Abstract

Indonesia and Malaysia have a good potency for cooperation in aviation industry. It can be seen in the establishing two aviation companies namely PT. Indonesia Air Asia and Malindo which both are low-cost carrier. These aviation industries are categorized as low-cost carrier, however safety and security are absolute factors because these are rights for consumers. This article will describe further about safety and security standard; protecting the rights for consumers in connection with safety aviation in Indonesia and Malaysia from the Consumer Protection Law and the Aviation Law. As a result of the research shows that safety standard passenger for air transportation in airport covers information and safety facility in the shape of availability of the emergency safety tools (fires, accidents and natural disasters); information, area and health facility; and healthcare workers. Moreover, safety standards for passenger in an aircraft include information and safety facility in the shape of availability information and the emergency safety tools for passenger in an aircraft. The protection for consumer rights for safety flight in Indonesia as follows: aviation industry has obligation to fulfill minimum standard of safety and security; consumers must be safety from false information which raises concern; aircraft operation which endanger of the passenger; and consumer protection in operating the electronic device which endanger flight. On the other hand, the law of consumer rights in Malaysia relating to aviation are ruled under the Aviation Law as a result of the Warsaw Convention 1929. In conclusion, the verdict of consumer rights related to security aviation begins when the passenger enter to an aircraft, in the aircraft, and by the time they get off the plane.

Abstract

Human rights violation (HRV) occurs when a state including its organs commits HRV to individual within its jurisdiction. International Law has formulated a wide range of human rights law, especially the CEDAW which has been ratified through Law No. 7 of 1984. However, the law has not been applied properly. This article aims to examine HRV committed by a state which caused inability or unwilling to amend polygamy Law. Based on normative research, analysis to Article 2(f) of the Convention applies a viewpoint equality and state responsibility theories. Through this method, international conventions will be opposed to national provisions, Polygamy regulation. It is found that Indonesia through Polygamy regulation performs discrimination against woman’s rights. It can be stated that Marriage Law treats men and women unequal. It concludes that, as a state, Indonesia should responsible for HRV because the main problem of inequality is discrimination rooted from Polygamy regulation.Keywords: equality, human rights violation, non-discrimination, polygamy, state responsibility

Abstract

Air transportation is more interested in the various activities. As a flight service consumer, their rights are protected by law, both in the Law No. 1 of 2009 about Aviation and the Law No. 8 of 1999 about Consumer Protection. If passengers are at a lower position compared with airlines in the relationship between consumers and producer. Passengers tend to prefer to take no action if harmed by the airline. One of passenger rights of the most fundamental is the right to compensation effect using airline service as a carrier. When damaged by the airlines, passengers prefer to take no action event hough he has the rights to obtain compensation. This research analyzes about how the air carriers liability of damaged passengers and the concept of liability is applied in the Aviation Act. The data which is used in this research is secondary data and is supported by primary data and are distributed 100 questionnaires to domestic passengers which using purposive sampling. The purpose of this research to know whether the Aviation Act regulate expressly the air carrier liability for losses due to passengers using the airlines and analyze the concept of liability is used in theAviation Act. The results showed that the LawAviation is liable for the loss of passengers which is devided in 4 (four) articles, namely: the loss of passengers who died, permanent disability or injury; damaged or lost register baggage ; damaged or lost cabin baggage; and delaying in passengers, baggage and cargo carrier. There are 3 (three) concepts of legal liability in theAviation Act, they are; the concept of legal liability based on fault; concept of legal liability based on presumption (presumption of Liability); and the concept based on absolute liability. Recommendations of this research are creating immediately regulation of implementing the Aviation Act which related to compentation rights, need for increasing the empowerment of passengers to claim their rights, standard clause in the tickets, need repairing.

Abstract

Indonesia is a fertile place for traditional knowledge with more than 300 ethnical group inhabitants. Therefore, it is not surprising to know that Indonesia has the enormous potential of tradi-tional knowledge. However, Indonesia is still has some problems in legal framework to protect it. The research applies doctrinal research method. The problems that will be discussed in this article is what type of traditional knowledge documentation system that used in Indonesia and how it is performed in order to protect traditional knowledge. There are few goals from this research which are to find out about Indonesia's traditional knowledge documentation system and to compare it with other countries that also use documentation as the protection method. As a result, traditional knowledge documenta-tion system used in Indonesia is external registries which are done by parties outside the indigenous communities (Government, Academist, and NGO) and the information about traditional knowledge is placed in public domain. Even though it has not perfectly documented like India's Traditional Knowl-edge Digital Library, Indonesia has documented few of its traditional knowledge such as Songket pat-tern that belongs to South Sumatera. It could be summarized that traditional knowledge documenta-tion has a vital role as one of the most practical methods to perform traditional knowledge protection. In order to protect traditional knowledge, these documented activities need to be enhanced so it could give the financial benefit to indigenous communities as its owner.

