Abstract

Demokrasi Indonesia tidak menimbulkan perubahan perilaku politik tetapi sebaliknya memunculkan sikap acuh politik yang mengabaikan sisi-sisi moral politik. Agama yang seharusnya menjadi landasan etik politik lebih banyak ditampilkan secara simbolik. Politisi akhirnya menjadi demagog, menaburkan nilai-nilai agama yang tidak diamalkan. Sikap seperti ini pada ujungnya menimbulkan kefrustasian sosial dan menyemai kekerasan atas nama agama. Hal ini disebabkan oleh anggapan kelompok radikal bahwa para penguasa telah melecehkan agama dan layak dijatuhkan dalam cara apapun. Walhasil potret demokrasi menghasilkan kekerasan akibat tampilan politisi dan jawaban singkat yang diberikan kelompok radikal. Dengan demikian, sistem demokrasi Indonesia menjadi rusak dan perlu penataan ulang.

Abstract

Abstrak: Perbincangan tentang jilbab memang tidak pernah berhenti. Seolah mengalami metamorfosis, jilbab di Indonesia berkembang setahap demi setahap. Metamorfosis jilbab di Indonesia ini tidak terlepas dari beberapa hal yang mempengaruhinya antara lain: budaya, tafsir agama, kultur sosial ekonomi dan trend globalisasi. Di Indonesia, jilbab seringkali disamaartikan dengan hijab. Pengertian umum yang berlaku saat ini mengenai hijab adalah pakaian muslimah; kerudung (simple headscarf); atau pakaian longgar yang tak tembus cahaya. Sedangkan ketika berbicara mengenai jilbab, seseorang biasanya mengacu kepada kerudung yang diikatkan pada kepala, dan biasanya dikenakan perempuan muslimah.  Oleh karena itu, tulisan ini dihadirkan tidak hendak memerintahkan perempuan menggunakan jilbab, dan melepaskan jilbab, namun, tulisan ini hendak menegaskan bahwa Jilbab adalah budaya yang telah menjadi ketentuan hukum pada saat itu, dengan kondisi yang lain dengan saat ini, oleh karena pada asalnya adalah sebuah budaya, maka keberadaannya selalu dinamis sesuai dengan ruang dan waktu

Abstract

At first Islamic-either the Koran or the as-Sunnah are not set in concrete, about the recording of marriage. This is different from the verse muamalah that in certain situations instructed to record it. This is sometimes the legitimacy of certain circles for a wedding or marriage is not registered under the hand (Sirri). Demands of development, with a variety of benefit consideration, the Islamic law in Indonesia, set it as in the discussion of this article. Therefore, discourse is also important that the recording of marriage is a way to protect the rights of wives and children. Because Indonesias strong evidence that marriage is a marriage deed itself. Even the public also needs to be given the understanding that marriage is not listed on the side is not legal under the state also is not valid according to religion. Furthermore, from the standpoint of the State legislation, should be given criminal punishment for couples who do marry are not listed. Keywords: nikah sirri, maslahah, pembaruan, pluralisme hukum

Abstract

Islam Indonesia adalah unik, pluralis dan multikulturalis sebagai Islam Nahdlatul Ulama, Islam Muhammadiyah, Islam Syiah, Islam Sunni dan banyak lagi yang memiliki konsekuensi beragam bagi para pengikutnya. Faktanya, keberagaman terus menghadapi tantangan. Tuduhan terhadap moderat dan multikulturalisme melalui kekerasan dilakukan oleh aktor individu, organisasi massa, dan institusi paling otoritatif yang seharusnya menjadi penjamin moderatisme agama dalam kerangka keindonesiaan. Pada level ekstrem, perlawanan dimanifestasikan dalam serangkaian tindakan intoleran seperti pengusiran. Tulisan ini bertujuan untuk mempresentasikan bagaimana strategi kehidupan dalam nuansa multikultural dari perspektif hukum Islam. Gagasan fikih yang peka terhadap multikulturalisme menjadi penting bagi umat Islam di Indonesia untuk memiliki keragaman perspektif dalam kehidupan sehari-hari.

Abstract

In the contemporary Islamic discourse in Indonesia, an Islamic movement initiated by a group of young muslim intelectuals emerged which offered a new paradigm in comprehending Islamic doctrines. The movement naming itself Jaringan Islam Liberal (JIL) carrys some jargons of modern life like pluralism, tolerance, inclussivism, freedom of thought, and human rights.Through sociological approach, this article shows that JIL has played a significant role in dinamizing Islamic discouse in Indonesia. JIL proposed the “individualism” of Islamic thought; it is called “individual autonomy” in Berger and Luckman’s term, and “Islamic liberalism” in Binder and Kurzman’s one. Some methodologies applied by JIL in promoting its ideas are ijtihad freedom, hermeneutics, reactualization of Islamic doctrines, and “al-muhâfazhah ‘alâ al-qadîm al-shâlih wa al-akhdzu bi al-jadîd al-ashlah”.

Abstract

The article below tries to describe early age marriage according to contemporary Islamic Family law. Actually the substance of Islamic family law is to create a social merit for people in the present and the future. Islamic law is humane and always brings mercy to the world. It intends to make the Islamic law remain up to date, relevant and able to respond to the dynamics of the times. The government prohibits early-age marriages by several considerations. Even though, the religion does not limit the age of marriages, but it also has a positive value. Such a problem is quite a dilemma. Therefore, in such a context Islam is a mercy to the universe, including Indonesia, the grounding of Islamic law in the faces that follow the movement of the people of Indonesia to follow the motion flow of the Indonesian people to be a necessity. Thus, in the view of the author, in the Indonesian context, the grounding of values of Islamic law, or, more precisely, the adaptation of Islamic law in the social change of Indonesian people. It can be used as a counter towards the practice of early-age marriages that are in fact still be mistaken by most Indonesian society. Thus, the assumption that early-age marriages are permitted by religion but not permitted under the law is wrong and is the form of ignorance about the history of the building concept of the establishment of syari’ah law in general, the history and formation as well as the enactment of the Act No. 1 in 1974 in particular, as well as the understanding and dissemination of the concept and application of the Indonesian Fiqh. Abstract

Islamic militant group is arguably followed by laymen circle is. Change of movementis condusted by this group. This group tries to gain support from university students as a new agent which is assumed by this group to be able to change movement pattern. Spreading of Islamic radical group in the area of student is not apart from striving for caderization of intllectual group in Islamic fundamentalist circle. This strategy is an indoctrination of ideology which caused student feels difficult to cut his relation to this group. This phenomenon finally forms a new metamorphosis to a new Islamic radical movement in campus.

Abstract

Masnun Tahir   Dosen IAIN Mataram dan Kandidat Doktor UIN Sunan Kalijaga Yogyakarta         ABSTRACT   The trend apparent in recent years is the emergence of attitudes haste and carelessness by the people as well as certain institutions in giving fatwas. Such a situation is very worrying because most of the issues they raised pertained risky. They are very easy to determine the position of "halal" or "haram" to something, when in fact they do not pay attention to ethics in giving fatwa and have no qualifications or authority as a mufti (experts fatwa). This trend is something that must be straightened. Fatwas as a method in the Quran and Sunnah to explain Syari’ah law, can not be done by the person or entity which has no religious authority. So also a mufti must pay attention to ethics and the requirements as a mujtahid. Because, if not so, he would easily slip in error. This paper, discusses clearly how the position of the fatwa in Islam and in human life, academic requirements and scientific ethics for a mufti.   Kata-kata Kunci: Fatwa, Etika, otoritarianisme, otoritatif.
