Abstract

Thepurpose ofthis research is analyzing the effectiveness ofnational minister regulation number84 of2008 on gender mainstreaming in education and identifying the factors causing the effectiveness of regulation. Thisresearch located in Kebumen Regency. The type of this research is policy evaluation research.This research used qualitative descriptive approach. Data sources were informants,places and events, and documents. Data collecting technique performs by literature study and focus group discussion. The informants wereselectedreferto itspurpose. Datavalidation basedon triangulation and itsanalyzed usinginteractive analysis model. Theresult of this research indicates: 1) nationaleducation ministerregulationnumber84 of2008 iseffective promote on gender equalityand equity in education, 2) the factors influence the effectiveness of regulation including: political will, theeffectiveroleongenderworkinggroupandgender localpoint, gender sensitive human resources, gender based information system, the availability of gender analysis instrument, gender responsive budget, technicalassistance from thegovernmentat provinciallevel, and com munitysupport.

Abstract

Thisresearch is conducted toassess the implementation of international marriagerecords inIndone sia, barriers andsolutions, and theconsequences ofinternational lawifthemarriage is notrecorded. This research located in Surakarta. Thecharacteristic of this research is descriptive empirical. Thedata mainly used primary data, and also supportedbysecondarydata. Sample determination techniques use random methodandpurposive sample. Collecting data performs byinterviewandliterature study, andobtaining data areanalyzed using interactivequalitativeanalysis techniques.Theresults show that the requirements of international marriage recorded are marriage certificate, identity card for WNI, andpassport for WNA (foreign citizen). The obstacles onmarriage is often encoun teredandis notcomplete yet to attain marriage certificate ifthe representative state ofthe wedding orRlstate has notgiven the certificate, the delay of wedding recorded orreported, he difference name on residencydocuments, the internationalmarriage couple has different religion, and for internationalmaniage which isperformed in Indonesia, sometimes (these couples) can not speak Indonesian fluently. For this matter, the solution is completing all the requirements by theapplicant. The imposition offines for late recorded or reported ofthe wedding, used last document to fulfill the biodata ofthe applicant, submitted the petition ofcourt decision as legal foundation to registration office related to different religion on marriage and usedinternational language or translatoron marriage recorded implementation. The implication ofthis study indicates thai there are legal issues on public scrutiny byentry into force to the Population Administration Act which is said the status ofmarriage institution is religious ornon-religious institution, legal indicator on marriage isdeterminedby the religion norm orstate, andless detail on reporting ofinternationalmarriage which isconductedby foreign countryafter the couple returned to Indonesia.

Abstract

Studying the contentmaterial in "The Comparison ofthe AmendmentofRepublic ofIndonesias 1945 Constitution and theProposalof Constitution Commission", there is included thearticle supplement inthe proposal of Constitution Commission; they are: articles 24D, 24E, 24F, and24G. It indicates that the Constitution shouldbe made  morecompletelyandperfectly. Particularly, theprovision of article 24Fis an article abouttheLegalPolitics explaining that thestatearrangesanddevelopsthenationallegalsystemby maintaining andrespecting the variability oflegalvalues andlegalsources living within thesociety. The legalpolitics (rechtpolitiek) according toPadmo Wahjono inhisbookentitled Indonesia Negara Berdasarkan atas Hukum, is:  1)fundamentalpolicy; 2) lawdirection, form, andcontent; and3) thatwillbe formed. The national legalsystem consistofa number ofelements orcomponents, some of them currently exists and functions, but some other stillneed to be created. Theamendmentof 1945Constitution (Firstly 1999, Secondly2000, Thirdly2001, andFourthly2002) does notregulate about  thelegalpolitics. The proposal ofConstitution Commission, that is toinclude the provision ofarticle 24Finto the constitution, because oflegalpolitics vacuum within 1945 Constitution.

Abstract

This research ispurposedtoobtain a learningmodelthatproducestheintegration betweenacademic worldandlegalpractice inrealworld that feels limp frequently. Abstract

The purposeof this research is tofind outtheconstraint andthearrangement of theempowerment model of womenrole inDPRDinproducing thegender responsive regionsregulation.As a gender perspective research, this research used sociological/empirical approach using nonpositivistic approach. Thecharacteristic is developmental descriptive. This researchlocatedinSurakarta andKaranganyar (province ofcentralJava), Madiun andNgawi(province ofeastJava). This researchused primary data and secondarydata. The instruments of data collector are literature study, interview, and questionnaire. Sharpeningandformulating model which is conductedbyfocus group discussion (FGD) by involving the stakeholders. Thetechnique of qualitative dataanalysisbased in theoretical intepretation, and the generalization is taken as idealabbreviation (iusconstitutum). Theresult of thisresearch can be concludedthatresponsive regionsregulationsare stillblocked with some internal barriers, i.e. 1) limitednumberof womenidDPRD; 2) unexistence regulation thatregulates womeninvolvementin discusing of regionregulation containinggender matters; 3) limitedcomprehension and capability concernon legal drafting andgender; 4) the women ofDPRDmembersonlyentrancethe commission of welfare society. External barriers are: 1) thestrength of patriarchy culture; 2) unexistence regions regulationon genderpriority. Theemployment model of women politician roleinDPRD as efforts toproducegender responsive regions regulations contains: 1)theenhancementofgendersensitivityandabilityonlegaldrafting referto Act Number 10 of 2004 concerning the establishment of legislation regulation; 2) the arrangement of fraction across women alliance/commission; 3) the revision of DPRD regulation which is possibly the involvement ofAPLF/Kon the third level discussion on genderresponsive regions regulationprogram.

During Soehartos regime, theconceptofconstitutional statehadbeen shifted totheconceptoflaw state. That condition caused manycrimes which werebelieveddone by the government (crime by the government). Unfortunately, thosecriminalactscanneverberevealed untilnowsince there wasa certain law that created by the government in chargeat that time. That law, in fact, not only supported all thegovernments decisions used torule thecountry, but alsoguaranteed that there wasa suitability between the decisions and the law itself.

Abstract

The result of this research on handling of credit distraction as criminal riskon government bank,consists of: first, theprocess of credit is observedby internal supervisor unit (SPI), Bank of Indonesia (Bl) as central bank, andSupervisorBody ofFinancial (BPK). Second, thedimension courseofcredithas beendonerefer toguidance book, procedureandoperationalstandard, itscanalso bejustifiedadministra tivelyalthough there is loss consequence/hence that represented business risk. Third, ifcredit distraction is caused by criminal, the bankofficer is only processed based on administrative sanction. The main problem inhandling credit distraction as criminal risk ongovernment bankcontains:first, theoverlapping in handling creditdistraction; second, the difference of intepretation and incoherent rulebetween credit distraction thathappened because business riskand criminal risk, and third, the excistence ofconvptionelement.
