Abstract

Penelitian ini bertujuan untuk menganalisis dan mengkaji interaksi politik dan hukum dalam penyusunan legislasi daerah di Dewan Perwakilan Rakyat Daerah Kota Surakarta. Akan diuji konseptualisasi yang lazim diterima bahwa ada interaksi antara hukum dan politik dalam proses legislasi, sehingga perspektif yang digunakan adalah hukum tidaklah sekedar pengertian normatif, akan tetapi merupakan resultan yang dipengaruhi oleh tata interaksi dengan faktor-faktor lain. Penelitian ini merupakan penelitian hukum empiris yang bersifat deskriptif. Cara memperoleh data dilaksanakan dengan studi pustaka dan wawancara. Sebagai obyek pengamatan, maka dilakukan kajian dan analisis terhadap Peraturan Daerah Kota Surakarta yang dihasilkan kurun 2005-2010 dan untuk riset ini, dilakukan pemilahan ke dalam 3 rumpun yaitu Peraturan Daerah yang terkait dengan Pemungutan dan Perizinan, Aktivitas Pemerintahan, dan Sosial Kemasyarakatan. Berdasarkan hasil penelitian bahwa Peraturan Daerah dalam rumpun aktivitas pemerintahan mempunyai pola yang sama terhadap masalah interaksi politik dan hukumnya dibandingkan Peraturan Daerah dalam rumpun pemungutan dan perizinan. Kesamaan itu nampak dalam Pada saat rapat kerja dengan Perangkat Daerah inilah interaksi sistem politik yang sebenarnya terjadi. Dalam interaksi tersebut akan terjadi proses tawar-menawar dan adu argumentasi dalam rangka memperoleh kesamaan persepsi antara Panitia Khusus dengan Perangkat Daerah terhadap substansi Rancangan Peraturan Daerah. Abstract

Constitution is the supreme law ofthe land and become the highest law in the legal systemofa nation. The conservative study explaining that the function ofthe constitution is to give and control the power of state. Its success to discribe in the normal situation but failed to give the information about the function from the constitution in the transition periodewhen a state changes from the  utharitarianism to democra tization. In order to get the newperspective related with study ofthe constitutional law, the modern study showed that some characters of the constitution. Some related with the transitional model but the others cases be discribed the various factors in the democratization process. There are three characters of the contitution: critical, restorational, and residual. The critical constitution contained manynorms that exchange the new order government deffirent from the old rezim. The restorational one substance the legal system in Oder to come back to the ancient rezime before the otoritariansm condition. Last, the residual one contained the political mechanism as a continued the ancient rezime. In the same frame, the 1945 Constitution, thathave amanded by PeoplesConsultative Assembly (MPR) show the multicharacter as a critical, restorational, and residual constitution. The are many factors be influenced in the transitional process in Indonesia.

Abstract

This article effort to describe the problem ofthe local development planning system under the Law Nr. 25 2004 andthe Law Nr. 322004. The political will of the national government to give the strong legal certainty with the local development planning system motivied by the decentralization policy and the mechanicm constitutional that eliminated the State Policy Outlines (GBHN, Garisgaris Besar Halauan Negara). The regulate model about local development planning system in the the Law Nr. 25/2004 and the Law Nr. 32/2004 are different. Some problem relation with the political interest when the law promulgated and the others are relation with the substance oflaw.

Abstract

Penelitian ini mengkaji tentang penetapan harga eceran tertinggi sebagai intervensi pemerintah untuk mewujudkan hak konstitusional atas kedaulatan pangan dalam perspektif Negara Kesejahteraan. Pangkal argumentasi adalah ketersediaan pangan yang cukup akan menentukan kualitas sumber daya manusia dan stabilitas sosial politik sebagai prasyarat untuk melaksanakan pembangunan. Pangan merupakan variabel penting yang bisa digunakan untuk memperkuat basis material negara, sebagai sarana menjalankan fungsi reproduksi sosial sekaligus penentu keberlangsungan hidup sebuah bangsa. Dengan memperhatikan peraturan perundang-undangan, pemerintah mempunyai pedoman dalam menetapkan kebijakan harga dengan tujuan untuk stabilisasi harga termasuk terhadap komoditas pangan. Pembahasan dilakukan dengan menggunakan penelitian hukum normatif, yang merupakan sebuah penelitian yang mengkaji studi dokumen, yakni menggunakan berbagai data sekunder seperti peraturan perundang-undangan, putusan pengadilan, teori hukum, dan dapat berupa pendapat para sarjana. Hasil eceran tertinggi merupakan perbuatan pemerintah (bestuurhandeling) sebagai salah satu contoh intervensi negara dalam rangka mewujudkan hak konstitusional atas kedaulatan pangan. Kebijakan tersebut bertujuan menstabilkan harga pangan, mengurangi ketidakpastian petani, dan menjamin konsumen. Dalam hal ini, setiap warga negara akan memperoleh pangan yang cukup dengan harga yang wajar.This paper discusses the determination of the highest retail price as a government intervention to realize the constitutional right to food sovereignty in the perspective of the Welfare State. The basis of the argument is that sufficient food availability will determine the quality of human resources and socio-political stability as a prerequisite for carrying out development. Food is an important variable that can be used to strengthen the country's material base, as a means of carrying out the function of social reproduction as well as determining the survival of a nation. By paying attention to the laws and regulations, the government has guidelines in setting price policies with the aim of stabilizing prices including food commodities.The discussion was conducted using normative legal research, which is a study that examines the study of documents, namely using various secondary data such as legislation, court decisions, legal theories, and can be in the form of opinions of scholars.The results of the discussion show that the government's actions in determining the highest retail price are the government's actions (bestuurhandeling) as one example of state intervention in order to realize the constitutional rights to food sovereignty. The policy aims to stabilize food prices, reduce farmers' uncertainty, and guarantee consumers. In this case, every citizen will get enough food at a reasonable price.

