Abstract

Abstract: This study aims at analysing further and deeper on the concept of baiinah in Syafii thought construction. There were two research questions to be answered in this study: (1) whether or not Syafii allows the existence of hilah in trading; and (2) whether there are different concepts in which bai nah in hilah is allowed. To answer these questions, hermeneutikadilthey approach was employed in this research. Within this approach, the external and historical factors of a figure's historical life were taken into account. The result of the study indicated that there has been a misconception of how Syafii allowed baiinah. He actually allows the practice of qiyas and was against ulama who did not allow bai nah. The bai nah concept which was allowed by Syafii was not the trading in which contains dual trading intents; rather it was two trading which stand by themselves and did not relate with each other; thus avoiding misunderstanding within the trading process.Abstrak: Penelitian ini dimaksudkan untuk menelusuri secara mendalam bagaimana sebenarnya bai’ ‘īnah dalam konstruksi pemikiran syāfi’ī. apakah benar Syāfi’ī membolehkan satu bentuk jual beli yang di dalamnya ada unsur rekayasa (hīlah)? Atau sebenarnya Syāfi’ī ketika berbicara tentang bai’ ‘īnah dalam konteks yang berbeda dari apa yang dipahami oleh banyak pihak yang memandang Syāfi’ī membolehkan bai’ ‘īnah dalam konteks hīlah? Untuk menjawab masalah tersebut, penelitian menggunakan pendekatan Hermeneutika Dilthey yang berpijak pada asumsi bahwa manusia adalah makhluk historis sehingga eksistensinya sangat bergantung pada faktor sejarah atau faktor eksternal. Dalam pandangan hermenutika ini, kehidupan seseorang dapat dipandang sebagai internalisasi sistem sosial dan sistem sosial lahir sebagai perwujudan individu-individu. Hasil penelitian menunjukkan bahwa pandangan Syāfi’ī yang dicatat oleh banyak pihak membolehkan bai’ ‘īnah dilatarbelakangi oleh kontruksi pemikirannya tentang hukum Islam, dimana konstruksi pemikiran hukum Islamnya dipengaruhi oleh latar belakang kehidupan dan perkembangan pemikirannya pada masanya. Dalam hal ini, Syāfi’ī lebih memenangkan qiyas dan menolak atsar sahabat yang dipegang oleh para pihak yang tidak membolehkan bai’ ‘īnah. Namun demikian, bai’ ‘īnah yang diperbolehkan oleh Syāfi’ī bukanlah bai’ ‘īnah, dimana satu akad jual beli mengandung dua akad jual beli, sebagaimana dipahami oleh banyak pihak selama ini. Bai’ ‘īnah yang dimaksudkan oleh Syāfi’ī sebagai jual beli yang diperbolehkan adalah dua akad jual beli yang masing-masing berdiri sendiri, dimana antara keduanya tidak terkait satu sama lain, sehingga tidak ada unsur rekayasa di dalamnya.

Abstract

Fiqh has always been an important aspect in the live of Muslims. In the beginning of Islam, Muslim did not face problems as experienced by the later generations of Muslims therefore Muslims need to develop fiqh in accordance with  the  current  situation. In this case, philosophy may provide a new perspective in the development of fiqh. This article discusses about historical development of fiqh and how philosophy contributes to it.Keywords: fiqh, philosophy, development

