Abstract

Tujuan penelitian adalah untuk mengetahui  existing  condition tata ruang  yang digunakan Kabupaten Kutai Kartanegara, untuk mengetahui kebijakan Pemerintah Kabupaten Kutai Negara dalam penataan ruang . Dalam penelitian ini digunakan metode  Empirical Research on Law (ELR). ELR seeks to understand and explain how law works in the real world.Adapun sifat penelitiannya deskriptif developmental yang memberikan gambaran secara sistematis terhadap obyek yang akan diteliti, selanjutnya disusun model yang dapat dikembangkan untuk mengatasi problema dilapangan. Pendekatan penelitian menggunakan pendekatan kualitatif. Lokasi penelitian meliputi Kabupaten Kutai Kartanegara. Dari Hasil penelitian dan pembahasan dihasilkan dua kesimpulan, yaitu : pertama, Kondisi existing Penggunaan tanah di Kabupaten Kutai Kartanegara untuk bermacam – macam kegiatan diantaranya yaitu : . Kegiatan pertambangan , Kegiatan Kehutanan , Kegiatan Perkebunan, kegiatan pertanian. Terjadi pengalihan fungsi lahan yang meningkat dari tahun ketahun Kedua, Pemerintah Kabupaten Kutai Kartanegara telah membuat Draft Rancangan Peraturan Daerah Kabupaten Tentang RTRW maupun Zonasi Kabupaten Kutai Kertanegara, hanya saja belum bisa diajukan dalam pembahasan dengan DPRD karena Peraturan Daerah Propinsi tentang RTRW maupun zonasi Provinsi Kalimantan Timur belum ada.

Abstract

The aim of this research is to describe the regulation of Baluwarti land. As agreement between Surakarta government, Baluwarti society and keraton Surakarta relatives about the meaning of keraton Surakarta and the property of Baluwarti land. This research uses quality method with socio-legal study approach. The data consist if primary and secondary sort. The sources of the first data are keraton Surakarta relatives, the apparatus of Surakarta government and Baluwarti society, while the second are public and personeal data and the legally data. There were two ways to teke the primary data, namely observation and interview. Secondary had been gathered through library study, analysis of document, archives, primary and secondary legal data. Trianggulation method had been used to check the validity of data. The analysist consist of three ways used in the same moment, namely data reduction, data serve and verification. The interpretation had been used to understand the meaning of the information and the relation among it. The composition of the meaning relation depents on the thougt frame of the informant. As result of the discussion of this research is the harmonious opinion between Surakarta gavernment, Baluwarti society and keraton Surakarta reltives thet keraton Surakarta is the adat institution. It is also the guardian of Javanese culture and the tourism destinatiun. Each of them uses legal culture of Javanese as their frame of opinion. The opinion of part of keraton Surakarta relatives that keraton Surakarta is the governance center can’t be received. Such opinion isn’t compatable with the aspiration of Surakarta government and Baluwarti society. It is also able to cause the social violetry. There is a different opinion between keraton Surakarta relatives, government of Surakarta and Baluwarti society about the meaning of property of Baluwarti land. According to Baluwarti society and Surakarta government, Baluwarti land is the state property. On the other side, as for keraton Surakarta relatives, Baluwarti land is Sinuhun property delegated to Parentah Keraton Surakarta. But actually the three sides have the same interest. All of them hope that the existention of keraton Surakarta can give them economic constribution. The same interest is the foudation of the regulation of Baluwarti society as the cultural guardian. The source of Baluwarti land is the nation property, while Surakarta government regulates the relation between Sri Susuhunan and keraton relatives, person and corporation with Baluwarti land. The owner of Baluwarti property is Sri Susuhunan as the chief of keraton Surakarta relatives.

Abstract

AbstractThe objective of research was to find out the existing condition of spatial layout the Kutai Kartanegara Regency’s Government used and to find out the policy of Kutai Kartanegara Regency’s Government in spatial layout. In this research, Empirical research on Law (ELr) was used. ELr seeks to understand and explain how law works in the real world. This study was a descriptive developmental one providing a systematical description on the object to be studied, and then a model was developed to address the problems in the field. The research approach used was qualitative approach. The research was taken place in Kutai Kartanegara regency. From the result of research and discussion, two conclusions could be drawn. Firstly, the existing condition of land use in Kutai Kartanegara regency showed the land use for various activities such as: mining, forestry, gardening, and farming. The shift of land function increased over years. Abstract

