Abstract

God’s revelations, as the main source of knowledge, do not deny, in any way our brain’s functional capabilities. The Quran acknowledges the necessity and importance of the brain. Islamic epistemology regards the brain as the second source of knowledge after the revelations. The holistic perspective on knowledge that is gained by mankind is that it is constructed by man in the context of their thinking culture, education and social concepts. Therefore, in this regard, thinking method directly relates to the objectives of Islam and its Sharia, and gives a significant implication towards understanding and developing Sharia as a dynamic knowledge area. This study combines three (3) methods, content analysis; historical method and comparison of the review of the history of the construction of Islamic thought and the review of screening methods Sociology Society background. The discussion this article covers the definition and concept of scientific thinking skills and scientific Islamic thought and the approaches of critical thinking in Islamic scientific thought. In reality, Muslims are not prohibited by their religion to think scientifically through scientific thinking methods, provided that it does not contradict with Islam. Some knowledge which is built through scientific thinking can be used to understand the Quranic texts more profoundly. Also, undeniably, the eminence of God’s revelations has been made evident and exploited to proof the existence of Allah.

Abstract

IKHTISAR: Program pembangunan pendidikan bergantung bukan sahaja kepada pembangunan material semata-mata, tetapi memerlukan keprihatinan para pendidik Islam dalam membangunkan kerangka kurikulum dan metodologi pendidikan Islam yang progresif dan berdaya maju. Kertas kerja ini bakal mengupas berkaitan pendemokrasian sistem pendidikan Islam di Malaysia secara umum. Perbincangan meliputi beberapa perkara utama, iaitu: konsep dan falsafah pendidikan Islam, falsafah pendidikan Islam negara Malaysia, dan perbincangan khusus pendekatan-pendekatan yang perlu dalam rangka pendemokrasian sistem pendidikan Islam di Malaysia. Pendemokrasian sistem pendidikan adalah suatu budaya ilmu yang pernah dipraktekkan dalam sistem zaman kegemilangan awal Islam. Semakan dan penambahbaikan kurikulum pengajian Islam di Malaysia harus dilakukan bagi merealisasikan hasrat dan matlamat pendidikan Islam yang selari dengan Falsafah Pendidikan Negara dan Dasar Pembangunan Negara. Pernyataan Falsafah Pendidikan Islam yang menekankan aspek menyampaikan ilmu, kemahiran, dan penghayatan Islam berdasarkan Al-Qur’an dan Al-Sunnah perlu direalisasi secara sistematik. Sistem dan bentuk pendidikan Islam harus mampu mengimplementasikan “khaira ummah” atau sebaik-baik umat dan “ummatan wasatan” atau umat rujukan bagi insan lain.KATA KUNCI: Pembangunan pendidikan, falsafah pendidikan Islam, pendemokrasian, dasar pembangunan negara Malaysia, dan khaira ummah.ABSTRACT: This article entitled “Democratization of the Islamic Education System in Malaysia: An Over Review”. Education development program depends not only on material development alone, but requires a concern to Muslim educators develop curriculum framework and methodology for Islamic education is progressive and viable. This paper will peel related democratization Islamic education system in Malaysia in general. Discussion covers some of the main topics: concept and philosophy of Islamic education, the national Islamic educational philosophy in Malaysia, and specific discussion of approaches to the framework of the democratization of the Islamic education system in Malaysia. Democratization of the education system is a knowledge-based culture system practiced in the golden age of Islam. Review and improvement of the curriculum of Islamic studies in Malaysia have to be done to realize the aspirations and objectives of Islamic education in line with the National Education Policy and the National Development Policy. Statement of Educational Philosophy of Islam which emphasizes the knowledge, skills, and appreciation of Islam based on the Al-Quran and Al-Sunnah should be systematically realized. Abstract

ABSTRACT: This paper focuses on the module development model for “tafaqquh” at the mosque. The “tafaqquh” programme has been systematically conducted jointly by Malaysia Islamic Development Department, the State Islamic Affairs Department and mosques’ management committees. The programme has been made successful and effective by the contribution and cooperation of “takmir” teachers who  have been  appointed and trained intensively. These “takmir” teachers play very significant roles in the realisation of the aspiration and the scheme in developing knowledgeable society through the involvement of the mosque. To get the holistic view of the theme and subject of the study, focus is made on several key elements: the history of the development of Islamic studies module in the societies of the Muslim civilization; Islamic education theory which correlates to the National Philosophy of Islamic Education; “fiqh” learning method from the current methodology and pedagogy; and finally the presentation of the current “tafaqquh” module of alternative Islam in Malaysia. The learning of “fiqh” must be viewed from a broad context and it should be able to have an influence on the life of human beings from all living aspects.The philosophy of Islamic education, which is based on Al-Qur’an and Al-Sunnah, should be able to be implemented realistically. The modification and upgrade of  the “fiqh” learning syllabus in mosques require a drastic approach, besides practical module construction. Abstract

