Abstract

Post-tsunami disaster in Aceh, legal issues on land are regulated by the Government Regulation in Lieu of Law Number 2 of 2007, which regulates among others on land that does not exist and/or unknown its owners and their heirs. The land is being taken care as  a religious treasure by Baitul Mal  with an order the Syariyah Court. This study applies juridical normative and sociological normative methods. From the field research it was found that the Government did not have data of lands with unknown owners and their heirs. It was known from decision of the Syariyah Court  of Banda Aceh which revealed that the fact was originated from the construction of the drainage where the land procurement committee did not know where to hand over the land acquisition fund.Key words: tsunami, land, Aceh

Abstract

ABSTRACT: The presence of the commander Laot Laot and customary law is recognized in national legal systems. One is owned by the authority to settle the dispute through traditional justice. So far, the customary judicial decision Laot followed. But viewed from the provisions of national law, customary judicial decision Laot does not have a strong legal basis. This research is descriptive analytical, normative juridical approach sociological and juridical. From the research note that the judiciary can enforce the law and all courts established by state law, not including the customary judicial Laot in it. This judicial decision can only provide a peaceful because the decision is relative or voluntary. Abstract

ABSTRACT: Indonesian legal system recognizes 5 (five) formal legal sources, namely; act, judge decision, treaty, expert view, and customary law. Custom subsystem is unwritten law or more well known as customary law. The source of customary law has been implemented earlier before the written one followed by modern society. However, in the fact, customary law development in material meaning and judicial customary law in the meaning of formal law always faces constraints especially from positivism legal concept from time to time. Therefore, this research aims to focus on the history of the development of judicial customary law in Indonesia since the colonial period 1602 till the period after the MoU Helsinki in Aceh. The historic legal approach is applied by exploring how acts provide space for enhancing the system. Abstract

ABSTRACT: The customary law of the sea  for the furthere mentioned as hukum adat la’ot is the customary law conducted by the Aceh’s fisherman community to provide some prosedures on catching fish and the  fisherman community life. In the coastal area.  In the hukum adat la’ot is contained regarding the procedures of catching the fish (meupayang) at the sea and also contains the mechanism dispute settlement if occuring customary dispute among fisherman. Hukum adat la’ot has existed since 400 years ago. Abstract

Penelitian ini dilakukan untuk melihat bagaimana perlindungan terhadap konsumen serta pengawasan yang dilakukan oleh Pemerintah Kabupaten Aceh Besar terkait makanan jajanan anak yang mengandung bahan berbahaya di lingkungan sekolah. Dengan menggunakan pendekatan yuridis empiris, diharapkan penelitian ini bisa menjawab masalah yang diajukan. Selain bahan hukum, penelitian dengan pendekatan yuridis empiris juga menggunakan data primer. Hasil penelitian menunjukkan bahwa Pemerintah Kabupaten Aceh Besar berusaha memberikan perlindungan terhadap konsumen pangan jajanan yang mengandung bahan berbahaya. Perlindungan diberikan dengan cara pengawasan terhadap penjual makanan yang berjualan di lingkungan sekolah. Pemerintah disarankan agar mempertimbangkan untuk membuat undang-undang khusus tentang perlindungan konsumen anak. Consumer Protection on Snacks Hazardous Ingredients at School Area This research conducted to see how the consumer’s protection and the supervision carried out by Aceh Besar District Government related to childrens snacks that contain hazardous ingredients in the school environment. This research applied empiric juridical approach, it is hoped that can answer the problems arise. Not only uses legal materials but this research also uses primary data. The results of the study indicate that the Aceh Besar District Government seeks to provide protection for child consumers of snacks hazardous ingredients. Protection is provided by giving supervision for food sellers who sell in the school area. It is suggested to the government to consider making a special law on child consumers protection.

