REFLEKSI HUKUM is a peer-review scholarly Law Journal issued by Faculty of Law Satya Wacana Christian University which is purported to be an instrument in disseminating ideas or thoughts generated through academic activities in the development of legal science (jurisprudence). REFLEKSI HUKUM accepts submissions of scholarly articles to be published that cover original academic thoughts in Legal Dogmatics, Legal Theory, Legal Philosophy and Comparative Law. In order to guarantee the originality of articles and to avoid plagiarism, eewoww and Grammarly software will be used for each article checking. In addition, the author whom the article is announced to be eligible for being published shall submit approval declaration of article publishing and plagiarism declaration. Refleksi Hukum receives articles in Bahasa Indonesia and English and it will be issued twice in a year (April and October).

Abstract

AbstrakPenyelenggaraan pelayanan publik saat ini menjadi titik sentral tolok ukur tertib hukum administrasi dalam rangka mewujudkan tujuan negara untuk memajukan kesejahteraan rakyat. Ombusdman sebagai lembaga yang memiliki kewenangan pengawasan terhadap penyelenggaraan pelayanan publik diharapkan dapat mewujudkan pemerintahan yang bersih dan baik. Namun demikian, keberadaan Ombudsman tidak sepenuhnya mampu mengatasi praktik tindak pidana korupsi yang berawal dari perilaku maladministrasi oleh oknum penyelenggara pemerintahan. Bedasarkan itu maka di masa depan perlu pembaharuan hukum secara terintegral dan komprehensif yang meliputi substansi hukum yaitu pembaharuan UU No. 37 Tahun 2008 dan sekaligus membangun struktur kelembagaan hukum Ombusdman dan kultur hukum masyarakat dalam mendapatkan jasa pelayanan publik.AbstractThe focal point of orderliness in administration law is public service performance in order to establish the pupose of the nation which is publics welfare. Ombudsman as institution that has monitoring authority of public service execution is expected to create clean and good government. Nevertheles, existency of Ombudsman is not fully capable to overcome corruption practice that begins from maladmistration practice. Therefore, comprehensive and integral law reform is needed, including amandement Act No. 37/2008, build Ombudsman as institution, and raise public culture regarding receiving public service.

Abstract

AbstractThis article discusses the application of the crime diversion to children in juvenile criminal justice system. So far in the criminal justice system, punishment for perpetrators of children not create justice the perpertrators and victims. On the other hand also still leaves another problem that was not solved even though the perpetrators have been punished. See the principle of the protection of children especially the principle that the best interest of the child. The cild process is required for settling disputes outside the criminal mecanism or commonly referred to as diversion. Settlement through this diversion is expected to provide a win-win solution tho the cases encountered so as to create fairness both in terms of perpertrators as well as for the victim.AbstractThis article discusses the application of diversion in juvenile criminal justice system. So far in the criminal justice system, punishment of juvenile perpetrators of crimes did not create justice for the perpertrators and victims. On the other hand, the system also leaves another problem that has not been solved eventhough the perpetrators have been unished. Noting one of the principles in the protection of children, which is the best interests of the child, criminal cases with children as perpetrators should be settled outside the criminal mechanism generally referred to as diversion. Settlement by way of diversion is expected to create a solution that is balanced so as to create justice for both perpetrators and victims. Nevertheless, the diversion can not be applied to all of the criminal act. Diversion can only be applied in offenses committed by children which are sanctioned by penalty of no more than seven years imprisonment and the offence is not a repetition of crime (recidive).

Abstract

AbstrakKontrak jasa konstruksi disusun oleh penyedia jasa konstruksi dan pengguna jasa konstruksi (sektor swasta atau pemerintah). Seringkali persiapan kontrak kerja konstruksi dilakukan secara tidak seimbang karena kontrak disiapkan oleh salah satu pihak, yaitu penyedia jasa konstruksi. Oleh karena itu, kontrak kerja konstruksi yang dikaitkan dengan teori keadilan oleh John Rawls menjadi issue yang menarik. Dalam artikel ini, penulis akan menelaah keseimbangan yang seharusnya ada dalam kontrak kerja kontruksi yang seharusnya diwujudkan oleh kedua pihak dalam menyusun kontrak kerja kontruksi.Selanjutnya juga akan dianalisis mengenai penyelesaian sengketa dari sudut pandang hukum perdata. Penyelesaian berdasar hukum perdata merupakan sesuatu yang masuk akal mengingat pada dasarnya, issue yang diselesaikan adalah wanprestasi. AbstractConstruction service contracts are concluded by and between the service provider (providers of construction services) and the service user (private or government). Frequently, the preparation of construction contracts are unequal because the contract has already been prepared by one party (service user). Therefore, it is an interesting issue to associate unequal construction contracts with the theory of justice promoted by John Rawls. In this article, the author will examine the balance that should exist in the construction contract that should be realized by both parties in the contract. Later on, the resolution of the dispute emerging from construction contract will also be analyzed from the civil law perspective. Dispute settlement based on civil law is basically appropriate considering that at the last resort, the relevant issue is breach of contract.

