Abstract

Indonesia belum memiliki sistem hukum perburuhan yang adil. Terjadi dilema kepentingan buruh,pemberi kerja dan Pemerintah. Tulisan ini bertujuan membuktikan bahwa sistem hukum perburuhanbelum berjalan. Tulisan ini berdasarkan hasil penelitian normatif dengan pendekatan statute approachdan sociolegal. Hasil penilitian menunjukkan bahwa pertama, substansi pengaturan hukum di bidanghubungan kerja, khususnya upah minimum, outsourcing dan TKI masih terdapat inkonsistensi. Strukturhukum perburuhan belum berjalan. Kedua, terjadi tumpang tindih kewenangan antara KementrianTenaga Kerja dan Kementrian Dalam Negeri di bidang perburuhan berkaitan dengan otonomi daerah.Terjadi kekosongan hukum dalam upaya hukum bagi masalah perburuhan kolektif. Ketiga, budayahukum dalam hubungan industrial yang lebih baik belum berjalan. Sangat dibutuhkan peran pemerintahdalam menciptakan mekanisme perlindungan buruh yang berpijak pada Konvensi dan Rekomendasi ILO.Kata kunci: sistem hukum perburuhan, keadilan substansi, hubungan industrial.

Abstract

Prior to the enactment of Law 13/2003, workers whose did dismissal due to retirement, the right to receive pension funds (for civil servants) or rights to severance pay (for private sector workers). The aim of the article to provide an alternative solution for the national case on retired PT BRI Persero Tbk on going at this time, Status of Directors Nokep 883-DIR/KPS/10/2012 SK analyzed based on Article 167 Law 13/2003, this is BRI has included workers/employees in the pension plans whose contributions/premiums paid by the BRI and workers. SK Nokep 883-DIR/KPS/10/2012 Directors has violated Article 167 paragraph (3) of Law 13/2003.

Abstract

This study discusses presupposition and implikature in Abdur’s Stand-up Comedy Indonesia (SUCI) Session 4 Kompas TV. SUCI uses Indonesian language as the main material of the jokes. The jokes in SUCI come from everyday life of the comics. The jokes in SUCI have some massages. It uses pragmatics analysis approach to answer the questions about (1) presupposition and (2) implicature of SUCI 4. The data are oral forms of Kompas TV’s SUCI 4 shows. The data are obtained by the observation method and by taking notes technique. The data analysis uses pragmatics equal methods. The theories used are the theory of background knowledge, presuppotition, and implicature. The analysis shows that first, Comica’s presupposition about the east of Indonesia are geographycal, society, food, technology, and pulic building condition. Secondly, implicature of Abdur stand up comedy are admit a shortage, found out attention, and critics about government role. Keywords: presupposition, implicature, Indonesian stand up comedy.

Abstract

      Serikat Pekerja atau Serikat Buruh merupakan bentuk pelaksanaan dari hak seseorang untuk berserikat dan berkumpul. Adanya serikat Pekerja / Buruh sangat penting bagi kelangsungan hubungan industrial. Serikat Pekerja diharapkan dapat melaksanakan fungsinya secara maksimal dalam rangka meningkatkan hubungan industrial di tingkat perusahaan.

Abstract

Sejak adanya krisis moneter dan ketidakstabilan politik nasional Indonesia, pekerja sangat memerlukan perlindungan hukum, mengingat Indonesia adalah negara hukum. Dampak krisis moneter diantaranya adalah adanya penutupan perusahaan, adanya pemutusan hubungan kerja secara besar- besaran atau adanya efisiensi tenaga kerja.  Salah satu bentuk perlindungan hukum yang dibutuhkan oleh pekerja adalah kepastian hukum tentang adanya hak-hak normatif bagi pekerja yang diputus hubungan kerjanya karena pekerja melakukan  kesalahan berat.        Pekerja yang melakukan kesalahan berat dapat langsung di putus hubungan kerjanya apabila ia tertangkap tangan, pengakuan  serta ada bukti lain yang cukup bahwa ia telah melakukan kesalahan berat.        Pekerja yang mengalami PHK karena melakukan kesalahan berat  berhak mendapat  uang penggantian hak 1 x ketentuan serta uang pisah. Apabila hak itu tidak diperoleh maka dapat dilakukan upaya hukum secara administrasi atau secara perdata, selama pengadilan hubungan industrial berdasarkan UU No. 2 Tahun 2004  belum terbentuk.

Abstract

The existence of national labor law system guarantees fair is one of legal reform to achieve access to justice. This study aims to analyze whether the system of labor law has given capacity to achieve access to justice as the basis for implementing international labor relations in Asia. The method of this study is a normative legal research with statute approach. The findings support that there was an inconsistency on the substance of the legal structures that affect the low legal culture. The substance of the national labor law systems have not adapted the comprehensive International Labor Organization (ILO) conventions. Less robust system of national labor laws affect access to justice in the weak field of labor in the region.

