Jurnal Al-Fikra diterbitkan oleh Program Pascasarjana Universitas Islam Negeri Sultan Syarif Kasim Riau. Jurnal Al-Fikra menerima manuskrip atau artikel dalam bidang ilmiah keislaman dari berbagai kalangan akademisi dan peneliti baik nasional maupun internasional.

Abstract

When Andalucia was as center of Umayyad Dynasty in Europe, school of Malik ibn Anas became the formal school of state, and at the time, Ibn Hazm opposed such state school legalization and called to refer to the Quran and Sunnah. The commitment of Ibn Hazm to return religious problem, especially Islamic law, to text of the Quran and Sunnah and also because of his relation with Abu Daud al-Asfahani made his school be known as school of literalism. The rational dimension in Islamic law epistemology of Ibn Hazm can be met in deconstructive and reconstructive aspect of his criticism discourse toward epistemology of all existing schools at that time. Thus, it can be known that Ibn Hazm literalism is based on critical dimension and not on textual literalism. The most striking rational aspect in the Islamic law epistemology of Ibn Hazm can be seen in the concept of argument (al-dalil).

Abstract

There are different opinions about implementation and codification of Islamic Law in Malay country. This difference is because of dissimilar perceptions about the Islamic law itself as norms and legal. The presence of Islam in Nusantara was entailed by implementation of legal rules that it came with. Such statement may be proved based on historical proofs like written stone in Trengganu dating in 1303 A.D./702 H., Malaccas Constitutions, Minangkabaus Law, and Ulamas works on Islamic jurisprudence

Abstract

There is an inclination that the conscience of the Muslims more and more increase to apply their religious teachings for attaining spiritual and material needs. The conscience of studying Islamic teachings for implementation cannot be apart from the role of Islamic dakwah institutions. It cannot be denied that Islamic law is an un-separated sub-system of national legal system. It can be proved by institutionalization of Islamic law even though only in terms of family law, bequest, and donated property, and moreover the alms and pilgrimage institutions are recently founded. These legal products may be main indicator that prospect of Islamic law institutionalization including hisbah in Indonesia will be better, brighter, and more increasing in the future.

Abstract

Profession ethics in a professional vocation that is something demanded is not only containing moral rules for members and organizers of the certain profession, but also as tools for the wide community to understand and evaluate moral quality of such profession. Furthermore, the most important further is ability to think reflectively-ethics on ethical codes of their profession. Through such of thinking, they will be able to think philosophically-jurisprudence, diligent, and inclusive by reference to religious norms, law, and social setting that can yield moral-ethical behavior and moral wises.

Abstract

Tariqat Ni`matullahiyah was founded by Shah Nimat Allah Wali and had spread across world parts of Asia, Europe, America, and Africa. London is the center of this Tariqa in the West, but it seems that it does not unfold its wings in Southeast Asia yet i.e. in Malay world especially in Indonesia despite of Shiite teachings influenced the culture of its community. Tariqat Ni`matullahiyah refused fatalistic, static, excessive, alienation paradigm of tariqat and suluk. Nevertheless, the adherents of this tariqat strives to free themselves from any bunches and attentions both of physically and spiritually as facilities for attaining the more gracious and eternal objective.