Abstract

Penulisan artikel ini difokuskan pada Rapat Umum Pemegang Saham (RUPS) yang dapat dilaksanakan melalui video konferensi berdasarkan pasal 77 ayat (1) Undang-undang tentang Perseroan Terbatas. Dalam RUPS secara Video konferensi peserta rapat tidak hadir secara langsung berhadapan dengan peserta lain dan Notaris maka diperlukan adanya tanda tangan elektronik (e-signature) bagi para peserta rapat yang tidak hadir secara fisik di tempat penyelenggaraan rapat. Akta yang dibubuhi tanda tangan elektronik dapat dipersamakan dengan data elektronik atau informasi elektronik yang kedudukannya diakui sebagai alat bukti yang sah. Prosedur pelaksanaan pembuatan akta semacam ini bertentangan dengan pasal 16 ayat (1) huruf m UU tentang Jabatan Notaris bahwa notaris wajib membacakan akta di hadapan para penghadap dan saksi. Tujuan dari penelitian ini adalah: (1) Untuk menganalisis pengaturan tentang persyaratan Video konferensi dalam kaitannya dengan Cyber Notary  (2) Untuk menganalisis implementasi dari RUPS melalui video konferensi,  (3 )Untuk menganalisis serta memberikan saran terhadap peran dan tanggung jawab Notaris dalam Rapat Umum Pemegang Saham yang dilaksanakan melalui Video Konferensi Metode penelitian yang digunakan dalam penulisan tesis ini adalah penelitian normatif dengan menggunakan pendekatan perundang-undangan. sehingga dapat menemukan pemecahan permasalahan mengenai RUPS video konverensi.

Abstract

Tulisan ini mengkaji permasalahan/isu hukum mengenai status hukum harta bersama dan pembagian harta bersama kemudian peran notaris terhadap pembagian harta bersama karena perceraian. Jenis penelitian yang dilakukan menggunakan penelitian secara normatif, dengan menggunakan pendekatan perundang-undangan (statute Approach), pendekatan konseptual (Conceptual Approach) dan pendekatan kasus (Case Approach). Data penelitian yang digunakan adalah data sekunder berupa bahan hukum primer yaitu Kitab Undnag-Undang Hukum Perdata, Undang-Undang No 1 Tahun 1974 tentang Perkawinan, Peraturan Pemerintah Nomor 9 Tahun 1975 tentang Pelaksana Undang-Undang Perkawinan, Kompilasi Hukum Islam dan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris. Bahan hukum sekunder yaitu buku, jurnal ilmiah, dan artikel-artikel. Bahan hukum tersier yaitu kamus dan internet.Penarikan kesimpulan secara deduktif. Hasil penelitian dan kesimpulan yang diperoleh adalah adanya perbedaan atau tidak sejalan putusan hakim Nomor 618/Pdt.G/2012/ PA.BKT dengan pasal 97 Kompilasi hukum Islam mengenai pembagian harta bersama yang seharusnya dibagi separuh bagian duda dan separuh lagi bagian janda, tapi dalam putusan hakim pembagiannya menjadi 1/3 bagian duda dan 2/3 bagian janda. Kemudian peran notaris yaitu membuat akta kesepakatan dan pembagian harta bersama berdasarkan putusan.

Abstract

Hasil penelitian menunujukkan bahwa hubungan antara PT. Grab dan driver merupakan hubungan kemitraan. Isu hukum yang akan dibahas dalam tesis ini: 1) Apa legalitas dan konstruksi hukum (status, kedudukan, hak, dan kewajiban) para pihak PT. Grab dan Pengemudi taksi dalam perjanjian pengangkutan jalan berbasis online, 2) Apakah legalitas dan konstruksi hukum perjanjian pengangkutan jalan berbasis online telah memberikan perlindungan hukum terhadap pengemudi taksi berbasis online, 3) Bagaimanakah konsep perlindungan hukum terhadap pengemudi taksi dalam pelaksanaan perjanjian jalan berbasis online dimasa yang akan datang. Metode yang digunakan dalam penelitian ini adalah penelitian normative yang bertujuan untuk menghasilkan argumentasi, dan teori. Teknik analisis yang digunakan adalah metode deskriptif kualitatif yang bertujuan untuk memperoleh pengertian keterkaitan badan hukum dengan yang lainnya sehingga dasar hukum yang digunakan adalah Kitab undang – undang Hukum Perdata (KUH Perdata) dan pelaksanaan teknis operasional didasarkan atas Peraturan Menteri Perhubungan No. 108 Tahun 2017, pengaturan hukum belum memberikan perlinungan hukum terhadap driver karena aturan yang belum secara spesifik mengatur hubungan antara penyedia aplikasi seperti PT. Grab dan driver. Dan konsep perlindungan hukum terhadap pengemudi taksi dalam pelaksanaan perjanjian transaksi online diawali dengan pembentukan badan hukum yang menjadi para driver. Penulis berharap kiranya tesis ini dapat memberikan masukan bagi akademisi dan bagi usaha jasa pelayanan aplikasi berbasis online.
