Abstract

Zakariya al-Anshari was the mujaddid (reformer) in the 10th century Hijra, that was very popular with the studies in the field of fiqh (jurisprudence). One of his worls in this field is a book entitled Fath al-Wahhab bi Syarh Manhaj al-Thullab. Throughout his life, he devoted himself to scholarly activity. In his work, he describes in detail about the laws of fiqh, ranging from thaharah (purification) problems until the problems of qadha (justice), which is the study using a systematic and comprehensive approach to jurisprudence. Zakariya al-Anshari’s book of fiqh are needed by all levels of society; whether scholars for the purpose of writing books, the government in making regulations and legislation, as well as the boarding schools community in curriculum lessons

Abstract

Dynamic shufism developts positive thinking and realistic behavior about of paradigm of the material, spiritual  and moral. Shufis  are convinced anticorruption. Corruption in Indonesia especially has been in a virus, savage cancer and serious condition and its dangers are out of ordering state and civil society life in the fields of politics (money politics), economy (legalling all ways obtain money and wealth) and law (manipulation of facts). Problem solving these fenomena, anticorruption movements have been done every where, either by an individual, the state or social organization, however, its result is not yet satisfactory. One of the effective methods (thariqah) according to dynamic shufism perspective to solve corruption (fasad or risywah  in al-Qur`an and tradition term),  collusion and nepotism stressing  corruption is a polytheism (syirik). It is a pity, corruption is not yet awared or realized of one of polytheistic existence. In a polytheistic context  necessary is interpreted by perspective of dynamic shufism. Polytheism (syirik) indicate a long time   public and envirement corruption and humankind suffering. Corrupters must be heavily punished and psychotherapy in order to be cured of a psychological disease and moral hazard or immoral.

Abstract

Along with the times, methods and style of interpretation (tafsir) was also developed. A book of commentary, Ahkam al-Qur’an, written by Al-Jashshash is one of the books devoted to the legal texts, according to categories defined by Al-Jashshash himself (Jurisprudential/Fiqhy style). In interpreting the legal verses, Al-Jashshash was combining interpretation hues; bi al-ma’tsur and bi al-ra’yi. The methods that used were: firstly, proposed subsection shall be construed; secondly, provide an explanation of meaning and etymology, confirmed by another verses of the Holy Quran, Hadith, and opinions of the Prophet’s Companions; thirdly, to include jurisprudential issues that may be understood from the verse that interpreted; fourthly, expressed opinion among scholars and arguments that they used; and fifth, to analyze opinions of scholars that put forward, and determine his own opinion.

Abstract

Inter-religion clashes until the worship’s places bombing tragedy in the name of jihad is still a blurry portrait in Indonesia. The latter has a great impact, and in recent years resulting in the loss of many human lives. Religion does have a tremendous influence against its adherents. The militant and extreme followers would do anything to defend their faith. Sincerity, for the sake of God (lillahi ta’ala), daredevil, are their package language of understanding their beliefs. Basically, Islam gives justification for such an extreme position. On the other hand, Islam also teaches believers to always be open (inclusive) and be respectful to diversity (plurality). This paper leads us to the three doctrines that are implicitly mentioned in the Holy Quran. Therefore, a person’s ability of understanding and reinterpreting those doctrines becomes very important

Abstract

Issue about human organ donation and transplantation cause problems, as can be seen from various aspects, i.e. aspects of worship, muamalah and jinayah. Many questions surrounding this issue are waiting for answers from the view of Islamic law.  It is obviously known that the transplantation of human organs and tissue is a useful medical treatment for patients with impaired organ function. This way is the best alternative therapies to help patients with organ failure or dysfunction, because the results are more satisfactory. In general, legitimacy of transplants and organ donation refers to the goals of human creation, namely to be caliph in the world (khalifah fi al-ardh). It is technically analyzed with ta’lili and istishlahi reasoning. In ta’liliyah, permissibility of human organ transplantation and donation has been analogous to the possibility to give forgiveness and take diyat in qisas cases. In istishlahiyah, it is assessed based on the concept of mashlahah, namely something returned to the upholding of human life in absolute. The human need against transplantation seems irresistible. Therefore, which opinion that would be used is up to the human needs with the consideration of mashlahah

Abstract

The Islamic state aspired by some people in Indonesia is a reflection of yearning to the concept of state that has ever implemented by the prophet Muhammad PBUH. They try to fight for the glory through the famous movement in the history namely DI/TII. The movement was stopped, and then rose again when the faucet of broadest democracy is opened during the Habibie government. However, because the concept of state is not detailed in the Holy Quran, and there is historical evidence that in establishing the state of Medina, the Prophet used The Charter of Medina as a form of social contract among Muslims, Christians and Jews. It proves that the establishment of the Islamic state is truly similar to the process of state formation in another concepts, namely through social contract. Thus, the Islamic state is not actually lies on the formality, but the substance of Islamic values, such as the value of unity (tauhid), justice, and the protection of people’s interests

Abstract

The emergence of the economic system shariah  as a solution to the welfare of humanity and justice lately has given hope for a better economic life. But, in fact the implementation of shariah economy is far from its` philosophical concept. So, it is nessecary to do the redefinition of Islamic economics which not separated from the value or human behavior. Identification of the Islamic economic jurisprudence (fiqh muamalah) can not be separated from the context of the shift in thinking of contemporary scholars of Islamic law jurisprudence. Various criticisms of both content and methodology of fiqh epistemologies had actually begun since the death of the Prophet Muhammad.  One of reasons for implementation of Islamic law in the economic realm is to explore the philosophical framework to build a scientific fundamentalist Islamic economics. There are three basic philosophical framework of Islamic economic. First of all, economic growth based on non ribawiy system, second one, economic distribution system based on Islamic philanthropy (Zakat, infaq, Sadaqah and other endowments), and the third as well as shariah trading systems based on halal and thoyyiba products. Philosophical framework of this system of growth in the application of non ribawy covers financial institutions as a central instrument of economic growth system. In the aspect of distribution, the Islamic economic stresses on the principle that the property is a mandate from Allah SWT. This obligation is a form of spending  treasure in the way of Allah SWT. In the aspect of consumption, the basic philosophy of Islamic economics emphasis on systems that are lawful in both aspects of commodity trading and transaction model used. With the collapse of welfare capitalism that is fair, then it becomes a necessity for mankind to deconstruct and reconstruct the economy of capitalism and economic justice berketuhanan called Islamic economy.
