Zoning Regulation as Land Use Control Instrument: Lesson Learned from United States of America and Singapore

Abstract

One of local government authorities is the implementation of land use planning. Due to implementation land use planning, controlling is needed as effort for the implementation is appropriate with the planning. According to Spatial Planning Act No.26/2007, land use control instruments are zoning regulation, permit, incentive and disincentive, and sanction. In Indonesia, zoning regulation is new instrument and only a few of city that have made and uses zoning regulation as land use control instrument. Local government has to create zoning regulation and uses it to control land use in their area. Comparative study is needed to learn from other countries that use zoning regulation as land use control instrument successful.United State of America and Singapore are relevant as cases study because of their success in using of zoning regulation. This study used a descriptive approach with literature sources. The results show that: (1) there is similarity between United State of America (USA) and Singapore in success using zoning regulation as instrument of land use control; (2) There is different type of land use control system. Most of cities in USA, except Houston City, use regulatory system. Inthis system, decision for a land use application is only based on zoning regulation. While Singapore uses discretionary system, the owner’s right to develop is controlled, not only by a zoning regulation, but also by a planning authority’s discretion. Abstract

Wilayah pantai/pesisir mempunyai karakter yang spesifik dibandingkan dengan kawasan yang lain. Wilayah ini merupakan agregasi dari berbagai komponen ekologi dan fisik yang saling terkait dan saling berinteraksi. Pembangunan dengan memanfaatkan sumberdaya pantai tanpa memperhatikan prinsip-prinsip ekologis akan dapat merusak fungsi ekosistem pantai.Pengembangan wilayah pada kawasan pesisir sebagaimana pengembangan wilayah pada kawasan lainnya, mempunyai tujuan utama untuk meningkatkan kesejahteraan masyarakat. Kegiatan ini dilakukan melalui perencanaan pengembangan dalam suatu proses yang didalamnya terdapat berbagai pendekatan yang harus diperhatikan.Dewasa ini pembangunan pada kawasan pantai berkembang sangat pesat dan ditunjukkan dengan adanya multi kegiatan, misalnya usaha tambak, nelayan, pengusaha industri, hotel dan rekreasi wisata, dan usaha-usaha. Dengan semakin meningkat dan kompleksitas kegiatan didalamnya maka perlu dilakukan perencanaan pengembangan kawasan pantai/pesisir.Pengelolaan wilayah pantai secara terpadu (Intergrated Coastal ZoneManagement) merupakan kunci bagi pembangunan melalui pemecahan problem dan konflik di wilayah pantai yang sangat pelik dan kompleks.

Abstract

The dynamic of land utilization is related to changes of land function. In this contect, the morphological study is impemented to uncover the changes in land functions in Kampung Luar Batang, Nort Jakarta, Indonesia. Kampung Luar Batang is a historical Kampung which was estabished by VOC in Batavia under the influence of existence of a Moslem missionary, Al-Habib Husein bin Abubakar Allaydrus, and accelerated by the its strategic geographical location close to urban economic centers, Historically, Luar Batang has been a place for laborers settlement, VOC defense port, port of transit for migrants, pilgrimage center and rental dwelling that is surrounded by illegal housing. Each function was not chronologically appeared, but developed in multi-layered manner.In fact the historical meanings of Luar Batang were not obtained through in depth literature study, since the availability of references about the kampung is very limited. This study is an effort to uncover the physical elements of the kampung from historical perspective, based on the maps documentatin and empirical study. The graphical abstraction model presented at this paper is an attempt to clarify the dynamic of land utilization.Keywords : Morphology, Kampung bersejarah, Luar Batang.

Abstract

Earthquake, tsunami and volcanic eruption are some of the various disasters that frequently hit in Indonesia. These disasters impact damage from small to large. These disasters also have a major impact on the balance of community lifes who are victims. Various efforts of reconstruction, rehabilitation and reconstruction are undertaken by governments, communities and various stakeholders. To succeed as expected, these efforts should be based an a spatial plan which is suitable and comprehensive. The spatial planning in disaster prone areas is indispensable in dealing with disasters before, during and after a disaster. Formulation and implementation of spatial plans are turned to face many problems such as limited and the loss of data due to disasters, as well as social and cultural conditions in disaster prone areas. To streamline the implementation of spatial plans and land use control need zoning regulation as a land use control instrument. Therefore, it is necessary to study the role of zoning regulation in the utilization of space and rebuilding in disaster areas prone.This study used a descriptive approach with literature sources. The results show that: (1) The Making of spatial plan on the basis of disaster mitigation in disaster prone areas is indispensable in dealing with disasters, before, during and after a disaster and should be complemented with zoning regulations, (2) The making of spatial plan and zoning regulations in the region after the disaster requires a special approach by modifying the normal procedure, and (3) zoning regulation as a land use control instrument control instrument guides the implementation of various activities related to disaster mitigation and need to be adjusted to the social, economic, cultural and characteristics of each disaster prone areas.Keywords : spatial plan, zoning regulation, disaster prone areas, disaster mitigation.

