Kafa`ah: Journal of Gender Studies
Kafa’ah (Print ISSN 2356-0894 Online ISSN 2356-0630)is an open-access and peer reviewed journal published by Center for Gender and Child Studies, State Institute of Islamic Studies (IAIN) Imam Bonjol Padang. This journal covers key issues on gender studies, including: place of women in society, empowering women, and government policies on women empowerment. The objective of the journal is to promote the sharing of knowledge and understanding on the gender issues. It then welcomes contributions from experts, researchers, practitioners, and policy makers around the world. This journal is published twice a year.

Abstract

Minangkabau women is a part of culture who has significant role in rumah gadang. In Minangkabau, a woman also called bundo kanduang. The next generation of culture was born through her.The honor to Minangkabau woman is related to her standing and her function ini daily life. She attempt to be cared with the environment. It starts with educate the children with religious and cultural teachings. So that, they could be the next generation who know the rights and obligations as Minangkabau society. Educating children is not only when they are physically born in this world, but it can be started when they are in the mother’s womb. Therefore, the ancestors have myths that related with pregnancy. It contains the element of goodness that radiated from the myth’s cultural value. In relation to gender, pregnancy’s myth in Minangkabau also addressed to men. This is related to results and findings from the pregnancy’s myth. Cultural value in pregnancy’s myth have a power to organize the behavior of human. In the other words, the values in it can apply to all layers of society. So that, this research is qualitative research. Abstract

This article focuses on unregistered marriage among Samin community and its disadvantages to women and children. Using qualitative method, this paper tries to answer the question on how the practice of marriage among Samin community is and what are legal consequences of their marriage. Data were collected through observation and FGD. Since the marriage is not registered, it is not legally acknowledged by the government and Samin people do not have marriage certificate. Consequently, husband’s name is not mentioned in the family registration card and in child’s birth certificate since the children are considered as born out of wedlock. However, after the Constitutional Court’s Decision on judicial review of Administrative Law, believers of faith (penghayat kepercayaan) are allowed to state so in their national identity card. Thus, Samin people try to use this opportunity to declare their religious identity and to have their marriage registered.

Abstract

Freedom of speech is seen as the basic right of everyone. Any attempt to restrict the right to speak freely always finds resistance. Nevertheless, the state persistently strives for the freedom of speech not to harm another person or group of people by regulating freedom of speech in the legislation. But sometimes this rule does not always keep and control people talking, so the conversation is detrimental to certain anyone or any parties. Moreover, freedom of speech is supported by various sophisticated media such as online media. News enthusiasts are presented with a variety of information that interests many people, especially people with certain positions and capacities such as political positions and entertainer. Usually, women has become one of the hot topics that come to news. A news may take more attention if the media presents the bad side of uncollated action of a woman. Hot issues on women in which online media mostly post are on love affair, adultery and other wrong-doings. The phrases are scattered in online media openly and can be accessed in just a few seconds. On the other hand, the actors are generally Muslim and Islam teaches them to evaluate their statement that may end at defamation. When the media activist blows up the uncertain news, for example on an adultery accusation, but he is unable to present at least four witnesses who witnessed the adultery (related to Islamic law), the media activists could be trapped in alleged adultery (hadd al-qadzf).

Abstract

This paper aims to describe the habitat and agency of Indonesian Labor Women (TKW). The method used is text analysis using Bourdieus perspective habitus. There are three selected texts on the consideration of the TKW theme and the different destination countries. Women migrant workers are women who strive and struggle to improve their standard of living. Habitus of TKW is low education, low skill, and poverty. There are three levels of an agency that women do. First, women break away from the shackles of poverty. Second, after becoming a female migrant worker, women break away from their employers. Third, women write the text. The TKW text contains the experience of women being TKW which aims to open reader and community awareness. TKW text is a narrative of Indonesian womens fortitude and fortitude in fighting for life and family life to be more prosperous and happy

Abstract

Local wisdom is recognized as a vital social capital in empowering society. This has showed by the achievement of KWT Dewi Sri in enlarging it’s public role through adaptive strategies. In a pluralistic society, with a poor of socio-economical condition after the earthquake, certainly it was a difficult for the women to empower theirselves, their families, and their society. But such unlucky conditions have been managed successfully by KWT Dewi, even they  have stepped forward like the incarnation of Dewi Sri(Sri godless)  that in Javanese mythology being convinced as a source of prosperity for farming of villagers, and gradually have succeeded in refuting a view of feminization of poverty.