Abstrak:Institusi Hisbah merupakan sebuah institusi yang bertanggungjawab dalam melaksanakan prinsip al-amr bil makruf wa nahyu anil munkar. Pihak yang menguatkuasakan institusi ini dikenali sebagai Muhtasib. Objektif artikel secara umumnya membincangkan pelaksanaan konsep hisbah dan dakwah secara integrasi dalam prosedur dan modus operandi pencegahan maksiat dan jenayah khalwat di Malaysia. Sehubungan itu, artikel ini akan meninjau bidang tugas dan bidang kuasa bahagian penguatkuasaan dan pencegahan maksiat dan jenayah khalwat di Malaysia serta seterusnya menganalisis aplikasi konsep hisbah dan dakwah di kalangan pegawai penguatkuasa agama di Malaysia. Selain itu, turut membincangkan pendekatan amar makruf dan nahi mungkar dalam kerangka Hisbah yang mengkhususkan kepada operasi pencegahan maksiat dan jenayah khalwat. Kuasa ini diberikan kepada pegawai-pegawai penguat kuasa jenayah syariah di Jabatan Agama Islam negeri-negeri. Bidangkuasa penguatkuasaan jenayah Syariah khusus kesalahan jenayah khalwat adalah tertakluk kepada bahagian penguatkuasa, jabatan agama Islam negeri-negeri. Kajian literatur dan kepustakaan diaplikasikan secara kondusif bagi menjelaskan prinsip hisbah dan dakwah. Selain itu, kajian deskriptif dan analisis kandungan bersifat tekstualiti dilakukan terhadap peruntukan undang-undang terkandung dalam enakmen jenayah syariah negeri-negeri. Selanjutnya, kajian lapangan secara tembual dan observasi tentang aplikasi konsep hisbah di Bahagian Penguatkuasaan Jenayah Syariah, Jabatan Agama Islam negeri-negeri. Analisis perbandingan turut diaplikasi bertujuan untuk mencari persamaan dan perbezaan antara konsep dan realisasi hisbah dan dakwah oleh pihak penguatkuasa jenayah syariah bagi kesalahan khalwat. Umumnya, prosedur dan modus operandi pihak berkuasa dalam mencegah maksiat dan jenayah khalwat perlu memenuhi kriteria amar makruf nahi mungkar dalam kerangka hisbah. Akhirnya, artikel ini menghasilkan cadangan pendekatan alternatif terbaik yang lebih efektif iaitu integrasi hisbah dan dakwah dalam prosedur  pencegahan dan penguatkuasaan perundangan jenayah khalwat. Kata kunci: Hisbah, Dakwah, Maksiat, Khalwat, Undang-undang Jenayah Islam. AbstractHisbah institution is an institution responsible for implementing the principle of al-amr bil makruf wa nahyu anil munkar. The party that enforces this institution is known as Muhtasib. The purpose of this article is to discuss the implementation of the concept of hisbah and dawah in an integrated manner in the procedures and operation modus in prevention of immoral and criminal of khalwat in Malaysia. In this regard, this article will review the areas of duty and the jurisdiction of the enforcement and islamic criminal in Malaysia and further analyze the application of the concept of hisbah and dawah among religious enforcement officers in Malaysia. In addition, it also discusses the approach of the good and evil nature of the Hisbah framework which specializes in the prevention of immorality and the crime of khalwat. This authority is given to shariah criminal enforcement officers in the state Islamic Religious Department. The jurisdiction of Shariah criminal enforcement of special offenses against khalwat is subject to the enforcement division, the state Islamic religious department. Literary studies are applied conducive to explaining the principles of hisbah and dawah. In addition, descriptive and content analysis of textual content is performed on the provisions of the law contained in the syariah criminal enactment of states. Furthermore, field surveys were conducted and observations on the application of hisbah concept in the Shariah Criminal Enforcement Division, the State Islamic Religious Department. Comparative analysis is also applied to find the similarities and differences between the concepts and realization of hisbah and dawah by the shariah criminal enforcement of khalwat offense. Generally, the procedures and operation modus of the authorities in preventing immoral and criminal of khalwat should meet the criterion of a false morality.Finally, this article produces a more effective alternative approaches that are integration of hisbah and dawah in the prevention and enforcement procedures of khalwat crime. Keywords: Hisbah, Da’wah, Immoral, Khalwat, Islamic criminal law.

Abstract

The development of shari’ah is being questioned because it has deviated from the original purpose and tends to focus more on formal aspects than on its application and usefulness for life. Therefore, it is the time to re-evaluate the strategy and execution of all forms of shari’ah to fi t with the modern era and improve the business of ummah to cover the advancement of science and technology. There are two choices in establishing the patterns of shari’ah studies. First, follow the trends with tecnical, bureaucratic and legal also formal rule that will make Islamic shari’ah static. Secondly, formulate the paradigm of integrated shari’ah studies covering the development of science and technology whose purpose is to establish a dynamic and responsive Islamic law to the problems of society.

Abstract

This paper focuses on Islamic management issues as one of excel- lent legacies left by the Prophet (S.A.W). This paper will review the accomplishment of Islamic approach to management which had been practiced by the Prophet SAW and his companions. Based on archival research method, this paper will analyze the concept of Amal Jamai(team work) based on Islamic management centered onthetraditionsof theProphet(SAW).Thediscussionshowed that team work is an imperative element in Islamic management and not merely confined to the practice of dawah (inviting to Is- lam) but also in term of daily activities. In fact, the practice had been taught and shown by the Prophet (SAW). Even though the West had introduced many contemporary management theories, there is a huge difference compared to the Islamic approach to management. Abstract

The main objective of this legal research is to compare the legal construction and the use of “rahn tasjily” mechanism in the Sharia bank financing between Indonesia and Malaysia through law, concept, and history approaches. The data were analyzed qualitatively by systematic interpretation and historical interpretation. The results are: 1) Both countries do not have a strong regulation in Sharia guarantees, thus the law construction is implemented by harmonization and integration between Sharia principles and conventional regulations (civil). The differences are in the concept, the division of rahn, and the law substance in the Sharia banking complement regulation. 2) The mechanism is also different, where in Indonesia the guarantee should be bound by an authentic certificate (notary) and registered in the authority institutions in order that Sharia bank (murtahin) obtains a strong law protection beside an insurance. While in Malaysia, the use of collateral is only included in the financing contract without an authentic certificate; the registration is not compulsory and the ownership proof of guarantee (marhun bih) as well as the object is in rahin permanently (except a land); and the collateral strength for Sharia bank is an insurance.