Abstract

Rapid population growth in Surakarta requires the need for land for housing. Due to limited land available, the fulfillment of housing needs spread to the suburbs around the city of Surakarta. In choosing a home, whether it be consumption or investment, the convenience of individuals or households will have different preferences depending on the characteristics. The purpose of this study is to determine the preferences of housing selection based on the motivation of home purchase and to know the relationship of household characteristics with motivation of home purchase. The method used is quantitative descriptive method with percentage tendency and mean analysis to know housing selection preferences and cross tabulation analysis and Chi-Square test to know the relation between household characteristics and motivation of home purchase. The result of the analysis of housing preferences is, in households that buy houses for consumption, the main preference in housing selection is: 1) the physical condition of the environment (2.84); 2) home financing (2.76); and 3) location and accessibility (2.76). While in households that have motivations for investment, the main preference in housing selection is: 1) the physical condition of the house (2.83); 2) location and accessibility (2.80); and 3) the physical condition of the environment (2.78). Characteristics of households that influence the motivation of home purchase is the level of education (sig. 0.000); households income level (sig 0.001) and housing type (sig 0.006. With the knowledge of housing selection preference based on purchasing motivation, it is hoped that it can be used as input in making policy for the government in housing development especially in fulfilling the needs of housing for the right target, especially for low income people who mostly still have difficulty access to own housing.Keywords: selection of housing, motivation of home purchase, sub-urban area

Abstract

Interaction and linkages between business and information technology (IT) strategies remain a primary concern among executives. This study aims to gain an in depth understanding of how companies achieve alignment and the policy framework that underlies the efforts, particularly those that are associated with the most dominant factor that contributes to the establishment of strategic alignment, namely IT infrastructure flexibility. For that purpose, the study explored four companies engaged in the field of oil, electricity, and communication by adopting interpretive case study. Data were gathered using triangulation methods via field interviews, artifacts, document analysis, as well as direct observation. The textual data were elaborated by an intentional analysis in order to guide the study in exploring the phenomenon. The study identified elements that reflect IT infrastructure flexibilities namely connectivity, compatibility, modularity, IT staff knowledge and skills, and integration. Those elements cover both technical and behavioral dimensions of a company’s components that need to be included in the consideration during the planning phase

Abstract

Dengan ditetapkannya budaya dan tata ruang kota sebagai penanda keistimewaan Yogyakarta dalam UU No. 13 tahun 2012 tentang Keistimewaan Yogyakarta, maka Yogyakarta merupakan kasus spesifik dalam Penataan Ruang, karena aspek Tata Ruang menjadi salah satu penanda Keistimewaannya. Apa yang istimewa. Apanya yang istimewa dang mengapa istimewa; apakah penanda (tata ruang kota), petanda (konsep budaya) atau makna/pesan dari hubungan antara petanda dengan penandanya yang tersirat dalam wujud tata ruang kota Yogya. Penelitian ini berupaya untuk mengenali dan memahami hubungan antara kebudayaan, tata kota dan keistimewaan Yogyakarta. Dari bukti-bukti empiris, kajian tentang kebudayan dan tata ruang kota memerlukan rentang waktu panjang, karena akan menyangkut data longitudinal (diakronik) dan lateral (sinkronik). Oleh karena itu studi ini perlu didudukkan dalam bingkai sejarah dan budaya, untuk membaca peristiwa sepanjang perkembangan kota Yogyakarta, dari HB I sampai HB IX. Kemudian untuk memahami makna kaitan antar penanda dan petanda sepanjang perjalanan perkembangan kota, maka digunakan metoda hermeneutika, khususnya Hermeneutik Paul Ricoeur. Dari hasil kajian terhadap obyek tata ruang kota yang dianggap istimewa, maka budaya yang mewujud dalam keistimewaan tata ruang kota Yogyakarta bisa dilihat dari komponen ruang kotanya maupun konfigurasi fungsi ruang kotanya. Kesimpulan penting dari penelitian ini adalah konsep budaya yang mewujud dalam tata ruang kota, yaitu monumental dan pertahanan, yang tidak ditemui di kota manapun di Indonesia. Kemudian dari sisi makna, terjadi perbedaan makna simbol-simbol tata ruang kota di era HB I dan HB IX.Kata kunci. Kebudayaan, tata ruang kota, budaya, Yogyakarta. Since Yogyakarta’s culture and spatiality were proclaimed as special features of Yogyakarta as stated in Law No. 13, 2012 on the Special Region of Yogyakarta, Yogyakarta is recognized as a specific case in spatial planning, because its spatiality is one of the attributes that make it exceptional. Why is it exceptional and how is it exceptional? Because of its attributes (the space), its signature (the cultural concept), or the meaning/message of the relationship between its attributes and signature, which is implicitly manifested in Yogyakarta’s spatiality? This research was aimed at identifying and explaining the relationship between the culture, spatial planning and special features of Yogyakarta. Research about culture and spatial planning based on empirical evidence takes a long time to complete, because it involves longitudinal and lateral (synchronic) data. Therefore, this study needed to utilize a historical and cultural framework in order to interpret events in the development of the city from the reign of Sultan Hamengkubuwono I to that of Hamengkubuwono IX. Additionally, in order to understand the meaning of the relationship between the attributes and the signature of the city throughout its development, the hermeneutic method of Paul Ricoeur was used. The results of this study of the spatial planning features of Yogyakarta that are considered exceptional reveal the culture that expresses itself in the components and functional configuration of Yogyakarta’s urban space. An important finding from this research is that there is a cultural concept that manifests itself in the city’s spatiality, i.e. monumental and defensive, which cannot be found in any other city in Indonesia. Moreover, it was found that there has been a change in the meaning of the city’s spatial symbols from the era of Hamengkubuwono I to the era of Hamengkubuwono IX. Keywords. Collaborative Planning on Cross-Border Service of Water Supply in Surakarta Urban Border Area, Indonesia