Abstract

This study was aimed: (1) to map socio-economic situation in Kaliurang, (2) to identify the issues that were most felt by the community living in Kaliurang, (3) to know the impact of socio-economic after the water source “Sigintung” controlled by the Municipal Waterworks (PDAM) of Batang Regency, (4) to encourage the initiation to build partnership management of water resources between the community and the stakeholders in Batang, and (5) to obtain alternative management schemes that guarantee the rights of local communities with stakeholders in realizing fair and sustainable management of water resources. The approach taken in this study were: (1) Rapid Rural Appraisal, (2) Participatory Rural Appraisal, and (3) Participatory Action Research. The result of this research shows that the controlling water source “Sigintung” by PDAM bring about apprehensive impact to the local community so that they live in poverty, and this is the issue that is most felt by them. Therefore, they want to solve this problem by initiating partnership management of water resources between them and the stakeholders in Batang, and the result is that now, they can access the water from the PDAM’s water receptacle in water source “Sigintung” directly. In addition, they build water installation and receptacle beside the Musholla to transport water from the receptacle to their houses, even though other expectation cannot be realized due to the stakeholders attending the meeting in Kaliurang were not the managements that can make a decision.

Abstract

People’s refusals and disobediences upon fatwa (released by MUI or ulama with their own opinions), followed by influence decreases of religious figures (ulama) towards Muslim community, were being such of phenomenal realities in Indonesia nowadays. This mass behavior might redefine their perceptions and thoughts about “the legitimate ulama”, according both; syara’ (religious legitimation), and social system. The research was located in Pekalongan Regency, thought-out known as “Kota Santri”, and plenty more, many Pesantren and Kyai have lived there. The result revealed that ulama and Muslim Community mostly had the same perception and view in understanding the meaning of Hadist “al-ulama’ waratsat al anbiya” (ulama are heir of prophets). Ulama’ as informants added ulama’ were religious successor leader after the end of Muhammad’s saw prophetic era. But, in another sides, there were some differences, especially in interpreting social label: Kyai, KH, or Ustadz. Muslim Community mostly thought that a person who had such social label was ulama. Meanwhile ulama noted Kyai, KH or Ustadz was just social label, no more. So, it seemed to be weird and screwy if we looked up the sosial fact of fidelity of Muslim Community in Pekalongan Residence. It also could be said that Muslim community in Pekalongan Residence were standing still their obidiece toward kyai, KH, Ustadz or another ones, not toward ulama yet.

Abstract

However, Nikah Siri (unregistered marital) has been seen asa part of the social behavior, and lived in Indonesian society. Thisbehavior often impact living condition of social structure. In anotherside, this social problem must be fixed with appropriate law-makingsystem. The Act Plan of “Hukum Peradilan Agama Bidang Perkawinan”(RUU HPABP) was noted in commitment to criminalize the behavior.Some sounds of pro and anti toward this Act Plan nowadays, makethis issues more interesting be reseacrhed. Applying symbolicinteractionism approach and labelling theory, this study examined thecriminalization issues on the Act Plan in social framework. The frameworkis critical to assume the effectiveness of law making processbased on people participation. This research took place in PekalonganDistrict (the City and Regency of Pekalongan), which is noted for the‘hidden’ large number of nikah siri practices. Results of the study revealedthe social criminalization of Nikah Siri akin to kinds of people’sperception toward the behavior. The hidden types of Nikah Siri(hidden from people’s knowledge) had an effect on social constructionto criminalize the behavior, but not the open one

Abstract

Dalam ekonomi Islam, air dianggap membawa berkah dari Allah yang memberikan dan mempertahankan hidup, dan memurnikan umat manusia dan bumi. Ini milik masyarakat secara keseluruhan - tidak ada individu secara harfiah memiliki air. Sebagai menopang kehidupan, itu adalah penting untuk mengelola dan mendistribusikan air dengan benar sehingga semua masyarakat dapat mengakses air untuk menggunakannya untuk konsumsi seperti minum dan mencuci, dan produksi seperti pertanian. Sayangnya, pengelolaan air di Dusun Kaliurang Desa Kembanglangit tidak dilakukan dengan benar sehingga masyarakat yang tinggal di sana tidak dapat mengakses air banyak, dan menderita air dan krisis pangan. Artikel ini membahas masalah pengelolaan air ada dalam pandangan ekonomi Islam

Abstract

The implementation of Good University Governance’s principles (accountability and responsiveness), academic culture, academic’s service quality and initiatives in the STAIN Pekalongan’sacademic society was tested in this study. Data werecollected from three main internal stakeholders (students, staffs, and lecturers) usingquestionnaire and their perception differences were analized using non parametric test of difference. The results show that (1) the total averages results placed between 7.34 to 9.89 which means that research variables were at a medium level (2) lecturers’ perceptions differ significantly from bothstaffs and students.

