Abstract

Abstrak           Dampak peristiwa ekonomi pada era reformasi adalah daya beli masyarakat yang semakin menurun dikarenakan naiknya harga kebutuhan pokok. Dunia usaha juga mengalami dampak buruknya, terkait dengan hal tersebut pemerintah mengupayakan agar para pelaku bisnis tetap dapat menjalankan usahanya dengan menyediakan dana pinjaman. Salah satu syarat untuk memperoleh pinjaman tersebut adalah harus memiliki jaminan, menurut pasal 1 ayat (4) Undang-Undang No. 42 tahun 1999 tentang Fidusia, benda tidak berupa bangunan diatas tanah hak sewa dapat dijadikan obyek fidusia. Termasuk didalamnya adalah bangunan diatas tanah hak pakai dapat dijadikan obyek fidusia berdasar  pasal 12 ayat (1b) Undang-Undang No. 16 Tahun 1985 Tentang rumah susun. Sehingga dipertanyakan tentang perlindungan hukum terhadap kreditur penerima fidusia jika debitur wanprestasi. Dan dapat diketahui bahwa berdasarkan pasal 12 ayat (1) dan pasal 13 Undang-Undang No. 16 Tahun 1985 Tentang Rumah Susun dan Pasal 15 ayat (2a) Undang-Undang No.4 Tahun 1992 Tentang Perumahan dan Pemukiman bangunan diatas tanah hak pakai dapat dijadikan obyek jaminan fidusia . Bangunan yang dapat dijadikan obyek jaminan fidusia adalah rumah susun yang dalam proses pembangunan. Rumah susun ini diterima sebagai obyek jaminan fidusia tanpa menjaminkan tanahnya. , karena rumah susun  tersebut memiliki sertifikat tersendiri. Apabila debitur wanprestasi berdasar pasal 15 ayat (2) Undang-Undang Fidusia kreditur penerima Fidusia memiliki hak untuk menjual benda yang menjadi obyek jaminan fidusia dengan cara parate eksekusi.  Kata kunci: perlindungan hukum, hak pakai, fidusia               Abstract           The impact of economic events in the reform era is that peoples purchasing power has declined due to rising prices of basic necessities. The corporate world is also experiencing these negative impacts, related to the government to strive for the business person can still run their business by providing loan funds. One of the conditions for obtaining such loans is need to have a guarantee, according to article 1, paragraph (4) of Law No. 42 of 1999 on Fiduciary, the object is not the form of the building above ground lease rights can be the object of a fiduciary. Included are building on land use rights can be the object of a fiduciary under Article 12 paragraph (1b) of Law No. 16 Year 1985 About the flats. So the question of legal protection against creditors of the fiduciary recipient if the debtor defaults. And it is known that pursuant to Article 12 paragraph (1) and article 13 of Law No. 16 1985 On Flats and Article 15 (2a) of Act 4 of 1992 on Housing and Residential buildings on the land use rights can be the object of fiduciary. The building that can be the object of fiduciary are flats in the development process. This apartment is accepted as an object of fiduciary without land offers. , Because the apartment has its own certificate. Abstract