Abstract

Artikel ini bertujuan menemukan dan menjelaskan konsep dana kibat hukum pelaksanaan hareuta peunulang dan penyelesaiannya di Kabupaten Pidie, Aceh, Indonesia ditinjau dari Kompilasi Hukum Islam (KHI). Data diperoleh melalui library research dan field research. Data disajikan dengan menggunakan deskriptif kualitatif. Hasil penelitian menunjukkan, konsep hareuta peuneulang merupakan konsep hibah adat yang telah dipraktikkan secara turun temurun dalam kalangan masyarakat di Kabupaten Pidie. Konsep tersebut berupa pemberian rumah dan/atau tanah dari orang tua kepada anak perempuan sebelum melangsungkan pernikahan sebagai bekal dalam berumah tangga. Dalam pelaksanaannya, pemberian (hibah) hareuta peunulang menimbulkan masalah karena hanya diberikan kepada anak perempuan, sementara anak laki-laki yang seharusnya juga mendapatkan harta warisan sebagaimana di atur dalam KHI justru tidak mendapakannya. Persengketaan atau gugatan terhadap pembagian harta warisan tersebut di Kabupaten Pidie dapat diselesaikan secara musyawarah oleh perangkat gampong, tuhapeut, imuem meunasah, dan perangkat gampong lainnya. Disarankan kepada masyarakat dalam putusan pembagian harta warisan dapat berpedoman pada Pasal 171 huruf g dan Pasal 210 KHI, serta prinsip-prinsip hukum Islam. Hal ini untuk menghindari pertikaian dalam hal pembagian harta warisan.This article aims to find and explain about the concept, legal effect and its legal settlement of hareuta peunulang in Pidie, Aceh, Indonesia in terms of Compilation of Islamic Law (KHI). Data obtained through library research and field research. Data presented by using qualitative descriptive. The result showed, hareuta peuneulang is an indigenos grants that has been practiced by communities in Pidie District. The concept for the grant of the house and / or the land from parents to daughters before married as financial support in settling down. In its implementation, the grant of hareuta peunulang poses a problem because it is only given to daughter, while son who should also get inheritance as arranged in KHI do not get it. The dispute or lawsuit against the division of the inheritance in Pidie can be resolved by deliberation by gampong components, tuha peut, imuem meunasah and other gampong component. It is suggested to the comunities in the decision of the division of inheritance can be guided by Article 171 letter g and Article 210 KHI, as well as the principles of Islamic law. This is to avoid disputes in terms of division of inheritance.

Abstract

ABSTRAK. Lembaga adat di Aceh sebetulnya telah ada sebelum adanya UU tentang Pemerintahan Aceh. Artikel ini dikaji dengan menggunakan pendekatan yuridis normatif. Sementara analisis data akan menggunakan teknik content analysis. Dari bahasan ditemukan bahwa dukungan utama kedudukan Mahkamah Adat dalam UU tentang Pemerintahan Aceh adalah Pasal 98 ayat (1), ayat (2), dan ayat (3) yang mengatur tentang lembaga adat dengan kewenangan menyelesaikan persengketaan masyarakat. Keberadaan mahkamah kemudian dipertegas dengan Qanun  Nomor 9 Tahun 2008 yang menguraikan tentang  prosedur dan struktur perangkat mahkamah adat, tata cara persidangan di mahkamah adat, jenis-jenis kasus yang dapat diselesaikan dan jenis hukuman yang dapat diberikan. Adat Court Position After the Law on Government of Aceh  ABSTRACT. Customary institutions in Aceh actually existed before the Law on Government of Aceh. This article examined using normative juridical approach. While the data analysis will be using content analysis techniques. From the discussion it was found that the main support position the Adat Court in Law on Governing Aceh is Article 98 paragraph (1), paragraph (2), and paragraph (3), which regulates the customs agency with the authority to resolve disputes society. The existence of the court then reaffirmed by Qanun No. 9 of 2008 which elaborates on the procedure and device structures customary tribunals, court proceedings in court custom, the types of cases that can be resolved and the type of punishment that can be given

Abstract

Lahirnya Undang-Undang No. 7/2016 tentang Perlindungan dan Pemberdayaan Nelayan, Pembudidayaan dan Petambak Garam, memunculkan masalah baru bagi nelayan kecil. Undang-undang ini memperbesar ukuran gross tonnage kapal nelayan kecil dari ukuran 5 GT menjadi 10 GT. Ketentuan ukuran 5 GT diatur dalam Undang-Undang No. 45/2009 tentang Perubahan Undang-Undang No. 31/2004 tentang Perikanan. Perubahan GT tersebut tidak sederhana. Masalah utama adalah terdapat perbedaan antara undang-undang yang mengatur perlindungan nelayan dengan undang-undang yang mengatur perikanan. Implikasi dari perbedaan ini tidak terbatas pada kapal semata, melainkan pada jalur penangkapan ikan, fishing ground, hingga proses perizinan kapal. Dengan semakin besar GT, maka fishing ground yang selama ini dipakai oleh kapal nelayan ukuran 5 GT, turut dipakai oleh kapal berukuran 10 GT. Hal ini berpotensi konflik sesama nelayan. Tawaran pemetaan untuk harmonisasi hukum diharapkan akan menjawab permasalahan hukum perlindungan nelayan. Legal Arrangement of Small Fishermen Protection The birth of the Act No. 7/2016 on Protection and Empowerment of Fishermen, Cultivation and Fishers of Salt, raises new problems for small fishermen. This act enlarges the gross tonnage size of small fishing vessels from 5 GT to 10 GT. The 5 GT size requirement is regulated in the Act No. 45/2009 on Amendment of the Act No. 31/2004 on Fisheries. The GT changes are not simple. The main problem is that there are differences between laws governing the protection of fishermen and the laws governing fisheries. The implications of this difference are not limited to ships alone, but to fishing lanes, fishing ground, to the licensing process of ships. With the bigger GT, then the fishing ground that has been used by fishing boats size 5 GT, also used by the ship size of 10 GT. This has the potential to conflict among fellow fishermen. The legal to harmonization mapping offer is expected to address legal protection issues of fishermen.