Abstract

Penelitian ini dimaksudkan untuk menelusuri secara mendalam kebebasan ekonomi vis a vis intervensi negara dalam perspektif Ibn Khaldun. Untuk menjawab masalah tersebut, peneliti mengkaji secara langsung dari karyanya al-Muqaddimah, kitab jilid pertama dari Kitab al-‘Ibar yang terdiri dari tujuh jilid. Dalam hal ini, ide-ide yang dituangkan oleh Ibn Khaldun dalam al-Muqaddimah-nya dianalisis dengan menggunakan metode analisis isi atau content analysis. Selain itu, peneliti juga menganalisis pemikiran Ibn Khaldun dengan menggunakan pendekatan sosiologi pengetahuan Karl Mannheim. Hasil penelitian menunjukkan bahwa Ibn Khaldun memang sangat menekankan pentingnya kebebasan ekonomi dari kekangan kekuasaan negara dan sangat menentang intervensi negara yang mengekang kebebasan tersebut demi tumbuh dan berkembangnya perekonomian suatu negara. Namun demikian, kebebasan ini harus mengikuti aturan main, dimana peran negara diperlukan sebagai pelindung dan penegak aturan main tersebut. Berpijak pada teori sosiologi pengetahuan Karl Mannheim, pemikiran Ibn Khaldun dipengaruhi oleh determinasi sosial pengetahuan yang berkembang pada masanya, dan dia juga menggunakan perspektifnya sebagai seorang Muslim dalam menuangkan ide-idenya. Jadi terdapat relasi yang kuat antara pemikiran Ibn Khaldun dengan realitas sosial yang ada. Dengan demikian corak pengetahuan Ibn Khaldun adalah bercorak ideologi, bukan utopia.

Abstract

Penelitian ini bertujuan untuk menguji kualitas pelayanan akademik di Pekalongan STAIN dengan membandingkan siswa harapan dengan persepsi mereka terhadap pelayanan akademik mereka diterima. SERVQUAL instrumen digunakan untuk mengukur kualitas dimensi yang memiliki lima aspek yaitu keandalan, tanggap, jaminan, empati dan bukti fisik. Hasilnya adalah kesenjangan antara harapan dan persepsi. Kemudian, itu diuji apakah kesenjangan ini adalah signifikan atau tidak dengan menggunakan Wilcoxon Menandatangani uji Rank. Langkah selanjutnya untuk menghasilkan berguna analisis bagi para pengambil keputusan dengan menggunakan Kinerja Penting Analysis (IPA). Hasil pengujian menunjukkan bahwa baik semua item atau dimensi memiliki kesenjangan negatif. Ini berarti bahwa akademik kualitas pelayanan di Pekalongan STAIN masih memerlukan beberapa perbaikan.

Abstract

This research was aimed to know whether the interest based-banking system still shadow the sharia based-banking system in the light of that the former operate in a banking industry dominate by interest system.to proof whether it is true or not, it is necessary to do a research that questions whether interest rate of credit and deposit of conventional bank influence margin rate of murabahah finance of Islamic bank in Indonesia. The result showed that in a banking industry environment dominated by interest system, Islamic bank have not yet release from the old system. This is proven by that interest rate of credit and deposit of conventional bank has significance influence to margin rate of Islamic bank Indonesia, either partially or simultaneously, with determination coefficient 53.1%. It means that the contribution of those both variables (interest rate of credit and deposit simultaneously) to margin rate of murabahah is 53.1%. The rest (46.9%) is influenced by other factors.