Mengentaskan penduduk dari lingkaran kemiskinan diperlukan kebijaksanaan, organisasi, komitmen dan program, serta pendekatan yang tepat, maka diluncurkan program khusus penanggulangan kemiskinan dengan mendorong semangat keswadayaan dan kemandirian penduduk miskin yang produktif untuk bersama melepaskan diri dari kemiskinan. Dalam program khusus ini dibentuk kelompok-kelompok swadaya dengan semangata kooperatif yang dikembangkan di kalangan masyarakat desa. Kebijaksanaan tersebut dituangkan dalam program PNPM-MPd. Pertanyaan penelitiannya adalah bagaimana perencanaan PNPM-MPd di kabupaten Cirebon? Bagaimana pelaksanaan PNPM-MPd di kabupaten cirebon ? dan apakah manfaat, kendala pelaksanaan PNPM-MPd di kabupaten Cirebon? Tujuan penelitian ini untuk mengetahui pemberdayaan ekonomi melalui pelaksanaan PNPM-MPd di kabupaten Cirebon, untuk mengetahui kondisi ekonomi masyarakat desa di kabupaten Cirebon. Pendekatan yang dipakai dalam penelitian ini adalah pendekatan yuridis kualitatif, pengumpulan data dilakukan dengan cara observasi, wawancara, dan studi kepustakaan, dengan lokasi penelitian dalam pembahasan ini adalah masyarakat desa di kabupaten Cirebon. Hasil penelitian ini adalah kondisi ekonomi masyarakat di beberapa desa di kabupaten Cirebon dalam keadaan perlu ditingkatkan dengan pemberdayaan ekonomi melalui PNPM-MPd yang meliputi tahap perencanaan yaitu MAD-soaialisasi, Musdes-sosialisasi, Pelantikan KPMD, Penggalian gagasan, Musdes khusus perempuan, Musdes perencanaan, Penulisan usulan, verifikasi usulan, MAD Prioritas usulan, Mad penetapan usulan, Musdes informasi hasil MAD, SKPD (satuan kerja perangkat desa), pelasanaan PNPM-MPd dilasanakan oleh Tim pelaksana teknis desa dan oleh Unit pelaksana kegiatan pada tingkat kecamatan yang masing-masing unit pelaksana Kegiatan mendampingi Sembilan desa. Manfaat PNPM-MPd bagi masyarakat desa di kabupaten Cirebon sebagai sarana pemberdayaan ekonomi masyarakat meningkat dari yang konervatif menjadi inovatif, meningkatnya kesejahteraan masyarakat miskin, terbukanya kesempatan kerja, sumberdaya manusia meningkat dari yang tidak mengerti manajemen keuangan menjadi mengerti dan diterapkan pada pekerjaan selanjutnya. Adapun yang menjadi kendala pelaksanaan PNPM-MPd adalah paradigma perempuan (istri) harus manut laki2(suami), usaha yang modalnya diperoleh dari pinjaman PNPM-MPd bangkrut, uang pinjaman dari PNPM-MPd dipakai ketua kelompok, pengaruh politik desa (akibat pemilihan kuwu) wacana dana hibah.Kata kunci: Pemberdayaan, Ekonomi, MasyarakatABSTRACTAwakening the citizen from the circle of the poverty needs the wisdom, organization, commitment, program, and the accurate approach. Therefore, the special program to abolish the poverty is needed. This program will encourage the passion of productive self-sufficiency and independence of the poor citizen to simultaneously release them from the poverty. In this special program, the groups of the self-help are established with the cooperative passion which is developed in the circle of the village citizen. That wisdom is put into the program of PNPM-MPd. The research questions are that how is the planning of the PNPM-MPd in the district of Cirebon? How is the implementation of the PNPM-MPd in the district of Cirebon? And what are the benefits, obstacles of the implementation of PNPM-MPd in the district of Cirebon? The aims of this research are to know the economic empowering through the implementation of PNPM-MPd in the district of Cirebon, to know the economic condition of the village citizen in the district of Cirebon. The approach used in this research is the judicial qualitative approach, the data collection is conducted through the observation, interview, documentation study, and the location of the research in this explanation is the village citizen of the Cirebon district. The result of this research is that the economic condition of the citizen in several villages in the district of Cirebon needs to be increased with the economic empowering through the program of PNPM-MPd which consists of the planning step, namely socialization of MAD (musyawarah antar desa), socialization of Musdes, KPMD inauguration, search of the suggestion priority, women special Musdes, Musdes of planning, suggestion writing, suggestion verification, MAD of the suggestion priority, Mad of suggestion decision, Musdes of result information of MAD, SKPD (satuan kerja perangkat desa), the implementation of the PNPM-MPd is conducted by the organizer technical team of the village and by the unit of event organizer in the level of sub-district that each of the organizer unit accompanies the nine villages. The benefit of the PNPM-MPd for the village citizen in the district of Cirebon is as the method of citizen economic empowering that increases from conerfative to be inovative, increases the prosperity of the poor people, opens the job vacancy, increases the human resources from those who do not understand the financial management to be those who understand and apply it in the next job. The obstacles of the PNPM-MPd implementation are that the paradigm that the women (wife) must obey the husband, the fund got from the debt of bankrupt PNPM-MPd, the fund got from the debt of bankrupt PNPM-MPd is used by the chief of the group, the influence of the village politic (the election of the village head), the discourse of the donation fund.Key words: empowering, economic, citizen