Abstract

In Minangkabau community, ulayat land known as heritage is a land dominated by ninik mamak and ownership by women, actually  ulayat always dominated by ninik mamak. This study aims to describe the challenge  in the womens struggle against ulayat land by men in the Gunung Sarik Distrik, Padang. The qualitatif methode was done by using in-depth interview and focus group discussion with informant taken by purposive sampling. Women who are members of Gunung Sarik Saiyo Cooperative meet the obstacles in the struggle that is the first, the social system that is not supported. Second, get challenges from other people in community. Thirdly, the streotype of society is not good for women who often do activities outside the home in Gunung Sarik Village.

Abstract

This article aimed at investigating Wijjoo, an indigenous socio economic and political institution of Oromo women. Qualitative research methodology was employed in both data collection and analysis. Accordingly, data was collected through interview and focus group discussions from actual social context in 2014. This study has shown that Wijjoo is an exclusive assembly of Oromo women on which social, economic and political problems are discussed. Any injustice action against women is presented and further measures against such bigotry planned on its gathering. Butter which is considered as women property of women in Oromo culture also collected on Wijjoo meeting. The collected butter used by women’s for different purposes like household consumption, for marriage ceremony and other cultural rituals. Passing through different steps, Wijjoo gathering is concluded by smearing butter as a symbol of wetness, fertility and prosperity of human beings and cattle.Overall, the study concluded that Wijjoo plays a prominent role in ensuring the empowerment and autonomy of Oromo women as well as in nurturing their political, social and economic status. Therefore, recognizing and using this indigenous institution is vital in future policy formulation in the country for the fact that gender issues are central to the realization of sustainable development

Abstract

This article discusses how criminal act of human trafficking is handled related to global perspective and Islamic perspective. This is a case in South Sumatera. There are some forms of human trafficking and this crime should come to serious responses because it deals with human right. This research applies a conceptual approach, statute approach, philosophical approach, and sociology approach to law. The human trafficking, in this case, exploited the victims into underpaid workers, baggers, immigrant workers, housemaid and many more. This practice keeps in progress because of the low education level of the victims, strong economic reason, domestic violence, and other violence. The government of South Sumatera responses to this by establishing a special team against human trafficking which involves government institutions, NGOs and mass media. The legal act from the government of South Sumatera has been doing but it still has the burden for law enforcement

Abstract

Theoretically and empirically, the presence of women in politics is believed to reduce corruption behaviour. Unfortunately, in Indonesia, such essential categorization is not proven to reduce corrupt behavior considering that women can also be an executor, connoisseur, and even intermediaries of corrupt behavior. Women, as one category of sex, is not sufficient to analyze the role of women in corruption act, because woman is bounded by culture, religion, ethnicity and social class. Based on this background, this study attempts to find the root of the problem and the solution for woman politician in corruption act. By using electoral system theory and political party as theoretical analysis and literature study as the method, this study identifies that behavior of women corruptor cannot be separated from the power of elites in political parties and parliaments. The strong power of the oligarchic elite in political parties and parliaments itself is the result of an open proportional election system which has an impact on the high competitiveness of parties, so that led to high cost of political to be beared by women. Ultimately, to improve such conditions, the engineering of electoral and party systems is most likely to be a solution, as both are easy to intervene by state actors and civil society groups. In conclusion, this paper shows that political parties have to be responsible in promoting gender equality, and willing to review the quota and zipper system in relation to the proportional systems