AbstractThis article aims to identify and analyze accountability principles in complete systematic land registration rules. The existence of a program from the government to hold a mass certification throughout the territory of the Unitary State of the Republic of Indonesia against the object of land that has not been registered. The research method used is normative which is peskriptif with approach of Act (statue approach). To know the performance of the implementation of this land registration by using indicators of public service based on general principles of good governance, one of which is the principle of accountability. The result of this research is to know the implementation of accountability principle in land registration systematically based on Regulation of the Minister of Agrarian Affairs and Spatial / Head of National Land Agency Number12 Year 2017 on Accelerated Complete Systematic Land Registration.Keywords: Mass Certification; Complete Systematic Land Registry; PTSL, Principles of Accountability AbstrakArtikel ini bertujuan untuk mengetahui dan menganalisis asas akuntabilitas dalam peraturan pendaftaran tanah sistematik lengkap. Adanya program dari pemerintah untuk mengadakan pensertifikatan massal di seluruh wilayah Negara Kesatuan Republik Indonesia terhadap objek tanah yang belum terdaftar. Metode penelitian yang digunakan adalah normatif yang bersifat peskriptif dengan pendekatan Undang-Undang (statue approach). Untuk mengetahui kinerja dari pelaksanaan pendaftaran tanah ini dengan menggunakan indikator pelayanan publik berdasarkan asas-asas umum pemerintahan yang baik yang salah satunya adalah asas akuntabilitas. Abstract

AbstractThis article aims to find out and analyze the existence of indigenous peoples rights over Tembawang Adat Forest, Melawi Regency West Kalimantan Province after the enactment of Constitutional Court Decision No 35 / PUU-X / 2012. This article is an approach of the law. The legal materials used are primary legal materials and secondary legal materials. The technique of legal material analysis uses deduction with syllogistic method. The results of this article shows that the Melawi District has not given recognition to the existence of indigenous and tribal peoples. This is indicated by the absence of legal products that regulate the existence of customary law community in general or specific. Due to the absence of legal product regulating, Melawi Regency is prone to agrarian conflict with indigenous and tribal peoples.Keywords: Existence of Rights of Indigenous Peoples; Decision of the Constitutional Court Number 35 / PUU-X / 2012; Indigenous; Indigenous Forest AbstrakArtikel ini bertujuan untuk mengetahui dan menganalisis eksistensi hak masyarakat adat atas Hutan Adat Tembawang, Kabupaten Melawi Provinsi Kalimantan Barat setelah berlakunya Putusan Mahkamah Konstitusi No 35/PUU-X/2012. Pendekatan artikel ini adalah pendekatan undang-undang. Bahan hukum yang dipergunakan adalah bahan hukum primer dan bahan hukum sekunder. Teknik analisa bahan hukum menggunakan deduksi dengan metode silogisme. Hasil penelitian menunjukkan bahwa Kabupaten Melawi belum memberikan pengakuan terhadap eksistensi masyarakat hukum adat. Hal tersebut ditunjukkan dengan belum adanya produk hukum yang mengatur keberadaan masyarakat hukum adat baik secara umum maupun spesifik. Abstract

AbstractThis articel find and analyze the legislation of the implementation of the conversion of agricultural land to non-agricultural industrial area Nguter in Sukoharjo regency to balance the interests of food and industry sector. Further study on the justice aspects of the conversion of agricultural land to non-agricultural areas of Nguter Industrial Area in Sukoharjo Regency in balancing the interests of the food and industrial sectors. The research method used is normative which is peskriptif with approach of Act (statue approach). To know and analyze used among others the principle of legality, theory of bureaucratic theory stuffen, and theory of justice. The results showed that the national legislation is sufficient in balancing the agricultural sector and industrial sector, but in terms of local policy with the local regulation number 14 of 2011 on the spatial plan and Regulation of Sukoharjo Regent No. 67 of 2011 on Space Utilization Permit still unable to balance the agricultural sector as well as the industrial sector. Implementation of agriculture land conversion to nonagricultural areas Nguter Industrial Estate has not fully fulfilled the justice aspect as it tends to increase economic growth from industrial development, although the amount of rice production tends to increase but as population growth keeps increasing and agricultural land keeps decreasing significantly, come food needs can not be fulfilled.Keywords: conversion of agricultural land, justice aspect; Spatial Plan; food; industry AbstrakArtikel ini bertujuan untuk mengetahui dan menganalisis peraturan perundang-undangan pelaksanaan alih fungsi lahan pertanian ke non pertanian Kawasan Industri Nguter di Kabupaten Sukoharjo untuk menyeimbangkan kepentingan sektor pangan dan industri. Kajian selanjutnya mengenai aspek keadilan pelaksanaan alih fungsi lahan pertanian ke non pertanian Kawasan Industri Nguter di Kabupaten Sukoharjo dalam menyeimbangkan kepentingan sektor pangan dan industri. Metode penelitian yang digunakan adalah normatif yang bersifat peskriptif dengan pendekatan Undang-Undang (statue approach). Untuk mengetahui dan menganalisis digunakan antara lain prinsip legalitas, teori stuffen teori birokrasi, dan teori keadilan. Hasil penelitian menunjukan bahwa peraturan perundang-undangan secara nasional sudah cukup dalam menyeimbangkan sektor pertanian dan sektor industri, namun dari segi kebijakan daerah dengan adanya peraturan daerah nomor 14 tahun 2011 tentang rencana tata ruang wilayah dan Peraturan Bupati Sukoharjo Nomor 67 tahun 2011 tentang Izin Pemanfaatan Ruang masih belum mampu untuk menyeimbangkan sektor pertanian maupun sektor industri. Pelaksanaan alih fungsi lahan pertanian ke non pertanian Kawasan Industri Nguter belum sepenuhnya memenuhi aspek keadilan karena lebih cenderung meningkatkan pertumbuhan ekonomi dari pembangunan industri, meskipun jumlah produksi padi cenderung meningkat namun karena pertumbuhan penduduk terus meningkat dan lahan pertanian terus menurun secara signifikan, maka di di masa datang kebutuhan pangan bisa tidak terpenuhi.Kata Kunci: alih fungsi lahan pertanian; aspek keadilan; Rencana Tata Ruang Wilayah; pangan; industri.