Abstract

Abstrak Pajak merupakan salah satu usaha yang digunakan oleh pemerintah dalam pembiayaan pembangunan daerah yang berguna bagi masyarakat dan untuk kepentingan bersama.Pajak daerah sebagai salah satu bidang yang memberikan kontribusi terbesar dalam pendapatan asli daerah.Berdasarkan peraturan daerah bahwa pemerintah daerah diberikan kewenangan untuk mengelola keuangan daerahnya secara mandiri.Oleh karena itu pemerintah Kota Cirebon merasa perlu menerapkan sistem pelayanan pajak secara online untuk memaksimalkan pendapatan daerah.Rumusan masalah dalam penelitian ini adalah (1) Bagaimana aplikasi sistem pembayaran pajak online (2) Apakah pembayaran pajak online memberikan manfaat lebih bagi wajib pajak (3) Apakah pembayaran pajak online dapat meningkatkan Pendapatan Asli Daerah Kota Cirebon.Penelitian ini bertujuan untuk mengetahui bagaimana aplikasi sistem pembayaran pajak online, manfaat sistem pembayaran pajak online bagi wajib pajak dan peningkatan pendapatan daerah Kota Cirebon melalui sistem online.Penelitian ini menggunakan pendekatan kualitatif dengan teknik pengumpulan data melaui wawancara, observasi, dokumentasi dan studi kepustakaan. Teknis analisis yang digunakan dalam penelitian ini menggunakan metode studi kasus, penggunaan bahan dokumen, bahan dokumen tersebut berdasarkan informasi data yang diperoleh dari DPPKAD Kota Cirebon berupa buku Peraturan Daerah Kota Cirebon tentang Pajak Daerah, user manual SPTPD Online dan pendapatan pajak daerah tahun 2013 – 2015, dan yang terakhir metode triangulasi dalam penelitian ini membandingkan peraturan pusat dengan peraturan daerah yang berlaku. Hasil penelitian menunjukan bahwa (1)Aplikasi dalam pembayaran pajak online menggunakan pelayanan SPTPD online. Hal tersebut sebagaimana dengan sistem administrasi perpajakan yang diberlakukan oleh Direktorat Jenderal Pajak. (2) Manfaat sistem online bagi wajib pajak adalah memudahkan dalam melaporkan dan membayar pajak, penyederhanaan proses serta mengefisienkan waktu. (3) Pembayaran pajak online memberikan kontribusi untuk meningkatkan pendapatan daerah. Dengan adanya sistem online dalam pembayaran pajak daerah ini memberikan kemudahan bagi wajib pajak dalam pelayanan perpajakan, mengefektifkan proses administrasi pajak dengan itu keterlambatan pembayaran pajak dapat berkurang. Kata Kunci : Pajak Daerah, Pelayanan, Sistem Online dan Pendapatan Daerah.     Abstract Tax is one business that is used by the government in the financing of regional development that is useful for society and for the common good. Local tax as one of the areas that provide the largest contribution in revenue. Based on local regulations that local governments are given the authority to manage local financial independently. Therefore, the government of Cirebon City felt the need to apply online tax service system to maximize local revenue. The problems of this research are (1) How does the application online tax payment system (2) What is the online tax payments provide more benefits for the taxpayer (3) What isthe online tax payments can improve the original income Cirebon. The purose of this study is to know how is the online tax payment system applications, the benefits of online tax payment system for taxpayers and increase local revenue Cirebon through the online system. This study used a qualitative approach to data collection technique through interview, observation, documentation and literature study. Technical analysis used in this study using the case study method, the use of documents, materials that document is based on information and data obtained from DPPKAD Cirebon in book form Regional Regulation Cirebon on Local Taxes, user manual SPTPD Online and local tax revenue in 2013 - 2015 and the latter method of triangulation in this study compared the central regulation with local regulations apply. The results showed that (1) Application in tax payments online using SPTPD services online. It is as with the tax administration system imposed by the Directorate General of Taxation. (2) The benefits of an online system for taxpayers is to facilitate the reporting and paying taxes, simplification process setrta streamline time. (3) Tax payments online contributes to increase local revenue. With the online system in the payment of local taxes makes it easy for taxpayers in tax services, streamline the tax administration process with the late payment of tax can be reduced. Keywords: Local Taxes, Service, System Online and Local Revenue.