Abstract

The Regional Election Commission has the responsibility to increase the participation of disabled voters in local legislative elections. Democratic elections at the local level are characterized by the enthusiasm of disability voters in the election. The purpose of this paper is to map out legislation on the protection and respect of disability voters, to explore some of the constraints facing electoral voters in the election, and to examine the policies and obstacles faced by the The Regional Election Commission in an effort to increase voter participation in disability. This study uses socio-legal research methods, ie research that is interdisciplinary to provide a meeting room between the science of law and the sciences outside the law. The results show that, there are international law and national laws. Barriers facing disability voters include: theoretically there is no uniformity about the disability study; the culture of the people who tend to stigmatize the bad, not counting the right to vote; lack of accurate data of disability voters. The policies made by the The Regional Election Commission in increasing the participation of disability voters are: to implement Article 1 number 25 and Article 149 of Law No. 8 of 2012 on General Election of Members of DPR, DPD and DPRD. While the obstacles, namely: the weakness of family and community awareness; lack of human resources capacity of voter registration officers and data on the List of Potential Voters of Electoral Residents (DP4) does not mention information about disability.

Abstract

This paper aims to describe socio-juridically the performance of courts in authoritarian circles of power. The court is increasingly demanded attention by academics of constitutional law, along with the expectation of a role in the presence of power. Courts, of course by involving judicial apparatus, especially judges, are controlled by the executive but are able to negotiate their functions to support the government. Courts can provide legitimacy both internally and externally as well as being an effective tool for maintaining power. On this side, every regime of power has an interest of the court. Therefore, the idealita of the court then also related with independence, which is not only for the rule of law, constitutionality and human rights, but also in relation to globalization, free and efficient economic activities. If the judges are independent, they are basically protected from undue influence from those who can damage their impartiality. With variations that are not the same, but working in the same circle of power, courts in Singapore and Pakistan confirm these matters. Abstrak Tulisan ini bertujuan untuk mendeskripsikan secara sosio yuridis kinerja pengadilan dalam lingkaran kekuasaan yang otoritarian. Pengadilan semakin dituntut perhatiannya oleh akademisi hukum tata negara, seiring harapan akan peran di hadapan kekuasaan. Pengadilan, tentu saja dengan melibatkan aparatur peradilan, terutama hakim, dikendalikan eksekutif akan tetapi mampu menempatkan negosiasi fungsi mereka untuk mendukung pemerintah. Pengadilan bisa memberikan legitimasi secara internal maupun eksternal sekaligus menjadi alat efektif untuk mempertahankan kekuasaan. Pada sisi ini, setiap rezim kekuasaan berkepentingan dengan pengadilan. Oleh sebab itu, idealita pengadilan kemudian juga berurusan dengan independensi, yang tidak hanya untuk supremasi hukum, konstitusionalitas, dan hak asasi manusia, tetapi juga dalam kaitannya dengan globalisasi, kegiatan ekonomi yang bebas, dan efisien. Jika hakim independen, mereka pada dasarnya dilindungi dari pengaruh yang tidak semestinya dari pihak-pihak yang dapat merusak ketidakberpihakan mereka. Dengan variasi yang tidak sama, namun bekerja dalam lingkaran kekuasaan yang sama, pengadilan di Singapura dan Pakistan memberikan konfirmasi atas hal-hal tersebut.

