Abstract

Siyasah syar?iyyah theory oriented in public policies that reflect sharia Islamic government policy.Islam, which covers all aspects of human life, from worship to mu'amalat, from siyasah (good governance) to 'alaqât al-dawliyyah (international relations), has a particular system of government and policy.  Therefore, this article analyses the theory, starting from the definition, background, types, and its purpose.DOI: 10.15408/ajis.v15i2.2861

Abstract

Muslim scholars have mainly considered the maq??id al-shar??ah within three categories: ?ar?riyy?t (the essentials), ??jiyy?t (the complementaries) and tahs?niyy?t (the desirables or the embellishments). The concept of ma?la?ah is meant to protect the maq??id al-shar??ah (the higher objectives of shar??ah), which consist of seven essential values, namely religion, life, intellect, lineage, wealth, honour and state, all of which promote the people?s welfare and prevent all kind of evils. They are considered essentials because neglecting them would cause total social disruption and anarchy. Even though classical scholars considered the dar?riyy?t to be six in number, this article suggests that the value of ?state? be added to this list. The values in the dar?riyy?t category must be upheld and protected from any real or unexpected threats either by maintaining the essentials or removing the disruption. The concept of state is just as essential as the other six values, for without it, all of them would be endangered and considered incomplete. Therefore, the ?state? value guarantees the continued existence of other values. In this paper, the author argues that this value should be regarded as a seventh essential value. Para cendekiawan Muslim  telah mempertimbangkan maq??id al-shar??ah dalam tiga kategori: ?ar?riyy?t (esensi), ??jiyy?t (pelengkap) dan tahs?niyy?t (keinginan atau hiasan). Konsep ma?la?at dimaksudkan untuk melindungi maq??id al-shar?'ah (tujuan yang lebih tinggi dari syariat), yang terdiri dari tujuh nilai esensial, yaitu agama, kehidupan, kecerdasan, garis keturunan, kekayaan, kehormatan dan negara. Semuanya bermaksud kesejahteraan rakyat dan mencegah semua jenis kejahatan. Mengabaikan hal itu akan menyebabkan gangguan sosial dan anarki total. Meskipun para sarjana klasik menganggap dar?riyy?t berjumlah enam, penelitian ini menunjukkan bahwa nilai "negara" ditambahkan ke daftar ini. Nilai-nilai dalam kategori itu harus dijunjung tinggi dan dilindungi dari ancaman nyata atau tidak terduga, baik dengan mempertahankan esensi atau menghilangkan gangguan. Konsep negara sama pentingnya dengan enam nilai lainnya, karena tanpa itu, semuanya akan terancam dan dianggap tidak lengkap. Oleh karena itu, nilai ?negara? menjamin keberlanjutan keberadaan nilai-nilai lain. Peneliti  berpendapat bahwa nilai ini harus dianggap sebagai nilai esensial ketujuh.

Abstract

This paper studies the theoretical structure of financing for Islamic philanthropy in the form of waqf or endowment by looking at the past and present forms of waqf. Waqf is expected to play a more important role to tackle current social and educational issues, where financial sustainability has become one of the greatest challenges faced by waqf institutions. Using the content and thematic analysis approaches, this paper reviews the practice of successful waqf institutions and summarizes the features that are significant to a successful waqf fundraising and management. The paper analyses three models that are suitable for innovation and management of waqf fundraising: Venture Philanthropy of Waqf Model (VPWM), Value-Based Capital Model of Waqf (VBCM), and Social Enterprise Waqf Fund Model (SEWF). The paper then investigates the possibility of applying the Management by Objectives (MBO) framework to improve the overall management of waqf institutions. The discussions are hoped to be able to contribute towards developing a better fundraising and management of waqf institutions.

Abstract

The discussions of good governance are being widely debatable all over the world. The world has arrived at an agreement that good governance has major influence for human resource development in the society. The debate is currently, going on all sectors of activities such the social, economic, and political imperatives, cultural sources and traditions. These have contribution to supervise and govern societies, how to manage business enterprises. The purposeof this paper is to investigate and to understand the theory of good governance from both a modern and Islamic perspective. Firstly, this paper is aimed to find out what is the good governance in modern term. Secondly, this paper will try to explore and explain the siyasah shar?iyyah means concerning to good governance on modern societies. Thirdly, explaining and exploring the concept of good governance in the reign of caliph Omar ibn Abd al-Aziz. Italready known that within short time he was able to bring the khilafah to glorious administration. This paper find that it is believed that the concept of good governance already practised by Caliph Omar ibn Aziz throughout his reign. In addition, there are many successes have been achieved by Omar either in the field of economy, politics and national defense and religious fields where the field may be difficult to achieve today's leaders.

Abstract

Nowadays, the idea of integrating zakat into fiscal system has arisen in Muslim countries including Indonesia. It is argued that zakat, in history, has played a significant role to create welfare among societies. It is proven at the time of Caliph 'Umar ibn 'Abdul 'Aziz that zakat has alleviated poverty at that time alongside tax. Having considered such achievement, some scholars argued that zakat should be reintegrated into current fiscal system. This paper, therefore, attempts to study the feasibility of integrating zakat into Indonesian fiscal system. Employing descriptive analysis based on Siyasah Shariyyah (high objectives of the Shariah). Therefore, the objectives of the study are set with these following points: 1) to address the strength and the weakness of the implementation of this idea, 2) to assess its opportunity as well as its threat, 3) to examine whether the integration of zakat will secure maslahah (benefit) or create mafsadah (harm). The result shows that the integration of zakat into current fiscal system is in line with the Siyasah Shariyyah. Hence, the strong willingness and commitment of government is strongly required to applicate it. The proper model of integration should also be planned well. Moreover, nurturing the understanding to all parties, especially to the nonMuslims and secularists, that this idea is really beneficial and not discriminatory should be promoted.
