Abstract

International legal instruments governing trade relations between countries is contained in documents the GATT (General Agreement on Tariffs and Trade) countries signed in 1947, and entered into force since 1948.From time to time the provisions of GATT negotiations enhanced through a range of rotation, the last through the Uruguay Round negotiations that succeeded in forming an organization of world trade (World Trade Organization / WTO). International economic organizations in addition to the WTO there are also regional organizations, namely the ASEAN-China Free Trade Agreement (ACFTA). ACFTA Agreement is a trade agreement between ASEAN countries on the State of China. ACFTA has been effectively running in January 2010. The legal basis of the ACFTA is the Framework Agreement on Comprehensive Economic Cooperation Between the Association of Southeast Asian Nations and the People’s Republic of China, which was signed by the President of the Republic of Indonesia (Megawati) on December 4 Novenber 2002 in Phnom Penh, Cambodia, and has been ratified by the President Republic of Indonesia through the Decree of the President of the Republic of Indonesia Number 48 Year 2004 on Ratification of the Framework Agreement on Comprehensive Economic Cooperation Between the Association of Southeast Asian Nations and the People’s Republic of China (Framework Agreement). The implementation of ACFTA in 2010 marked the entry of Chinese goods are flooding the Indonesian region, including the city of Pekanbaru greatly affect domestic goods produced by Micro, Small and Medium Enterprises (SMEs) Pekanbaru. The influx of goods from China makes more and more choice for the consumer goods Indonesian. The prices of goods from China are relatively inexpensive and varied lead Indonesian consumers prefer and buy goods from China. This resulted in a decline in the goods manufactured by Micro, Small and Medium Enterprises (SMEs). Keywords: International Trade, ACFTA Agreement, Micro, Small and Medium Enterprises

Abstract

As an independent sovereign nation Indonesia has been actively involved in international relations and entered into international agreements with other countries, both bilateral and multilateral. Along with the developments that occur not only countries that can enter into international agreements but local governments have the authority in entering into international agreements with foreign parties. The method used in this research is normative law research. This study uses the legislation approach. The result of the research shows that Law Number 24 Year 2000 gives the regional authority to make international agreement, as regulated in Article 5. In addition, the regional authority in making international agreement is regulated in Law Number 12 Year 2008 regarding Regional Government. Mechanism of making international agreement by region, local government in this case that is Governor, Regent, or Mayor first ask opinion and consideration to DPRD to plan international agreement making. Keywords: Regional Authority, International Agreement   Sebagai negara merdeka yang berdaulat Indonesia telah aktif berperan dalam pergaulan hubungan internasional dan mengadakan perjanjian-perjanjian Internasional dengan negara-negara lain, baik yang bersifat bilateral maupun multilateral. Seiring perkembangan yang terjadi bukan hanya negara saja yang dapat mengadakan perjanjian internasional namun pemerintah daerah mempunyai kewenangan dalam mengadakan perjanjian internasional dengan pihak luar negeri. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Penelitian ini menggunakan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 24 Tahun 2000 memberikan kewenangan kepada daerah untuk membuat perjanjian internasional, hal tersebut diatur dalam Pasal 5. Selain itu kewenangan daerah dalam membuat perjanjian internasional diatur dalam Undang-Undang Nomor 12 Tahun 2008 tentang Pemerintahan Daerah. Mekanisme pembuatan perjanjian internasional oleh daerah, pemerintah daerah dalam hal ini yaitu Gubernur, Bupati, atau Walikota terlebih dahulu meminta pendapat dan pertimbangan kepada DPRD terhadap rencana pembuatan perjanjian internasional. Abstract

Tujuan penelitian ini untuk menjelaskan perlindungan hukum terhadap kelangsungan UMKM atas pemberlakuan MEA dan pengaruh pemberlakuan MEA terhadap UMKM di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan. Berdasarkan hasil penelitian dapat dijelaskan perlindungan hukum terhadap kelangsungan UMKM atas pemberlakuan MEA diberikan dalam bentuk peraturan perundang-undangan. Terdapat tindakan-tindakan dalam upaya perlindungan hukum yang diperbolehkan diantaranya safeguard (pengamanan perdagangan), anti dumping dan standarisasi. Pengaruh positifnya  UMKM di Indonesia memiliki kesempatan untuk mengembangkan usahanya di negara-negara ASEAN lainnya, sedangkan pengaruh negatifnya UMKM di Indonesia sebagian besar belum siap untuk bersaing dengan UMKM dari negara-negara ASEAN lainnya karena faktor permodalan, teknologi, dan pemasaran. Kesimpulan penelitian  ini perlindungan hukum terhadap kelangsungan UMKM atas pemberlakuan MEA diberikan dalam bentuk peraturan perundang-undangan. Terdapat pengaruh positif dan negatif pemberlakuan MEA terhadap UMKM di Indonesia.

Abstract

The guidance and supervision of the Pekanbaru City Government on the label of packaged food products, especially home industry products, turned out to not work optimally. Although the government has conducted socialization, the socialization carried out has not been optimal. This is evidenced that there are still many business people who do not understand the label. In addition, supervision carried out by the government is also ineffective because there are still many packaged food products circulating that do not yet have a label that complies with the provisions of applicable legal regulations. The implementation of the regulation of labeling packaged food products as regulated in Law Number 18 of 2012 concerning Food and Government Regulation Number 69 of 1999 concerning Labels and Food Advertising in the City of Pekanbaru is still not running optimally. This is evidenced by the fact that there are still many business people who are not aware of the regulations governing labels on packaged food products, so that the implementation of the labeling regulations for food products has not been effective.

Abstract

Based on Article 11 of Riau Provincial Regulation Number 6 of 2012 it is stated that the corporate social responsibility work field can be carried out in the fields of education, health, infrastructure, sports and arts, social and religious culture, environmental preservation, populist economic enterprises, empowerment of indigenous peoples, and other fields of work that significantly impact on improving the quality of society. The problem in this research is how is the implementation of corporate social responsibility of PT Asia Forestama Raya towards improving the economy of the community based on Riau Provincial Regulation Number 6 of 2012? What are the obstacles in the implementation and how are the efforts to overcome these obstacles? The method used in this research is socio-legal research. The results of this research that PT Asia Forestama Raya did not implement corporate social responsibility to empower the economy of the community in the District of Rumbai Pesisir, Pekanbaru City. The obstacles in the implementation are from the company point of view, namely the financial condition of PT Asia Forestama Raya is currently in an unstable condition so that for three years there has not been implemented a community economic empowerment program, from the community point of view, namely the lack of community knowledge regarding Riau Provincial Regulation Number 6 Year 2012, while from the government side, there is still weak supervision of the implementation of corporate social responsibility of PT Asia Forestama Raya. Efforts to overcome these obstacles are based on Article 32 of Riau Provincial Regulation Number 6 of 2012 which states that if PT Asia Forestama Raya does not implement corporate social responsibility, then the company may be subject to administrative sanctions in the form of written warnings from the Pekanbaru City Government and restrictions on business activities, suspension of business licenses, up to revocation of business licenses.