Abstract

AbstractThe public interest included the nation and the state interest and then the common interest, rights of land can be repealed with give proper compensation which is agree with law. One of them land acquisition for public interest such as Cipali Road Project as policy instruments was decided Sales Value of Taxable Object as basic calculation compesation land acquisition. The result of research is in the construction of Cipali Tollroad (Cirebon-Palimanan) Cirebon Regency because the construction of Cipali Tollroad is the public interest as “two sides of a coin” certainly there are two problems or impact result from Cipali Tollroad that are: 1) Positive Impact: their excursions in the region of the exit of Cipali Tollroad (Cirebon, Kuningan, Majalengka) can be increase; attract investment industry sector in districts which be passed tollroad; distribution of goods is faster, so the price of goods is cheaper and inflation also is lower; the price of soil is increased significantly, can be absorb labor in the business sector;. 2) Negative Impact: makes people who sell/attempted in along the pantura stripe is suffer a financial loss and bankruptcy; the emergency of bad debts for bank customer in along the pantura stripe “in the outside of Cipali Tollroad”; society who be running a business in along the pantura stripe as is Cipali Tollroad moved into crowded place/area in the stripe of Tol Cipali (Cirebon-Palimanan). Keywords: Economic Behavior, Compensation, and Public Interest. AbstrakKepentingan umum, termasuk kepentingan bangsa dan negara serta kepentingan bersama, hak-hak atas tanah dapat dicabut dengan memberi ganti kerugian yang layak dan sesuai dengan tata cara yang diatur dalam undang-undang. Salah satunya pengadaan tanah untuk Kepentingan Umum yaitu Proyek jalan tol Cipali, sebagai instrumen kebijakan telah menetapkan NJOP (Nilai Jual Obyek Pajak)  sebagai dasar perhitungan kompensasi pengadaan tanah. Hasil Penelitian ini adalah dalam Pembangunan jalan Tol Cipali (Cirebon-Palimanan) Kabupaten Cirebon karena Pembangunan Jalan Tol Cipali merupakan Kepentingan Umum seperti “dua sisi mata uang “ tentunya ada dua problem atau dampak akibat tol Cipali yaitu; 1) Dampak Positif: Adanya kunjungan wisata diwilayah pintu keluar tol Cipali (Cirebon, Kuningan, Majalengka) dapat meningkat; Menarik investasi sektor industri dikabupaten - kabupaten yang terlalui jalan tol; Distribusi barang lebih lancar ,sehingga harga barang lebih murah  dan inflasipun rendah; Harga tanah meningkat tajam, dapat menyerap tenaga kerja pada sektor sektor dunia usaha; 2) Dampak Negatif: Menjadikan masyarakat yang berjualan/usaha disepanjang jalan pantura rugi dan gulung tikar atau bangkrut; Munculnya kredit macet bagi nasabah Bank disepanjang jalur pantura “diluar Tol Cipali”; Masyarakat yang berusaha disepanjang jalur pantura dengan adanya Tol Cipali “Pindah ke tempat/kawasan yang ramai di jalur Tol Cipali (Cirebon-Palimanan).  Kata Kunci: Perilaku Ekonomi, Ganti Rugi, dan Kepentingan Umum.