Abstract

Penelitian ini bertujuan untuk mengetahui penerapan prinsip kehati-hatian pada pelaksanaan perjanjian kredit ringan di PT. Bank Tabungan Negara (Persero) Tbk mengetahui faktor penyebab terjadinya kredit macet pada kredit ringan di PT. Bank Tabungan Negara (Persero) Tbk serta untuk mengetahui penyelesaian yang ditempuh oleh PT. Bank Tabungan Negara (Persero)Tbk atas kredit ringan yang macet. Penelitian ini menggunakan metode penelitian yuridis empiris. Dimana hukum dilihat sebagai norma dan juga sebagai kenyataan sosial. Hal ini diperlukan dengan adanya pertimbangan untuk suatu aturan hukum yang berlaku dalam praktek dengan mewawancarai beberapa informan dan responden. Hasil penelitian menunjukkan bahwa kredit ringan tidak hanya dapat diambil oleh nasabah debitor yang mempunyai payroll di Bank BTN, namun juga berlaku nonpayroll. Kredit ringan tidak mengharuskan nasabahnya menyerahkan suatu objek untuk dijadikan jaminan. Oleh karena itu penyelesaian tunggakan kredit ini bisa saja membutuhkan waktu yang lama dalam penyelesaiannya karena memerlukan beberapa pertimbangan dan tindakan hukum agar nasabah debitor kembali membayar angsuran tepat waktu bahkan melunasinya. This study aimed to determine the application of prudential principles in the implementation of the Kredit Ringan agreement in PT. Bank Tabungan Negara (Persero) Tbk, the cause of bad credit and settlement pursued by PT. State Savings Bank (Persero) Tbk on Kredit Ringan that stalled. This study used empirical juridical research methods, where law is seen as a norm and as a social reality. This was necessary with consideration of the rule of law applicable in practice by interviewing some informants and respondents. The result of the research showed that not only the debtor customers who have payroll in BTN Bank are allowed to take Kredit Ringan, but this also applies to non-payroll customers.Kredit Ringan does not require its customers submit an object to be collateralized. Therefore, the settlement of credit arrears may take a long time because it requires some consideration and legal action for the borrower's customers to pay back the installment on time and even pay it off.

Abstract

Pasal 8 Ayat (1) huruf e Qanun No. 10 Tahun 2007 tentang Baitul Mal menyebutkan Baitul Mal dapat bertindak sebagai pengelola harta yang tidak diketahui pemilik/ahli waris berdasarkan putusan Mahkamah Syar’iyah. Banyaknya tanah pasca bencana tsunami yang tidak diketahui lagi pemilik/ahli warisnya menimbulkan permasalahan dalam penanggulangannya. Pemerintah Kota Banda Aceh berencana melakukan rekonstruksi pembangunan kota yang berdampak pada lahan tanah, sehingga dikeluarkan sejumlah dana ganti rugi dari Pemerintah Kota Banda Aceh yang dititipkan pada Baitul Mal Banda Aceh, berdasarkan Putusan Mahkamah Syar’iyah. Keseluruhan dana titipan hanya sebagian kecil yang telah diketahui pemilik/ahli warisnya dan telah diambil dana titipan dari Baitul Mal Banda Aceh.Tujuan penulisan ini untuk mengetahui dan mengkaji bagaimana Baitul Mal mendayagunakan dana titipan tanah terlantar yang tidak diketahui pemilik/ahli warisnya, dasar hukum yang digunakan Baitul Mal dalam mendayagunakan dana titipan tanah terlantar, dan kendala dan solusi Baitul Mal dalam mendayagunakan dana titipan tanah terlantar yang tidak diketahui pemilik/ahli waris.Article 8 Paragraph (1) letter e Qanun no. 10 Year 2007 about Baitul Mal mention Baitul Mal can act as a manager of property unknown to the owner / heir based on the decision of the Mahkamah Syar'iyah. The amount of land after the tsunami disaster of unknown again the owners / heirs cause problems in handling. The Municipal Government of Banda Aceh plans to reconstruct urban development that affects land, so that a number of compensation funds from Banda Aceh City Government are deposited in Baitul Mal Banda Aceh, based on the Decision of the Syar'iyah Court. The entire deposit fund is only a small portion that has been known to the owner / heir and has taken funds from the Baitul Mal Banda Aceh. The purpose of this paper is to know and examine how Baitul Mal utilize the funds of land abandoned land unknown to the owner / heirs, the legal basis used Baitul Mal in utilizing funds abandoned land, and constraints and solutions Baitul Mal in utilizing funds abandoned land not known to the owner / heir.