AbstrakKegiatan bisnis sangat menuntut adanya jaminan kepastian hukum. Salah satu persoalan penting terkait dengan kepastian hukum tersebut adalah perpanjangan hak guna usaha. Tulisan ini membahas mengenai jaminan kepastian hukum pemberian perpanjangan hak guna usaha, termasuk perlindungan hukum terhadap investor berkenaan dengan asset yang dimilikinya di atas hak guna usaha ketika permohonan perpanjangan hak guna usahanya tidak dikabulkan. Terkait dengan itu tulisan ini menemukan adanya perbedaan pengaturan antara Peraturan Pemerintah dengan Peraturan Menteri serta tidak memadainya perlindungan hukum kepada investor menyangkut aset-asetnya yang ada di atas hak guna usaha ketika permohonan perpanjangan hak guna usahanya tidak dikabulkan. AbstractBusiness activities requires guarantees of legal certainty. One of the important issues related to the legal certainty is the extension of the right to cultivate. This paper discusses the legal guarantee provided in the extension of the right to cultivate, including legal protection of the investor in respect of its assets over the right to cultivate when the application for renewal of their right was not granted. This paper revealed that there are differences between the relevant Government Regulation and Minister Regulation as well as inadequacy of legal protection of the investors assets located on the tract of land with the right to cultivate when the application renew that right was not granted.

AbstrakSebagai pihak yang dapat bertindak dalam hukum, subjek hukum memiliki kewenangan hukum yang tidak dimiliki pihak lain. Ada dua katagori subjek hukum yaitu manusia dan badan hukum. Manusia sebagai subjek hukum yang bersifat natural. Pertanyaan siapakahmanusia sehingga dia dapat menjadi subjek hukum, tidak dapat dijawab hanya dengan satu kalimat. Esensi manusia sebagai salah satu dasar menjawabnya. Pertanyaan selanjutnya adalah apakah badan hukum itu sehingga dia dapat berkedudukan sebagai badan hukum. Pertanyaan-pertanyaan inilah yang akan dijawab oleh tulisan ini.AbstractAs the parties that are capable to act under the law, legal subject possess particular capacity that is not possessed by other entity. There are two categories of legal subjects, namely human and legal entities. Humans as a legal subject that is natural. However, the question of who is human as the legal subject can not be answered just in one sentence. The analysis of human nature is one way to provide a substantial answer. The next question is what is a legal entity so that it is regarded as a legal subject. These questions will be addressed properly in this paper.

Abstract

Abstrak Pengakuan terhadap kebebasan untuk beragama dan berkeyakinan merupakan sebuah penegasan terhadap prinsip bahwa kebebasan beragama dan berkeyakinan adalah hak dasar.Kebebasan beragama dan berkeyakinan tersebut saat ini terancam dengan adanya keinginan untuk membentuk undang-undang, yaitu Rancangan Undang-Undang tentangKerukunan Umat Beragama. Permasalahan dari RUU tersebut adalah apakah dengan pengaturan hal itu mendorong masyarakat untuk toleran atau justru menjadi alat untuk mengintervensi keberadaan umat beragama di Indonesia. RUU KUB bisa saja melegalisasikan kehidupan beragama yang nyaman, namun juga melegalisasikan usahausaha untuk membatasi ruang gerak penyebaran agama melalui eksistensi umat, khususnya kaum minoritas sehingga hal itu tidak konsisten dengan semangat kemajemukan.AbstractRecognition of the freedom of religion and belief is an affirmation of the principle that freedom of religion and belief is a basic rights. This basic freedom is currently threatened by the aspiration to establish a law, as reflected by intense discussion of the Bill on Religious Harmony. The problems of the bill is whether the law will encourage people to be tolerant, or just become a tool to intervene in the existence of religious communities in Indonesia. The Bill on Religious Harmony could establish contented religious life, but it could also formalize efforts to limit the spreading of religions which is in turn not consistent with the spirit of pluralism.

Abstract

 AbstrakArtikel ini membahas mengenai penyelesaian sengketa dalam kontrak tambang emas melalui arbitrase. UU No. 4 Tahun 2009 menentukan bahwa setiap sengketa yang muncul dalam pelaksanaan izin pertambangan diselesaikan melalui pengadilan dan arbitrase dalam negeri sesuai dengan ketentuan peraturan perundang-undangan. Dalam pembahasan ini penulis berpendapat bahwa pilihan penyelesaian sengketa melalui arbitrase adalah pilihan yang tepat ketimbang pilihan litigasi di pengadilan. Hal tersebut dikarenakan arbitrasi memiliki beberapa kelebihan seperti proses penyelesaian sengketa lebih cepat, hasil kesepakatan yang bersifat “win-win solution”, serta jaminan kerahasiaan sengketa dari sorotan publik. Berdasarkan kelebihan- kelebihan tersebut, arbitrase dinilai lebih tepat untuk diterapkan dalam sengketa kontrak tambang emas di Indonesia.Abstract                                                                   This article discusses the settlement of disputes in the gold mining contract through arbitration. Law Number 4 of 2009 specifies that any disputes that arise in the implementation of mining license should be resolved through arbitration in domestic courts and in accordance with the provisions of the legislation. In this paper the author argues that choosing arbitration as a dispute resolution mechanism is more proper than choosing court litigation. That is because arbitration has several advantages such as faster dispute resolution process, the “win-win” nature, as well as the guarantee of confidentiality from public scrutiny. Based on these advantages, arbitration is considered more appropriate to be applied in gold mining contract disputes in Indonesia.

