Abstract

ABSTRACT This study aims to determine (1) the factors of abandonment of The Land Cultivation Rights, (2) the role of the National Land Agency (BPN) on the implementation of the authority and mechanism for handling the abandoned lands, and (3) the communication effort (negotiation)conducted by BPN in the handling of abandoned lands. This research was conducted at the Regional Office of the Provincial National Land Agency South Sulawesi and Enrekang. The method performed was qualitative descriptive approach.The informantswere determined by the use of purposive sampling technique. The data have been obtained through observation, in-depth interviews,and documentation as well. The results showed that the the factors of abandonment of The Land Cultivation Rightsare consisting oftechnical factors, business management and socio-economic factors.  Then the role of the National Land Agency (BPN) on the implementation of the authority and mechanism for handling the abandoned lands were preparing all forms of data and facts eitherresearch based or document based.  The communication (negotiation) efforts by BPN in the handling of abandoned lands have been conducted to public tenants by the direct dialogueor personal approachfor deliberation, group and formal/bureaucracy approach through socialization and involvement of the community leaders and authorities. The communication effort (negotiation) conducted by BPN in the handling of abandoned lands has been in the form of coordination in order to achieve public common goals: the common perception and common pattern-making on economic resource benefits. Keywords: Communication effort (negotiation), The Land Cultivation Rights (HGU), abandoned land ABSTRAK Penelitian ini bertujuan untuk mengetahui (1) faktor-faktor terjadinya penelantaran tanah-tanah Hak Guna Usaha (HGU), (2) peranan Badan Pertanahan Nasional (BPN) dalam pelaksanaan kewenangan dan mekanisme penanganan tanah-tanah terlantar, dan (3) upaya komunikasi (negosiasi) oleh BPN dalam penanganan tanah-tanah terlantar. Penelitian ini dilaksanakan di Kantor Wilayah Badan Pertanahan Nasional Provinsi Sulawesi Selatan dan Kabupaten Enrekang. Metode yang dilakukan dalam penelitian adalah pendekatan deskriptif kualitatif dengan penentuan narasumber atau informan dilakukan secara sengaja (purposive). Pengumpulan data diperoleh melalui pengamatan, wawancara mendalam, dan dokumentasi. Hasil penelitian menunjukkan bahwa faktor-faktor terjadinya penelantaran tanah Hak Guna Usaha (HGU) terdiri atas : faktor teknis manajemen usaha dan faktor sosial ekonomi. Kemudian peranan BPN dalam pelaksanaan kewenangan dan mekanisme penanganan tanah terlantar sebagai lembaga berwenang yang menyiapkan segala bentuk data dan fakta baik yang ditemukan berdasarkan hasil kajian lapangan maupun dokumen-dokumen penting yang dibutuhkan dalam rangka melakukan penanganan tanah-tanah terlantar melalui mekanisme yang berlaku.  Adapun upaya komunikasi (negosiasi) dalam penanganan tanah terlantar yaitu komunikasi (negosiasi) dengan masyarakat penggarap dengan melakukan dialog secara langsung untuk musyawarah mufakat dengan melakukan pendekatan pribadi, pendekatan kelompok dan pendekatan formal/birokrasi melalui sosialisasi dan pelibatan tokoh masyarakat maupun aparat desa.  Selanjutnya upaya komunikasi (negosiasi) dengan instansi/pihak-pihak terkait dengan melakukan koordinasi  dalam rangka mencapai tujuan bersama untuk kepentingan publik sehingga terjadi kesamaan persepsi dan pola pengambilan manfaat ekonomi atas sumberdaya ekonomi di areal HGU.

Abstract

This article reviews the essence of law enforcement as social change instrument. Law in the context of Indonesia that embrace democratic system is upholding the justice values in it that fairness principles for all Indonesian people. As positive law in a legal state, law enforcement is required to be professional, proportional, good, fair, and wisely so in accordance with the rules of expediency, kindness and equality in the law itself. The outcomes of the research indicate that law and community cannot be separated, for law the community is a resource that gives life (to nature) and move the law. The communities live the law with the values, ideas, concepts. And also contribute the community to implement the law.

Abstract

Small-scale land acquisition is an activity of providing land by giving fair and fair compensation to the entitled parties. The land area for small-scale land is not more than 5 hectares. This study aims to identify and analyze the implementation of small-scale land acquisition by using the stages of determining the location and analyzing and finding legal implications for land acquisition by using location determining stages. This type of research is an empirical law study in which research serves to see the law in a real sense and examines how the workings of the law in the environment. Data are analyzed qualitatively that is decomposition, depiction, and explanation of certain circumstances, processes or events. The results of the study indicate that the implementation of small-scale land acquisition by using location determination in East Java is through 4 (four) stages of planning, preparation, implementation, delivery of results based on the Decree of Governor of East Java. The decree is inconsistent with the provisions of Article 121 paragraph (3) of Presidential Decree Number 148 of 2015. The legal implications of this investigation are not null and void, but it can only be revoked if a party sues them.