Abstract

AbstractThe provision of legal aid for Indonesian citizens in need has not been maximally covered by the State. One of the ways in which the State provides legal aid is through a mechanism of free legal aid provided by an Accredited Legal Aid Organization (OBH) to the poor who are facing legal cases. On the other hand, there is an obligation for advocates to provide free legal aid to the poor. The "poor" criteria has not been involving the meaning of marginal society as a whole. This study aims to provide an overview of OBHs steps in providing appropriate legal aid to both subjects, objects and procedures. This legal research is using statute and conceptual approach. The result of this study is that the OBH should have an appropriate framework before deciding a person who will be entitled to legal aid. The steps that can be taken by the OBH are gathering facts to find the initial truth; classifying the nature of legal issues; identifying and selecting relevant legal issues; conducting legal findings relating to legal issues and enforcing the law.  AbstrakPemberian bantuan hukum bagi warga negara Indonesia yang membutuhkan, belum maksimal diberikan oleh Negara. Salah satu cara yang ditempuh oleh Negara dalam pemberian bantuan hukum adalah melalui mekanisme pemberian bantuan hukum secara Cuma-Cuma yang dilakukan oleh Organisasi Bantuan Hukum (OBH) terakreditasi kepada orang miskin yang sedang bermasalah dengan hukum. Di sisi lain terdapat kewajiban bagi advokat untuk memberikan bantuan hukum secara Cuma-Cuma kepada orang miskin. Kriteria “miskin” belum mencakup makna masyarakat marginal secara keseluruhan. Peneltian ini bertujuan untuk memberikan gambaran tentang langkah OBH dalam memberikan bantuan hukum yang tepat sasaran baik subyek, obyek dan prosedurnya. Penelitian hukum ini menggunakan statute approach dan conceptual approach. Hasil penelitian ini adalah OBH harus memiliki kerangka kerja yang tepat sebelum menetapkan seseorang berhak untuk mendapatkan bantuan hukum. Langkah yang dapat diambil oleh OBH, yaitu mengumpulan fakta, untuk mencari kebenaran awal; melakukan klasifikasi hakekat permasalahan hukum; melakukan identifikasi dan pemilihan isu hukum yang relevan; melakukan penemuan hukum yang berkaitan dengan isu hukum dan melakukan penerapan hukum.

Abstract

This study is inspired by the use of Instagram as social media that is liked by Indonesian people. From 265, 4 million Indonesian people in 2018, 120 million people are users of social media. Fifty-three million out of 120 million people are the active users of Instagram in Indonesia. Instead of uploading the daily photos, Indonesian people are fond of posting jokes as the representative of social life. Those jokes use language as the primary medium. The use of words utilizes polysemy and homonymy for showing double meaning, so it represents jokes. This qualitative study uses the data of humorous postings on Instagram. After analyzing the data, it is found that the dominant aspects are polysemy and homonymy. Polysemy is shown by the transfer of meaning, the use of terms, and metaphor. Homonymy is viewed by the usage of language tendency, the use of names or titles, the abbreviation, and the divergence of meaning.

Abstract

The compensation for running a job is to get wages. There is one form of wage protection through minimum wage. The fact is there are still workers who have not earned a wage based on minimum wage after they run their jobs. One of them is the retainers of the court (Abdi Dalem) of Sultan palace of Yogyakarta. This study aims to analyze the validity of the wage system applied to the court servants who accept below the minimum wage. This study applies socio-legal approach. The result of this research is the Abdi Dalem get salaries in the form of “kecuca” which amount is less than the minimum wage of Yogyakarta Province. Sultan Hamengkubuana X should be prosecuted for violation of Article 90 paragraph (2) jo. Article 187 of Law Number 13 Year 2003. The right to pursue of the courtiers has never been implemented because the working relationship between the courtiers and the Sultan is devotion. The sense of service is the soul of the agreement on which the working relationship is based. What has been agreed upon by the parties is binding as the law for the party making it (Article 1338 B.W. (Burgerlijkwetboek). The significance of this research is that the principle of local wisdom which is the basis of working relations can be unleashed. The contribution of this research is the emergence of an understanding that the employment relationship is not solely aimed at earning wages. A sense of tranquility after work becomes the choice of the destination of the courtiers to serve the Sultanate of Yogyakarta

Abstract

Taxpayer data and information from banking and finance institution could be guidance on any development. Therefore, it could be a corrective act to do the law enforcement on increasing Inland Revenue. Financial information exchange regarded to tax interests, besides by demanding way also could automatically way done (Automatic Exchange of Financial Account Information/AEol). Indonesia commitment was manifested by Multilateral Competent Authority Agreement signed after AEOI on 3rd June 2015. Indonesia agreed to start the financial information exchange automatically on September 2018. The followed-up Indonesia government commitment was on 8th May 2017. It had approved the financial information access no.1 2017 legislations as to tax interests. Then, one year later was set to be no.9 2017 legislations.Keywords : Automatic, Exchange, Financial Account