AbstrakArtikel ini berargumen bahwa kriminalisasi dalam Pasal 2 ayat (1) dan Pasal 3 UU Tipikor adalah praktik kriminalisasi berlebih. Praktik kriminalisasi berlebih pada hakikatnya adalah keputusan menetapkan suatu tindakan sebagai tindak pidana dalam undang-undang tanpa didukung oleh alasan yang memadai. Dalam kontrak dengan pemerintah, perlindungan terhadap keuangan negara sudah memadai sehingga tindakan merugikan keuangan negara tidak perlu dikriminalisasi atau dipidana berdasarkan Pasal 2 ayat (1) dan Pasal 3 UU Tipikor.AbstractThis article argues that the criminalization stipulated in Articles 2(1) and 3 of the Indonesian Anti-Corruption Act is overcriminalization. Overcriminalization is, in essence, the decision to criminalize certain behaviour without being supported by adequate reasons. In government contracts, the protection over State budget has been properly established, therefore any State budget loss should not necessarily be criminalized according to Articles 2 (1) and 3 of the Indonesian Anti-Corruption Act.

Abstract

AbstrakTulisan ini mengkritisi kriminalisasi oleh legislator ditinjau dari perspektif Teori Hukum Pidana. Keputusan legislator untuk mengkriminalkan suatu tindakan melalui undangundang perlu dibatasi karena sangat mempengaruhi kebebasan individu. Di negara berdasarkan pada asas the Rule of Law (negara hukum), pembatasan kekuasaan legislator bersifat niscaya. Khusus terkait dengan keputusan legislator dalam melakukankriminalisasi, bentuk pembatasan tersebut dapat dilakukan salah satunya dengan jalan membedakan antara kriminalisasi yang legitimate dengan kriminalisasi yang tidak legitimate. Melakukan pembedaan tersebut merupakan salah satu bidang kajian dari Teori Hukum Pidana dengan tujuan supaya undang-undang pidana yang dihasilkan dalam proses kriminalisasi mengandung kebenaran.                                                                                                                                                                                                AbstractThis article tries to criticize the legistature’s decision to criminalize from the Criminal Law Theory perspective. The legislatures decision to criminalize needs to be limited because it has great impacts over civil liberties. According to the Rule of Law principle, the limitation over legislative power is inescapable. Specifically related to the legislature’s decision to criminalize, the forms of limitation can be undertaken by differentiate between the legitimate criminalization and the illegitimate criminalization. Doing this differentiation is analytically one of the main concerns of the Criminal Law Theory in order to satisfy that the criminal law resulted from the criminalization process is really needed.

Abstract

AbstrakSejak akhir Perang Dunia II, masyarakat internasional menyaksikan meningkatnya upaya serius untuk menanggulangi kejahatan internasional. Selain pengadilan pidana nasional dan mahkamah internasional murni, forum yang baru-baru ini digunakan untuk menangani kejahatan internasional adalah pengadilan hibrida yang telah dibentuk di beberapa negara seperti Kamboja, Sierra Leone dan Timor-Leste. Pengadilan hibrida tersebut dibentuk dengan latar belakang politik berbeda-beda, tetapi sebagai institusi yuridis, pembentukannya seyogianya didasarkan pada instrumen yuridis. Artikel ini mengidentifikasi ada tiga pola dalam pembentukan pengadilan hibrida, yaitu: pembentukan pengadilan hibrida atas dasar perjanjian antara PBB dan negara terkait, pembentukan pengadilan hibrida oleh PBB atau pemerintahan internasional dan pembentukan pengadilan hibrida oleh suatu negara yang kemudian memperoleh dukungan masyarakat internasional.AbstractSince the end of World War II, the international community witnessed the increasingly serious efforts to deal with the international crimes. Besides the domestic criminal courts and purely international tribunals, the forum that is also recently used to handle international crimes is the hybrid courts that have been established in several places such as in Cambodia, Sierra Leone and Timor-Leste. Hybrid courts are established from different political backgrounds, but as a legal institution, its establishment was necessarily based on legal instruments. This paper identifies that there are three patterns in the formation of hybrid court, which are: the establishment of a hybrid court based on an agreement between the UN and the relevant state, the establishment of a hybrid court by the UN or international administration and the establishment of a hybrid court by a country which later gains greater international support.