AbstractThe purpose of this article was written to know the method of judge in deciding the case of Sale and Purchase of the right of the Foundation Foundation Blocked in Banjar Sari Sub-district, Surakarta City (Analysis of Decision of the Surakarta Negotiation Court Number 199 / Pdt.G / 2010 / PN.Ska This research is Normative. data use, literature study and interviews to find the rule of law, legal principles, to answer the legal issues encountered The method of data analysis using several stages starting from data collection, data analysis and final taking conclusions In deciding a case the judge has a role very important because the judge is a milestone for the existence of justice The process or method to take a decision in a legal case must also be examined The method used by Judge in deciding Case Number 199 / Pdt.G / PN.Ska is degan mengedapankan Consideration of consideration judge in the presence of proof or truth only formally and beside it is material proof or truth. That in this Case pursuant to Article 1337 of the Civil Code provides that a cause is prohibited, where prohibited by law, or when contrary to good morals or public order. This method provides an opportunity for judges to undertake legal discoveries on the grounds that if the law establishes certain things for a particular event, the rules are limited to that particular event and for events the opposite is true.Keywords: Legal Discovery method, buying and sellingAbstrakTujuan ditulisnya artikel ini untuk mengetahui metode hakim dalam memutus perkara Jual Beli hak atas Tanah Yayasan Terblokir Di Kecamatan Banjar Sari Kota Surakarta ( Analisis Putusan Pengadilan Negri Surakarta Nomor 199/Pdt.G/2010/PN.Ska. Penelitian ini bersifat Normatif. Metode pengumpulan data menggunakan,studi kepustakaan dan wawancara dengan menemukan aturan hukum, prinsip-prinsip hukum, guna menjawab isu hukum yang dihadapi. Metode analisis data menggunakan beberapa tahapan mulai dari pengumpulan data, analisis data dan terakhir pengambilan simpulan. Dalam memutuskan suatu perkara hakim mempunyai peranan yang sangat penting. Hal tersebut karena Hakim merupakan tonggak untuk adanya keadilan. Proses atau metode untuk mengambil sebuah keputusan dalam suatu perkara hukum pun harus dicermati. Metode yang digunakan Hakim dalam memutus Perkara Nomor 199/Pdt.G/PN.Ska adalah degan mengedapankan Pertimbangan pertimbangan hakim dengan adanya bukti atau kebenaran formil saja dan mengesampingkan bukti atau kebenaran materiil. Bahwa dalam Perkara ini sesuai dengan Pasal 1337 Kitab Undang-Undang Hukum Perdata mengatur bahwa suatu sebab adalah terlarang, apabila dilarang oleh undang-undang, atau apabila berlawanan dengan kesusilaan baik atau ketertiban umum. Metode ini memberikan kesempatan kepada hakim untuk melakukan penemuan hukum dengan pertimbangan bahwa apabila undang-undang menetapkan hal-hal tertentu untuk peristiwa tertentu, berarti peraturan itu terbatas pada peristiwa tertentu itu dan bagi peristiwa diluarnya berlaku kebalikannya.Kata Kunci : metode Penemuan Hukum, jual beli

Abstract

Abstrak Artikel ini bertujuan untuk mengetahui dan menganalisis implikasi hukum pembuatan akta pemindahan hak atas hak milik atau hak guna bangunan untuk rumah susun bagi warga negara asing. Selain itu juga untuk mengetahui dan menganalisis konsep asas pemisahan horizontal dalam peraturan perundang-undangan mengenai rumah susun bagi warga negara asing. Penelitian ini merupakan penelitian hukum doktrinal atau normatif yang bersifat perspektif dan terapan. Pendekatan dalam penelitian hukum ini adalah dengan menggunakan pendekatan undang-undang. Tehnik analisa bahan hukum dalam penelitian ini bersifat deduksi dan menggunakan metode silogisme guna memperoleh bahan hukum dalam penelitian ini. Berdasarkan hasil penelitian hukum ini, dapat disimpulkan bahwa penerapan asas pemisahan horizontal dalam peraturan perundang-undangan hukum pertanahan khususnya rumah susun tidak konsisten, sehingga menyebabkan permasalahan kepemilikan rumah susun bagi warga negara asing. Dimana dalam peraturan pertanahan di Indonesia, warga negara asing hanya boleh memiliki rumah susun di atas tanah hak pakai sehingga hal ini menyebabkan pembuatan akta pemindahan hak atas hak milik atau hak guna bangunan untuk rumah susun bagi warga negara asing secara langsung yang dilakukan oleh pejabat pembuat akta tanah berakibat batal demi hukum.Kata kunci : Rumah Susun; Warga Negara Asing; Asas Pemisahan Horizontal
