Abstract

Demographically, Indonesia is the fourth largest country in the world, yet international migration is a meager issues and only recently becoming a hot policy debates on the problem of migrant workers protection. The huge demand for domestic workers since the mid 1980s from the Gulf countries, Malaysia, Singapore and Hong Kong, continue unabated, increasingly creates tensions between the state and the civil societies, as many migrant workers exposed to exploitation and human right abuses. The center of the tension lays on the wide discrepancy between the policy to bolster the overseas labor and the failure of the state in providing a proper regulation in which protection for migrant workers is secured. To understand the current problems of overseas labor policy in Indonesia is necessary to trace the relationship between migration and the state and the history of state policy on migration. Assessing the role of stakeholders in this migration industry is important in able to understand the apparently lack of grasp and continuously reactionary and ad hock nature of the policy and related regulations. Abstract

The natural resources management in Indonesia has been overburdened with problems, starting from legislation problems to the impacts of their exploitations to the people and environment. The absence of uniformed national paradigm due to overlapping and multi-interpretation legislation have worsened the problems. The establishment of the Indonesian Constitutional Court in 2004 has brought a new hope to unfold the mess. However, as this writing reveals, the “interpretation” of the Constitutional Court on different types of management of natural resources has caused the policy on natural resource management even more complicated. The “stream” that the Constitutional Court follows seems to be no different than the political economy pragmatism, which was also followed by the current government.

Abstract

Serikat Pekerja di Indonesia seolah menemukan kembali “semangat”nya setelah masa reformasi. Aktifitas Serikat Pekerja yang di rejim sebelumnya sangat terbatas mulai bangkit dan kembali menyuarakan hak-hak pekerja. Namun demikian, kebangkitan Serikat Pekerja ini tidak berarti tanpa kendala, terutama apabila pelaksanaannya disandingkan dengan pedoman yang diberikan dalam hokum internasional khususnya dalam Konvensi-konvensi ILO. Dalam artikel ini dibahas berbagai bentuk kendala yang dihadapi Serikat Pekerja di Indonesia seperti kriminalisasi aktivis Serikat Pekerja dan pengerahan massa dalam menghadapi aksi-aksi Serikat Pekerja. Serikat Pekerja sebagai ujung tombak pemenuhan hak-hak dasar pekerja di Indonesia menjadi penting di tengah menurunnya kondisi ekonomi yang seringkali dijadikan alasan banyak pengusaha untuk tidak memenuhi hak pekerja. Metode yang digunakan adalah studi pustaka dan analisa media. Dari studi ini ditemukan beberapa ‘tren’ sikap diskriminasi anti-serikat pekerja, meski beberapa diantaranya bukan merupakan bentuk yang baru seperti kriminalisasi aktivis serikat pekerja, pembentukan serikat pekerja “bayangan”, penyerangan terhadap aktivis serikat pekerja, intimidasi pada pekerja, mekanisme registrasi yang masih berbelit, dan respon pasif atas laporan-laporan tindakan diskriminatif yang diterima aktivis dan anggota serikat pekerja. Abstract

Perkembangan dan proses reformasi konstitusi di suatu Negara tidak bisa terlepas dari pengaruh konsep-konsep global di antaranya adalah konsep hak asasi manusia. Konsep hak asasi manusia merupakan suatu konsep yang paling penting peranannya dan paling banyak diadopsi di abad ini. Namun demikian dalam proses adopsi ke dalam konstitusi suatu negara, konsep ini mengalami lagi proses ‘adaptasi’ sejalan dengan situasi politik dan sosial-budaya di Negara penerima. Hal ini diperlihatkan dalam proses reformasi konstitusi yang dilakukan di dua Negara Asia yang berada dalam situasi transisi demokrasi yaitu Thailand dan Indonesia. Dari perbandingan dua negara ini ditunjukkan bahwa tidak akan ada dua Negara yang mengadopsi konsep hak asasi manusia yang serupa secara substansial. Di dalam perjalanannya konsep ini akan mengalami interpretasi, modifikasi -dan bahkan mengalami perubahan- yang pada akhirnya akan menghasilkan sebuah konsep hak asasi manusia yang memiliki karakteristik yang khusus.

Abstract

Recently, we are witnessing the vast expansion of the use of social methods in law research. The so-called socio-legal research is one way of using scientific methodologies in social science disciplines (such as sociology, anthropology, economics, language) to find answers for legal problems. In this paper I would like to unfold how these methods influence the legal reasoning in legal research, to what extent they can be used or even to be misused. Law, is a specific subject, in which law text are authoritative in nature, which makes it having its own particularities that differs it from other texts. As an authoritative text, approach to law is narrowed as it supposed to maintain the certainty of the law itself. However, legal problems do not always concern with merely legal text, it also touches many aspects of the societies, which for this part, law needs approaches from other social sciences methods. In this writing, legal research methods are differentiated based on the user of the information it will provide. Keywords: legal research, socio-legal studies, interdisciplinary studies