Abstract

Abstract Cirebon City Many Household Food Industries hereinafter called small and medium enterprises engaged in traditional food field. On the other hand, the above conditions and phenomena can result in the position of business actors and consumers becoming unbalanced and consumers are in a weak position. Consumers are the object of business activities to profit maximally by business actors. This research uses qualitative approach. The research results of the research in the form of consumer protection through certification and the halal label on Household Food Industry at the Department of Trade, Cooperatives, Small and Medium Enterprises of Cirebon City through certification and halal label is the issuance of Household Food Production Certificate issued by the Dinas Kesehatan City of Cirebon. Another form of consumer protection is the Consumer Dispute Settlement Agency of Cirebon City for consumers who feel harmed by the producers and willing to resolve consumer disputes. The role of Trade, Cooperatives, Small and Medium Enterprises of Cirebon City in certification and halal label on household food industry is to facilitate Small and Medium Enterprises and the general public who have food production business to recruit Small and Medium Industry in area of Cirebon City who wishes to get a halal certificate for free. Keywords: Protection, Consumer, Halal Certification and Halal Label. Abstrak Kota Cirebon banyak Industri Rumah Tangga Pangan untuk selanjutnya disebut perusahaan kecil dan menengah yang bergerak di bidang makanan tradisional. Di sisi lain, kondisi dan fenomena di atas dapat mengakibatkan kedudukan pelaku usaha dan konsumen menjadi tidak seimbang dan konsumen berada pada posisi yang lemah. Konsumen menjadi objek aktivitas bisnis untuk meraup keuntungan yang sebesar-besarnya oleh pelaku usaha. Penelitian ini menggunakan pendekatan kualitatif. Adapun hasil penelitian adalah bentuk perlindungan konsumen melalui sertifikasi dan label halal atas Industri Rumah Tangga Pangan pada Dinas Perdagangan, Koperasi, Usaha Kecil dan Menengah Kota Cirebon melalui sertifikasi dan label halal adalah dengan dikeluarkannya Sertifikat Produksi Pangan Industri Rumah Tangga yang dikeluarkan oleh Dinas Kesehatan Kota Cirebon. Bentuk lain perlindungan terhadap konsumen adanya Badan Penyelesaian Sengketa Konsumen Kota Cirebon untuk konsumen yang merasa dirugikan oleh produsen dan berkehendak untuk menyelesaikan sengketa konsumen. Peran Dinas Perdagangan, Koperasi, Usaha Kecil dan Menengah Kota Cirebon dalam sertifikasi dan label halal atas industri rumah tangga pangan adalah memfasilitasi Industri Kecil Menengah dan masyarakat umum yang mempunyai usaha produksi pangan untuk merekruit Industri Kecil Menengah di wilayah Kota Cirebon yang berkeinginan memperoleh sertifikat halal secara gratis. Kata Kunci: Perlindungan, Konsumen, Sertifikasi dan Label Halal.

Abstract

Rural development in an integral part of regional development and national development as an effort to improve the quality of community’s life. The implementation of this rural development program is very important in the context of national development because rural areas occupy the largest portion in the entire country. The purpose of this study was to find out the village budget management sourced from the state budget in order to realize rural community development based on rural development in the perspective of Nawa Cita and the role of the village government in running the Nawa Cita program on peripheral community development on village government budget management based on people’s interest in order to realize equitable development. This study used a qualitative approach in order to investigate and understand the phenomena such as what happens, why it happens, and how it happens while understanding a social situation, events, and interaction roles. Data collection was carried out by conducting interview with the Head of BPMPD Department of Cirebon Regency, the Head of BPMPD Department of Kuningan Regency, the Head of BPMPD Department of Majalengka Regency and the Head of BPMPD Department of Indramayu Regency and all village heads in Cirebon, Indramayu, Majalengka, and Kuningan Regions. As well as the data were obtained from the documents in regency, disctrict, and village. The result of this study showed that village as the frontline of the development has strategic role in the success of the Nawa Cita Program. The village budget management is based on the principle of transparency, accountability, participatory, efficient, effective, orderly and budgetary discipline by paying attention to the justice principles, propriety and benefits for the village community. The implementation of activities in the APBD is carried out by the implementing team consisting of the elements from village apparatus and community institutions and supervised by the BPD, at the end of each fiscal year the Village Head has the obligation to submit a village government management report (LPPD) to the regional head through sub-district head and submit information to the LPPD to the BPD.