Abstract

Background: Circumcision is one of the surgical practices often performed by nurses in rural and urban areas. Minister of Health Decree No. 1239 of 2001 on the registration and practice of nurses has not provided clarity on the limits of authority and legal protection for certain nurses. Many nurses provide services in the community that are not in accordance with the rules and authority.Subjects and Method: This was a normative study with statute, case study, and conceptual approach. Legal materials were collected using document review. Legal materials were analyzed by describing the problem under study.Results: Article 65 of Law Number 36 the Year 2014 on Health Personnel provides delegation of authority from the doctor to the nurse if the doctor cannot perform a medical service, provided that the physician is obliged to provide clear written authority delegation to perform the medical service. Regulation of the Minister of Health of the Republic of Indonesia No. 17 of 2013 on Amendment to Regulation of the Minister of Health No. Hk.02.02/Menkes/148/I/2010 Concerning Permits and Implementation of Nurse Practices states that medical service can only be delivered based on written request from the doctor. Regulation of the Minister of Health of the Republic of Indonesia Number 17 the Year 2013 Concerning Amendment to Regulation of the Minister of Health No. Hk.02.02/Menkes/148/I/2010 Concerning Permission and Implementation of Nurse Practice Article 3a authorize Nurses to undertake nursing practice in health-care facilities outside of the solo practice.Conclusion: Legal construction for nurses who practice circumcision provides legal certainty in the rules relating to solo practice so that there is a law protection. Ministerial Regulation does not have binding power. Criminal Legal Accountability on Medical Privacy Violations

Abstract

Background: The secret of medicine or medical secrets is the right of the patient, this secret is a moral obligation based on the norms of decency originating from Hippocratic oaths, maintaining the secret of medicine is the duty of doctors to carry out their duties and practices. This provision is regulated in Article 48 of Law Number 29 of 2004 concerning Medical Practice, if this secret is leaked it can be held liable for violators. The purpose of this study was to solve legal issues and at the same time provide a prescription regarding the need for legal sources in the form of primary legal materials and secondary legal materials.Subjects and Method: This was a systematic review with normative juridical methods to solve legal issues.Results: Legal liability for medical secrets in health service facilities can be applied to the Criminal Code (KUHP). Disputes that occur regarding doctors or health personnel are resolved through professional organizations. Doctors through the Indonesian Doctors Discipline Honorary Council (MKDKI) but MKDKI did not have the authority to examine Criminal cases. Violations of medical secrets or job secrets, legal liability is not regulated or not based on legislation in force in the health sector, but the legal liability of violations of medical secrets comes from the general Criminal Code (KUHP).Conclusion: The secret of medicine is the autonomy right of patients. Maintaining the secret of medicine is the duty of doctors to health service facilities, the secret of medicine is not absolute and can be opened in certain circumstances, but this secret can be opened in accordance with the provisions of legislation. Juridical Review of Presumed Consent as the Right of Patients in Emergency Conditions

Abstract

Background: Doctors and patients are two legal subjects who are bound in a therapeutic tran­saction. This transaction involves informed consent. Informed consent is the doctor's obligation and the patient's rights. There are exceptions to the application of informed consent in emergency situations. The doctor is still obliged to provide help even though the patient is in an unconscious condition and cannot give consent to the action. This is known as the Presumed Consent. This study aimed to explore presumed consent as the right of patients in emergency conditions using juridical review.Subjects and Method: This was a normative study with a law approach, case study, and concep­tual approach. Legal materials used are written documents and the results of interviews. The technique of analyzing legal materials by formulating principles and legal understanding and evaluating the results of interviews. Respondents consisted of 6 General Practitioners who worked in the emergency room, ICU, treatment room, and operating room at PKU Muhammadiyah Sukoharjo Hospital.Results: According to article 17 of the medical ethics code (KODEKI) in 2012, every doctor is obliged to carry out emergency assistance as a form of humanitarian duty. This was similar to Article 51 of Law No. 29 of 2004 concerning Medical Practice. Whereas, in article 29 paragraph (1c) of Law No. 44 of 2009 concerning Hospitals it is explained that the Hospital is also obliged to provide emergency care to patients according to their abilities. If the patient is considered unable to be treated, the doctor must refer to a doctor who is more competent after giving emergency care, but if the doctor has been able to take action according to professional standards and procedures, the doctor must provide an explanation after the patient is aware or to the closest family. The results of interviews with general practitioners at Muhammadiyah Hospital in Sukoharjo, Central Java from 6 respondents all stated that patients had the right to get emergency assistance according to the standard even though without written consent from patients and families. After being aware, the patient and/or family will continue to explain information about the condition and follow-up on its handling.Conclusion: In accordance with the laws and regulations on informed consent in emergency conditions or called presumed consent, patients are entitled to immediate emergency assistance and the doctor is obliged to carry out help in accordance with professional standards and procedures.
