Abstract

The development of economy always emphasizes on the growth aspect without considering moral values prevailing in the society. Looking at the fact, then, Islamic economists conceptualize that the development is focused not only on the material aspect, but also on the moral values. The first is necessary to fulfil the ideal needs of the society, which is namely al-had al-kifayah. On the other hand, the later -moral values aspect- is developed in order to achieve the Blessing of Allah Al-Mighty. In addition, the development of economy is not only to provide higher growth only, but it should also be in line with the justice of the distribution. Thus, the economic growth which is relatively less, is considered good if it is followed by the justice of the distribution. Of all, however, both qualitative and quantitative standards of the economic growth is still ignored by the thoughts of Islamic economists.

Abstract

The goal of Shariah ( ilm al-maqashid ) historically develop dynamically. This science shows free and sporadic earlier. Then, it develops evolutively and it becomes one of basic of established Islamic law thought. The goal of tashri can be classified into three categories, al-masalih ad-daruriyah, al-haji, and al-tahsini. This classification does not answer law problerms academically. Because of ilm al-maqasid is not only departing from linguistics understanding toward Quran and Sunnah, but also considers the values deriving from society. especially moral norms. So, al-masalih that relates to and as reference of the academic intellectual exercise is al-masalih al-hayawiyah, al-masalih al-aqliyah, and al-masalih ruhiyah. This classification will comprehend Islamic law integratively all of maslahah, it implies that Islamic law will be applicable and functionable to solve society problem.

Abstract

The controversies regarding the emerging of the Shari’ah Local Acts ( Perda Syari’ah) in several regencies or provinces in Indonesia. The debates about the act appear pros and conts among the societies, government and politicians. Some of them declare that the actcontradict to the Indonesian Constitution and The Indonesian basic ideology Pancasila. Contrary to above perspective is stated that this act can be justified by the constitution. According to the history of Islamic jurisprudence needs to be placed the substance of shari’ah or the public interest should be applied over that the textual interpretation of shari’ah, for instance tadwin ( codification) and taqnin ( legislation). Abstract

Berbicara tentang Hak Milik Intelektual (HAMI) dalam perspektif fiqh menghadapi beberapa problem antara lain yaitu, pertama HAMI tergolong masalah hukum baru yang keberadaannya seperti sekarang ini belum dikenal oleh masyarakat muslim pada abad-abad terdahulu. Karena mayoritas ilmu yang dikembangkan pada masa itu adalah ilmu-ilmu syari’ah yang pengajaran dan penyebarannya menjadi kewajiban kolektif (fard’ al-kifāyah)1 dan untuk memperoleh pahala.2 Kedua, sebagian masyarakat muslim memandang HAMI hanya sebagai produk hukum Barat yang bersifat kapitalis, bahkan ada pendapat yang menyatakan bahwa HAMI adalah bentuk monopoli terhadap ilmu pengetahuan yang jelas-jelas tidak dapat diterima oleh Islam.3 Ketiga terdapat sejumlah teks keagamaan yang menyatakan bahwa ilmu pengetahuan menjadi amal jariyah seseorang yang dapat mendatangkan pahala secara berkesinambungan.

Abstract

Pornography and pornoaction happen because of modernization and globalization influence on sosiety lives. Without consciousness from society to solve the above problems which considering Islamic community public interest, pornography and pornoaction always emerge. Islam as doctrine early presents to solve the problems, so there are many Quranic verses and prophet traditions regulate the dress, communication between man and woman, including the publications that appear moral decadence. Kata kunci: pornografi, pornoaksi, Islam, fiqh.

Abstract

Buku karya Abdul Jabbar Hamid al-Sabhany ini berupaya mengisi celah kekosongan pemikiran ekonomi Islam di tengah merebaknya pemikiran ekonomi klasik dan neoklasik yang jarang disentuh oleh referensi asing secara umum termasuk pula pada referensi berbahasa Arab—kecuali beberapa karya kecil yang focus pada sebagian pemikiran teorikus ekonomi Islam seperti Ibn Khaldun, al-Maqrizi dan lain-lain. Di samping itu, penulisan buku ini dilandasi kegelisahan Abdul Jabbar ihwal aliran pemikiran ekonomi Islam yang ditopang oleh al-Quran dan Sunnah tidak dilakukan studi yang layak terhadapnya secara proporsional (hal. 12). Menariknya, usaha maksimal penulis memaparkan aliran pemikiran ekonomi secara singkat, mengacu pada referensi asli tanpa disertai komentar penulis yang cukup semata-mata untuk menghindari subyektifitas.

Abstract

Study of the products of Islamic law in Indonesia is often partial and focused on mainstream mass organizations. In fact, the existence of small and local organization that influence the dynamics of Islamic law in Indonesia, such as Wahdah Islamiyah. In response to the problems of the people, especially in South Sulawesi, this organization has been often condemned heretic wing, spreaders heresy and other negative charges. In fact, the style and the formulation of laws formulated emphasizes maqashid al-shariah, thus seem more flexible, visible, and dynamic. This negative accusations, is more likely due to political pressure, of the substance of the factors defined legal fatwa. Seeing the dynamic thinking of Islamic laws of community organi zation of Wahdah Islamiyah in its way to formulate some Fatwa by interacting with social, economic, political, cultural, localized, national and global reality is to enforce human beings’ welfare without ignoring nash. The interaction with social reality forms a way of thinking of Wahdah Islamiyah which leads to moderation and inclusive characteristics.

Abstract

The change of value currency had been the serious attention by the classical fiqh experts. Therefore, there are many different opinions about that, not only between mazhab to another, but also in the circle of one mazhab. The best interesting, the ulama not only connectedthe change ofvalue currency with transaction ofsale andpurchase, lease, loan, salary and other bussiness transactions, but also with zakah, family responsible, and diyat in the criminal cases also the minimal limit (counting) of the thief good value made the man cut his hand. The difference happened in this context, actually showed how the fiqh experts searched the transaction consequences in crisis condition in order one to another not make lose each other and finally may create the justice that one of the spirit of Islamic economy.
