakat saat koruptor dituduh melakukan korupsi. Hal lainnya presiden sebagai kepala eksekutif maka presiden dapat menjadi subjek hukum yang bersifat tegas. Adanya sikap yang tegas ini akan menimbulkan dampak kepada penegak hukum untuk menerapkan peraturan perundang-undangan secara adil. Kata kunci: Korupsi, Pemberantasan, Mao Tse-Tung