Abstract

Abstract: Recently, many planners apply collaborative planning theory in planning involving two or more parties, such as between government, private and community, including in the inter-region cooperation. However, the theory has rarely been used to explain the interaction between regions in city border area, especially in the cases in Indonesia. This article discusses the case of cross-border service of water supply of the Local Water Company (PDAM-Perusahaan Daerah Air Minum) of Surakarta City into the urban border area of Sukoharjo Regency, based on collaborative planning theory. This article is written based on results of the research on the case using case study research method. The discussion concludes that the approach of collaborative planning theory used on the case is cooperative-accommodation approach. It is because PDAM of Surakarta City accommodate the cross-border region service as a reciprocal policy, as most of their water inputs come from their neighboring regions. In general, such an approach is in accordance with the need of the interacting regions, which one region needs supporting service to meet the need of their communities in water service, and another can fulfill the need based on its capacity. In this case, the concerned technical agencies, PDAM of every region interact each other directly in providing the service. The important thing, the interaction is in line with the prevailing cross-border region bureaucratic regulations and does not infringe the autonomy of every region.Keywords: city border area, collaborative planning, cross-border water supply, Surakarta

Abstract

     Sulaa is one of the coastal villages in Baubau, most people work as fishermen and weaver, therefore the sea is a very important part of their lives. Local Government has reclaimed Sulaa coast as an effort to solve abrasion that was faced by Sulaa’s people every year. The reclamation has impact on the social, economic, and cultural community. This paper aims to show the variety of spatial changes of settlements and spatial behavior of people in the postreclamation of the coastal settlement. This research uses Phenomonology paradigm and inductive analysis methods. The main instrument is the researcher ownself with the hypothesis that a researcher can see the object in its context, observes directly and improves the awarness continuously.     This research showed there are spatial changes occured in post-reclamation of the coastal settlement, includes (1) a change in the spatial patterns and density of buildings, which is followed by a change in the orientation of the building and adjustment of space in their homes, especially the buildings in the area of reclamation;(2) spatial patterns of social, economic and cultural community tends to be oriented to the shore.Keywords: Spatial changes, post-reclamation of the coastal settlement, Sulaa.

Abstract

Kauman Yogyakarta adalah salah satu permukiman tradisional yang punya latar belakang budaya dan agama yang kuat, sampai saat ini permukiman Kauman masih dapat bertahan terhadap desakan pembangunan modern kota ini. Penelitian ini mencoba untuk mengetahui dan memahami bagaimana para warga permukiman Kauman Yogyakarta mengelola pembangunan dan perubahan-perubahan seperti apa yang dialaminya. Penelitian ini memakai metode fenomenologi Husserl yang menerapkan model penyaringan tiga tahap untuk mencapai hakekat, yaitu deskripsi, eiditis dan transendental. Tercakup pula dalam tulisan ini penjelasan singkat mengenai perkembangan sosial masyarakat Kauman Yogyakarta, yang berfungsi sebagai latar belakang pengetahuan saja. Selanjutnya pada bagian pembahasan dijelaskan secara utuh perubahan makna ruang yang terjadi di permukiman Kauman Yogyakarta yaitu desakralisasi pada ruang cikal bakal permukiman ini.
